המערער הורשע ביום 21.3.2012 על פי הודאתו בעבירות של סיכון חיי אדם בנתיב תחבורה, עבירה על פי סעיף 332(2) לחוק העונשין, התשל"ז-1977 (להלן: חוק העונשין ); הפרעה לשוטר במילוי תפקידו, עבירה על פי סעיף 275 לחוק העונשין ושיבוש הליכי משפט, עבירה על פי סעיף 244 לחוק העונשין. על פי עובדות כתב האישום המתוקן, ביום 1.1.2012, נפגש המערער עם נ' וב' (להלן: האחרים ) והם החלו נוהגים בשתי מכוניות בעוד הם נושאים עימם כלי פריצה ובהם שלושה מכשירי לום, פטיש חמישה ק"ג, מכשיר דיסק, מיכלי חמצן ועוד. בהגיעם לבית המיועד לפריצה נשאו עימם השלושה גם כובעים המכסים את הפנים. נ' התמקם מתחת לבניין ושימש כתצפיתן עבור ב' והמערער שנכנסו למקום סמוך. לאחר כעשרים דקות התקשר נ' לשניים והורה להם לסגור את התריס כדי שלא יבחין בהם אדם ששהה במקום. אחד מהשלושה נסע ברכב וסרק את הרחובות הסמוכים. לאחר כשעה וטרם נפרץ הבית המיועד, נסעו השלושה מהמקום כאשר ברכב נוהג המערער. רכבי משטרה חסמו את ציר התנועה שנסעו בו והשלושה נסעו לאחור בפראות לאורך כל אורכו של הרחוב. במהלך הנסיעה אחורנית נאלצו מספר הולכי רגל לקפוץ לצד הדרך בכדי לא להיפגע וכן פגעו השלושה בחלק הקדמי של רכב משטרתי שהיו בו מספר שוטרים. כמו כן, במהלך הנסיעה לאחור נפגעו שני כלי רכב שחנו בצידי הרחוב ונגרמו להם נזקים. רכב משטרתי נוסף שהגיע לאזור נפגע אף הוא במהלך נסיעת השלושה ונגרם לו נזק בחלקו השמאלי. לאחר מכן, השלושה סובבו את הרכב ועם תחילת נסיעתם קדימה פגעו ברכב משטרתי נוסף שניסה לחסום את רכבם.

השלושה המשיכו לנסוע בפראות ובמהירות מופרזת תוך שהם חוצים פס לבן רציף, עוקפים כלי רכב באופן מסוכן, גורמים לכלי רכב לסטות לשולי הכביש, וחוצים צומת באור אדום. בהבחינם ברכב משטרתי אשר חוסם את הדרך פנו השלושה לדרך עפר וב' השליך את תעודת הזהות שלו. השלושה שבו לכביש והמשיכו לנהוג בצורה פרועה תוך יצירת הסיכונים שתוארו לעיל. בהגיעם לצומת מרכזי, ולאחר שחצו אותו באור אדום, התנגשו השלושה בחלקו האחורי של אוטובוס אשר ניזוק כתוצאה מכך. כיוון שרכבם נפגע קשות החלו השלושה להימלט בריצה אשר במהלכה השליך נ' את הטלפון הנייד שלו. במהלך המרדף הרגלי אחרי ב' נפל קצין משטרה וספג מכה בראשו. כן צוין בכתב האישום המתוקן כי המערער ונ' תיאמו ביניהם גרסאות.

בטרם מתן גזר דין הורה בית המשפט על הכנת תסקיר שירות מבחן בעניינו של המערער. מתסקיר שירות המבחן עלתה הבנה חלקית של האירוע על ידי המערער. עם זאת, לאור גילו הצעיר והמסקנה כי שליחתו למאסר עלולה לפגוע בשאיפותיו לעתיד ולהיות הרסנית עבורו, המליץ שירות המבחן על ענישה צופה פני עתיד. בגזר דינו, התייחס בית המשפט לחומרת העבירות בהן הורשע המערער ולחלקו הגדול בביצוען, שכן הוא זה אשר נהג ברכב והשליטה בו היתה בידו. בית המשפט קבע כי הנסיעה הפרועה, לאורך מרחק, מלמדת על חוסר מורא מן החוק. בית המשפט נתן דעתו לנזקים שנגרמו בעקבות המקרה לכלי רכב רבים וכן לנזקים אשר היו עלולים להיגרם וביניהם קיפוח חיי אדם. עוד התייחס בית המשפט להמלטות המערער מפני השוטרים ולחוסר נכונותו לציית לקריאותיהם. לקולא שקל בית המשפט את העדר העבר הפלילי של המערער, את גילו הצעיר ואת הודאתו במיוחס לו. על בסיס זה, דחה בית המשפט את המלצת שירות המבחן וקבע כי נסיבותיו האישיות של המערער נסוגות מפני הצורך בענישה מרתיעה, נוכח חומרת העבירות. כן קבע בית המשפט כי לא נמצאו בדברי המערער חרטה ולקיחת אחריות. על בסיס זה, גזר בית המשפט על המערער עונש של 30 חודשי מאסר בפועל; 24 חודשי מאסר על תנאי למשך שלוש שנים ופסילה מהחזקת רישיון נהיגה למשך ארבע שנים החל מיום שחרורו.

