החלטה

בקשה לעיכוב ביצוע גזר דינו של בית המשפט המחוזי בחיפה (השופטת ד' סלע ), בת"פ 14825-04-13, מיום 1.9.2014, במסגרתו הושתו על המבקש 24 חודשי מאסר לריצוי בפועל, מאסר מותנה וקנס.
כתב האישום

המבקש הורשע על יסוד הודאתו במסגרת הסדר טיעון בעובדות כתב אישום מתוקן בעבירות של החזקת סם מסוכן שלא לצריכה עצמית, לפי סעיף 7(א)+(ג) רישא לפקודת הסמים המסוכנים (נוסח חדש), תשל"ג-1973 (להלן: הפקודה ), והחזקת כלים לפי סעיף 10 רישא לפקודה.

על פי הנטען בכתב האישום המתוקן, ביום 13.8.2014 החזיק הנאשם בביתו 1,800 כדורי סם מסוכן מסוג MDPV
מחולקים ל-9 אריזות; 17 גרם
של אבקת סם מסוכן מסוג MDPV
(להלן: הסם ); ומשקל דיגיטלי.

ביום 1.9.2014 גזר בית המשפט המחוזי על המערער 24 חודשי מאסר לריצוי בפועל, 15 חודשי מאסר על תנאי למשך 3 שנים בגין עבירה בה הורשע או על עבירת סמים, וקנס בסך 10,000 ש"ח או מאסר תחתיו למשך 3 חודשים. בית המשפט המחוזי קבע כי בנסיבות העניין בשים לב לעקרון ההלימה ובהתחשב בחומרת העבירה, בנסיבות הקשורות בביצועה, לרבות סוג הסם שנתפס בחזקת הנאשם ומשקלו, וכן הערכים החברתיים שנפגעו מביצועה ומדיניות הענישה הנהוגה בעבירות אלה, יעמוד טווח הענישה במקרה הרלבנטי בין שנתיים לחמש שנות מאסר. בית המשפט המחוזי לקח בחשבון לקולה את גילו של המערער בעת ביצוע העבירה (37), עברו הנקי, ואת נסיבותיו האישיות כפי שפורטו בהרחבה בתסקיר שירות המבחן ומפי סנגורו. עם זאת, בית המשפט ציין כי תהיה לנסיבות האישיות השפעה מועטה בלבד. כן, נלקחו גם בחשבון לזכות המערער הודייתו בביצוע העבירות במשטרה ובבית המשפט, לאחר שכתב האישום תוקן במסגרת הסדר הטיעון, האחריות שנטל על עצמו, והחרטה שהביע בגינם. נדחתה המלצת שירות המבחן להטיל על המערער צו מבחן למשך שנתיים ועונש מאסר שירוצה בעבודות שירות. נפסק כי לאור נסיבות העניין וחומרתן של עבירותיו, משקל נסיבותיו האישיות של המערער פוחת לעומת השיקול הציבורי המחייב מסר הרתעתי ברור בענישה.
הבקשה

המבקש טען בבקשתו כי סיכויי הערעור הם טובים וזאת לנוכח חומרת העונש שהוטל עליו. נטען כי בית המשפט לא ייחס משקל מספק לנסיבותיו האישיות ולעברו הפלילי הנקי. כן נטען, כי בית המשפט לא נתן משקל מספק לכך שהמבקש קיבל אחריות מלאה למעשיו והודה בהם. המבקש טען גם כי לא ניתן משקל מספק להמלצת שירות המבחן לא להטיל עונש של מאסר בפועל עליו, וכי בפועל יש פער ניכר בין המלצת שירות המבחן לבין גזר הדין. אשר לחשש להימלטות מן הדין, נטען כי יש לזקוף לזכותו את התנהגותו התקינה במהלך ניהול ההליך והקפדתו להתייצב לכל דיוניו כנדרש. לבסוף, המבקש טען כי גם בהשתת עונשי מאסר ממושכים, נוהג בית המשפט להיעתר לבקשת עיכוב ביצוע עד ההכרעה בערעור ותמך זאת בהפניה לפסיקה.

המשיבה בדיון בפני ביקשה לדחות את הבקשה וטענה כי היא סבורה שהבקשה היא בעיקרה דחיית הקץ. זאת משום שהסיכוי שהעונש שהוטל על המבקש יופחת לעונש מאסר אשר ירוצה בעבודות שירות הוא נמוך מאוד, והעונש אשר נגזר על המבקש הוא הרף התחתון שבית המשפט נקב לעבירות מסוג הזה. לדידה, אמנם שירות המבחן המליץ על עונש אשר ירוצה בעבודות שירות אך בית המשפט נימק היטב מדוע הוא לא יכול לקבל המלצה זו.
דיון והכרעה

לאחר שעיינתי בבקשה ובגזר דינו של בית המשפט המחוזי ולאחר ששמעתי את טיעוני הצדדים, הגעתי לכלל מסקנה, כי דין הבקשה להידחות .

כידוע, אין בעצם הגשת ערעור כדי להצדיק עיכוב ביצוע גזר הדין. את העונש יש לרצות בסמוך לאחר מתן גזר הדין, שכן חזקת החפות אשר עמדה למבקש במהלך משפטו, אינה עומדת לזכותו עוד לאחר הרשעתו. על המבקש עיכוב ביצוע מוטל אם כן נטל של ממש להוכיח כי ראוי לקבל את בקשתו (ראו" ע"פ 111/99 שוורץ נ' מדינת ישראל , פ"ד נד (2) 241 (2000)).

המקרה שלפנינו אינו בגדר אותם מקרים בהם ראוי להורות על עיכוב ביצוע. עם כל ההתחשבות בנסיבותיו האישיות של המבקש, אין בהן כדי לשנות מן ההחלטה. העבירה בה הורשע המבקש היא עבירה חמורה, ולאחר עיון בהודעת הערעור, התרשמתי כי סיכוי הערעור הלכאוריים נמוכים.

מזכירות בית המשפט מתבקשת לקבוע את הערעור לדיון בהקדם האפשרי.
סוף דבר, הבקשה נדחית .
על המבקש להתייצב לתחילת ריצוי עונשו בבימ"ר קישון, ביום 19.10.2014 לא יאוחר מהשעה 10:00, או על פי החלטת שב"ס, כשברשותו תעודת זהות או דרכון. על המבקש לתאם את הכניסה למאסר, כולל האפשרות למיון מוקדם, עם ענף אבחון ומיון של שב"ס בטלפונים: 08-9787377, 08-9787336.
