החלטה
לפניי בקשה לפטור מהפקדת עירבון בהליך שבכותרת, שנקבע לסך של 15,000 ₪.

ההליך נסב על פסק דינו של בית המשפט המחוזי בתל אביב-יפו, שדן בערעור מטעם המשיב על פסק דין של בית משפט השלום. בית משפט השלום קיבל חלקית תביעה שהגיש המבקש לפיצויים בגין נזקים שנגרמו לו בגין נטילת הלוואה מבנק למשכנתאות כנגד מישכון דירת מגוריו. נפסק כי המצגים המסולפים שהציג המשיב בבקשת ההלוואה, שהופנתה לבנק למשכנתאות, תרמו לכך שבית המגורים מוש כן. בית המשפט המחוזי, בקבלו את הערעור, פסק כי אין להטיל את האשם על המשיב כמי שהציג מצבים מסולפים ואין לקבל את המסקנה לפיה המבקש יטמון ראשו בחול.

בבקשה לפני טוען המבקש – המיוצג מטעם הלשכה לסיוע משפטי – כי הינו גרוש בן 55, נכה צה"ל, מחוסר תעסוקה ואינו מקבל הבטחת הכנסה עקב חוב למוסד לביטוח לאומי. על פי הנטען, המבקש מתגורר בדירה אשר רובצת עליה משכנתא וחוב בסכומים גבוהים והוא מתקיים מסיוע נדיב של אחיו ומשפחתו. המשיב מתנגד לבקשה.

זכאותו של המבקש לסיוע משפטי מלמדת על כך שלכאורה, מצבו הכלכלי של המבקש אינו מן המשופרים. עם זאת, יש ממש בטענת המשיב כי לא הוצגה תשתית ראייתית מספקת על בסיסה ניתן לקבוע כי אין באפשרותו של המבקש להפקיד ערבון. כך, לא הוצגו דפי חשבון בנק, לא ניתן פירוט של נכסי המבקש ושווים ולא הוצג תיעוד בדבר חוב למוסד לביטוח לאומי המונע לכאורה קבלת גמלה של הבטחת הכנסה. כמו כן, לא הובהר מדוע אין ביכולתו של המבקש להסתייע בסביבתו הקרובה – ובפרט בבני משפחתו המסייעים לו בנדיבות לדבריו - בגיוס הסכום הנדרש. לכך יש להוסיף כי סיכויי ההליך מעוררים ספק של ממש, הפועל אף הוא כנגד מתן פטור מלא. יחד עם זאת, נוכח זכאותו של המבקש לסיוע משפטי, להיקפו של ההליך ולמעמדם היחסי של הצדדים, יופחת העירבון לסך של 3,000 ₪. העירבון יופקד תוך 14 ימים מעת המצאת החלטה זו, ולא – יירשם ההליך לדחייה ללא צורך במתן הודעה נוספת.
