ביום 8.10.2013 הוגש כתב אישום (מתוקן), המייחס למערער מספר עבירות של קבלת דבר במרמה בנסיבות מחמירות לפי סעיף 415 סיפא לחוק העונשין, התשל"ז-1977 (להלן – חוק העונשין ); הוצאת שיק ללא כיסוי לפי סעיף 432(א) לחוק העונשין; סחיטה באיומים לפי סעיף 428 סיפא לחוק העונשין; שימוש במסמך מזויף לפי סעיף 420 לחוק העונשין וזיוף בכוונה לקבל באמצעותו דבר, לפי סעיף 418 אמצע לחוק העונשין. ביום 19.11.2013 התקיים בפני בית המשפט דיון הוכחות. במהלך הדיון, הזהיר בית המשפט את המערער כי בעקבות דברים שהשמיעה אחת העדות, עליו להתגונן מפני עבירה נוספת של איומים וסחיטה באיומים, על אף שזו לא יוחסה לו בכתב האישום. בנוסף, לאורך חקירתם של העדים, בית המשפט העיר לבא כוח המערער מספר פעמים על התארכות החקירה. בית המשפט ציין כי "חלקן הגדול של השאלות לא רלוונטי והיה מוטב לוּ [עורך הדין] היה מוותר עליהן מלכתחילה" והעיר כי "השאלות מזיקות לקו ההגנה". בהמשך, במסגרת הבעת ביקורת על האופן שבו הקריא בא-כוח המערער דברים מתוך הודעתה של אחת העדות, חיקה בית המשפט את אופן התבטאותו של עורך הדין. במועד אחר, בתגובה לעמדת המערער כי אחד מבאי כוחו אינו יכול לייצגו בדיון ממנו יעדר חברו למשרד, ציין בית המשפט כי עורך הדין אינו מהווה רק "שעון דובר ", אלא הוא חתום על חלק מן הבקשות ונוכח בדיונים באופן פעיל.
ביום 20.11.2013, הגיש המערער שתי בקשות – האחת לתיקון פרוטוקול הדיון מיום 19.11.2013 והאחרת לפסילתו של בית המשפט מלדון בהליך. ביום 21.11.2013 התקיים דיון בבקשות אלו. בתגובה להפניותיו של המערער לעמודים בפרוטוקול אותם הוא מבקש לתקן, ציין בית המשפט כי לאחר הדיון עובר הפרוטוקול עריכה והגהה על ידי הקלדנית, ולכן משתנה מספור עמודי הפרוטוקול. לאור זאת, בית המשפט תיקן את הפניית המערער, שהסתמך על פרוטוקול אותו קיבל במהלך הדיון, לעמודים המעודכנים לאחר עריכה זו. החלטה בבקשה לתיקון פרוטוקול ניתנה במהלך הדיון. ביום 24.11.2013 דחה בית המשפט את בקשת הפסלות לאחר שניתנה שהות למשיבה להגיש את תגובתה. על החלטה זו הוגש הערעור שלפניי. יש לציין כי בקשת הפסילה ותגובת המשיבה לא צורפו לערעור.

במסגרת הערעור, טען המערער כי הזהרתו של בית המשפט את המערער כי עליו להתגונן מפני עבירה נוספת מהווה "טרור משפטי"(!),
וכי מטרתה להעניש את עורך דינו של המערער בתגובה להתבטאויותיו. ככזו, היא מעידה כי דעתו של בית המשפט ננעלה ביחס לאשמתו של המערער. בנוסף, לשיטת המערער, שלל התבטאויותיו של בית המשפט כלפי באי הכוח, ובכלל זאת חיקויו של בא-כוח המערער והתבטאויותיו ביחס לפגמים בייצוגו מהווים העלבה של צוות ההגנה. התבטאויות אלו מראות שדעתו של בית המשפט ננעלה והן חותרות תחת יחסי עורך דין עם לקוחו. לבסוף, טוען המערער כי עריכת הפרוטוקול בהעדר הצדדים מעידה אף היא על דעה קדומה של בית המשפט ביחס אליו.

