בקשה לפטור מאגרה ועירבון
החלטה
לפניי בקשה לפטור מתשלום אגרה ומהפקדת ערבון בהליך שבכותרת.

ההליך נסב על החלטה של בית המשפט המחוזי בחיפה שניתנה במסגרת תביעה לתשלום פיצויים בגין תאונת דרכים בה נפגע המבקש 1, קטין יליד 1994. התביעה הוגשה נגד משיבה 1 (קרנית) וזו הגישה הודעת צד ג' נגד הוריו של המבקש 1. ההורים הגישו הודעת צד ד' נגד משיבים 2 -4 בטענה כי התירו את השי מוש
ברכב ללא ביטוח חובה. בהחלטתו הורה בית המשפט על מחיקת הודעת צד ד' נגד משיבים 2 -4. סילוק הבקשה היה בנימוק כי רק לקרנית, לה מוקנית זכות החזרה על פי חוק, שמור שיקול הדעת הבלעדי אל מי מבעלי הדין שהחוק מאפשר לה לחזור אליהם היא אכן תחזור. צד ג' שנתבע על ידי קרנית אינו יכול להיכנס בנעלי קרנית ולחזור אל בעלי דין נוספים הדרושים או הנכונים בעיניו.

בבקשה לפניי נטען כי בעקבות הפגיעה סובל מבקש 1 מנכות קשה, הוא משותק בכל גופו ותלוי לחלוטין בעזרת הזולת. נמסר כי מבקש 1 מקבל אמנם גמלת ניידות וגמלת ילד נכה מן המוסד לביטוח לאומי, וכן מתקבלות "מקדמות זניחות" מקרנית, אולם ההכנסות אינן מספיקות לכלכלת המשפחה. משיבה 1 הודיעה כי היא מותירה את העניין לשיקול דעת בית המשפט. משיבים 3 -4 מתנגדים לבקשה, הן בטענה כי סיכויי ההליך נמוכים והן בטענה כי לא הוכח חוסר יכולת כלכלית. משיבים 3 -4 הוסיפו וטענו כי מבקש 1 וקרנית כלל אינם צדדים להליך דנן ועליהם להימחק מהבקשה לרשות ערעור.

על בעל דין המבקש פטור מתשלום אגרה ומהפקדת ערבון מחמת עוניו לפרוש לפני בית המשפט תשתית עובדתית מלאה ועדכנית בדבר מצבו הכלכלי. המבקשים לא עמדו בנטל הנדרש במלואו. אמנם, מן הבקשה ומן החומר המצוי בתיק עולה כי המבקש 1 נפגע פגיעה קשה ביותר. יש להניח כי מצבו הרפואי מטיל על המבקשים מעמסה כלכלית כבדה. יחד עם זאת, היה על המבקשים לפרט בבקשתם נתונים המאפשרים לעמוד על יכולתם לשלם אגרה ולהפקיד ערבון, וזאת לא נעשה. בבקשה לא פורטו נכסיהם של המבקשים. לא צורפו לה תלושי שכר, דפי חשבון בנק, קבלות על הוצאות או אסמכתאות אחרות שהיו יכולות לשפוך אור על מצבם הכלכלי. בנוסף, הבקשה אינה מבהירה מדוע המבקשים אינם יכולים להסתייע בסביבתם הקרובה לצורך גיוס כספי הערבון. במצב דברים זה לא ניתן להיעתר לבקשה, אף מבלי להידרש לסיכויי ההליך. בשים לב לטיב ההליך והיקפו, למצבו הרפואי של המבקש 1, לעמדת משיבה 1 ולהעדר תגובה מצד משיב 2, וליתר נסיבות העניין, יועמד סכום הערבון על סך של 5,000 ₪. הערבון ישמש להבטחת הוצאות שייפסקו לטובת משיבים 3 ו-4 בלבד, ככל שאלו יפסקו. האגרה תשולם והערבון יופקד תוך 21 ימים מעת המצאה החלטה זו, ולא - יימחק ההליך או יידחה, לפי העניין, ללא צורך במתן הודעה נוספת.

בשולי הדברים יוער כי לא נפל פגם בצירופם של מבקש 1 וקרנית להליך שבכותרת. לפי תקנה 424 לתקנות סדר הדין האזרחי, התשמ"ד-1984, כל מי שהיה בעל דין בתובענה לפני הערכאה הקודמת ואיננו מערער, יהיה משיב בערעור. כאשר הליך הערעור קשור להודעה לצד ג', הרי שגם הצדדים להליך העיקרי הם בבחינת מי שהיו בעלי דין בבית המשפט קמא לעניין תקנה 424 (השוו, בש"א 8904/05 גרניט הנדסה לתעשיה נ' כלל חברה לביטוח בע"מ (לא פורסם, 2.7.2006); בש"א 4553/01 שיכון ופיתוח לישראל נ' ברזילי פ"ד נה(5) 357).