מכאן הערעור שלפנינו. במסגרתו, טוען המערער כי בית המשפט המחוזי לא נתן משקל מספק לתסקיר שירות המבחן, לפיו יש להטיל עליו ענישה צופה פני עתיד. לטענתו, יש לתת משקל ניכר לנסיבותיו האישיות ולכך שהודה במיוחס לו. עוד טוען הוא כי ניתן למצוא מקרים דומים בהם נגזר עונש קל מזה שהוטל עליו, וכי שגה בית המשפט המחוזי בקבעו כי לא ניכרת ממנו חרטה. לבסוף, טען כי מאז שהחל במאסרו ניכר שהתנהגותו חיובית, ויש לקצר את העונש שהוטל עליו משיקולי שיקום.

במענה, סומכת המשיבה את ידיה על גזר דינו של בית המשפט המחוזי. לשיטתה, חומרת העבירות ואורכו של המרדף מצדיקה עונש מאסר כפי שנגזר. בהקשר זה מציינת המשיבה כי למערער היו מספר הזדמנויות לחדול ממעשיו אך הוא לא עשה כן.

בסמוך לדיון בפנינו הוגש לעיוננו תסקיר שירות מבחן משלים בעניינו של המערער, ממנו עולה כי הוא משתף פעולה במסגרות השיקום השונות בבית הסוהר, וניכר כי הוא מבקש לשקם את חייו.

לאחר שעיינו בגזר הדין של בית המשפט המחוזי, בהודעת הערעור על נספחיה ובתסקיר שירות המבחן, ולאחר ששמענו את טענות הצדדים ואת עמדת שירות המבחן, מצאנו כי דין הערעור להידחות.

כידוע, ערכאת הערעור תתערב בחומרת העונש שהוטל על ידי הערכאה הדיונית רק במקרים שבהם ניכרת סטייה של ממש ממדיניות הענישה הראויה (ראו למשל: ע"פ 9097/05 מדינת ישראל נ' ורשילובסקי (3.7.2006); ע"פ 1242/97 גרינברג נ' מדינת ישראל (3.2.1998); ע"פ 3091/08 טרייגר נ' מדינת ישראל
(29.1.2009)). בהליך שלפנינו טענתו של המערער מבוססת על שיקולי השיקום. הלכה היא כי לשיקולי שיקום ינתן משקל בבואו של בית משפט זה לבחון ערעור על גזר דין. במסגרת בחינה זו, נקבע כי ערכאת הערעור תבחן גם את ההליך הטיפולי שעובר מערער בחלוף הזמן מיום מתן פסק דינה של הערכאה הדיונית (ראו: ע"פ 7445/12 אבו מוסא נ' מדינת ישראל (6.3.2013)). אכן, ניכר שהמערער עושה מאמצים לשקם את דרכיו במהלך מאסרו. עם זאת, במקרה דנן, על אף מאמצי השיקום של המערער, מצאנו כי אין מקום להתערב בגזר דינו של בית המשפט המחוזי, העולה בקנה אחד עם מדיניות הענישה בגין עבירות מסוג זה (ראו: ע"פ 6099/12 ניסימי נ' מדינת ישראל (18.11.2012); ע"פ 3954/08
אבו גודה נ' מדינת ישראל (6.4.2009)). בבחינת למעלה מן הצורך, יצוין כי רבות נכתב על הסיכון הנשקף מהעבירות בהן הורשע המערער ויש לנהוג במורשעים בהן ביד חזקה, למען שלום הציבור (ראו: ע"פ 3757/12 מחראב נ' מדינת ישראל (24.6.2012)). גם לגישתנו יש לתת את הבכורה במקרה שלפנינו לאינטרס ההגנה על שלום הציבור. זאת, נוכח העבירות הקשות שביצע ונסיבות ביצוען, ובראשן הנסיעה שארכה עשרות קילומטרים במהלכה לא חדל המערער מלסכן חיי אדם, וחוסר המורא שהפגין כלפי רשויות אכיפת החוק. אנו תקוה כי ימשיך לצעוד בדרך השיקום בו החל, למען עתידו.

סוף דבר, הערעור נדחה.