בהחלטתו מיום 24.11.2013, נימק בית המשפט את החלטתו לדחות את בקשת הפסלות, בקובעו כי החלטתו להזהיר את המערער כי עליו להתגונן מפני עבירה נוספת, לא נבעה מרצונו להעניש את עורך דינו של המערער. החלטה זו נבעה מחובתו, בהתאם לסעיף 184 לחוק סדר הדין הפלילי, התשמ"ב-1982, אשר מקנה סמכות לבית המשפט להרשיע נאשם בעבירה שאשמתו בה נתגלתה מן העובדות שהוכחו לפניו, אף אם עובדות אלה לא נטענו בכתב האישום, ובלבד שניתנה לנאשם הזדמנות סבירה להתגונן. עצם ציון האזהרה לאחר שבא כוח המבקש העיר דבר-מה בנושא, אינה מעידה כי מ דובר
בענישה המופנית לעורך הדין. בית המשפט הבהיר כי מ דובר
בהחלטה דיונית, בדומה להחלטות הנוגעות לאופן ניהול החקירות והערות על פגמים שנפלו בו. בנוסף, בית המשפט ציין כי הערות והחלטות דומות הופנו גם ביחס להתנהלות המשיבה. עוד הבהיר בית המשפט כי התייחסותו לעו"ד הרשקוביץ '

"שעון דובר " נאמרה בבדיחות הדעת, בהתייחס לכך שעורך הדין פעיל ומעורב בניהול ההליך.

דין הערעור להידחות. ראשית, אין בהחלטותיו של בית המשפט ביחס לעריכת הפרוטוקול וביחס לאפשרות כי המערער יורשע בעבירה נוספת כדי להעיד על כך שדעתו ננעלה. הלכה היא שאין בהחלטותיו של בית המשפט הנוגעות לניהול הדיון להביא לפסילתו, אלא בנסיבות חריגות המצביעות על קיומו של חשש אובייקטיבי ממשי למשוא פנים בניהול המשפט ולפגיעה בזכותו של בעל הדין להליך הוגן (ראו למשל: ע"פ 3374/09 פקירי נ '

מדינת ישראל , פיסקה 7 (2.11.2009); ע"פ 4165/13 ד. רותם ומאור (2009) בע"מ נ ' מדינת ישראל – משטרת ישראל (13.6.2013); יגאל מרזל דיני פסלות שופט , 178-174 (2006) (להלן – מרזל )). לא מצאתי ממש בטענת המערער כי יש בהחלטות כדי להקים חשש שבית המשפט נוהג כלפיו במשוא פנים. אף אם נפלה טעות בהחלטות, ולמותר לציין כי אינני מביע עמדה בדבר, הרי שמקומן של טענות מסוג זה הוא בערעור על פסק הדין (אם המערער יורשע בדין) ולא בערעור פסלות.
שנית, טוען המערער כי התבטאויותיו של בית המשפט כלפי באי כוחו מעידות אף הן על משוא פנים ועל כך שדעתו של בית המשפט ננעלה. הלכה היא כי התבטאות של בית המשפט, אף אם אינה מוצלחת, אין בה בדרך כלל, משום עילה לפסילת שופט, ויש לבדוק כל מקרה על פי נסיבותיו. הנטל הינו על המערער להראות שהתבטאויות אלו מקימות חשש ממשי ואובייקטיבי למשוא פנים. אין לראות בהתבטאויות בית המשפט בענייננו משום חריצת דעה שאינה ניתנת לשינוי (סעיף 77(א) לחוק בתי המשפט [נוסח משולב], התשמ"ד-1984. ראו למשל: ע"א 8684/12 פלונית נ ' פלוני (27.1.2013);

196-19 0). במקרה דנא, ההתבטאויות של בית המשפט והערותיו אין בהן משום הבעת עמדה ביחס לאשמתו של המערער, זאת בפרט מקום שבית המשפט ביקר אף את ניהול ההליך מטעם המשיבה.

יש לציין עוד, כי המערער התייחס בפתח ערעורו לכך שבית משפט קמא "הזמין" אותו להגיש ערעור פסלות. עמדת בית המשפט כי באפשרות המערער להגיש בקשת פסלות, ניתנה לאחר שהמערער התייחס בכתבי טענותיו לכך שאין להציג מידע בדבר עברו הפלילי, ומידע המתייחס לטענות שהועלו בבקשת המעצר. המערער טען שהצגת הדברים על ידי המשיבה נבעה "מרצונה של המשיבה להעביר הדיון אל מותב אחר". בצדק, קבע בית המשפט כי אין מקום לרמוז בכתבי הטענות לאפשרות פסילתו של המותב. אם
המערער מצא לנכון, היה עליו להגיש בקשת פסלות, אך בה בעת היה עליו להימנע מלהזכיר אפשרות זו, כמאין איום, במסגרת הגשת טענותיו לגופם של דברים.

לפיכך, הערעור נדחה מבלי שהמשיבה נתבקשה להגיב. ביום 29.11.2013 הגיש המערער בקשה להפסיק את ההליך המתקיים בבית המשפט קמא עד להכרעה בערעור זה. לאור הכרעתי בערעור לגופו, איני נדרש להכריע בבקשה זו שממילא התייתרה.
