בקשה לעיין בתיק בית המשפט
החלטה
לפניי בקשה לעיון בתיק שבכותרת. הבקשה הוגשה על-ידי עורך-הדין חיים ארבל, והנימוק: קיומו של "הליך משפטי מקביל" בבית המשפט המחוזי, שבו המבקש מייצג את אחד הצדדים, ושמתעוררת בו "טענה בדבר בעלות". הצדדים הגישו הודעות שלפיהן הם אינם מתנגדים לבקשה, למעט המשיבה 2 שמסרה את התנגדותה מן הטעם שהבקשה אינה מנמקת כראוי את מטרת העיון ואת הקשר של המבקש לתיק שבכותרת.
לאחר שעיינתי בחומר שלפניי הגעתי לכלל מסקנה כי דין הבקשה להתקבל.
המסגרת הנורמטיבית לבחינת בקשה לעיון בתיק בית-משפט של מי שאינו בעל-דין קבועה בתקנה 4 ל תקנות בתי המשפט ובתי הדין לעבודה (עיון בתיקים), התשס"ג-2003 (להלן: התקנות ). תקנה 4(א) לתקנות מורה כי "כל אדם רשאי לבקש מבית משפט לעיין בתיק בית משפט, ובלבד שהעיון בו אינו אסור על-פי דין". בענייננו, אין טענה כי קיים איסור בדין לעיון המבוקש. עם זאת, המשיבה 2 מתנגדת כאמור לעיון, שכן לדבריה הבקשה אינה מנומקת די הצורך. אלא שבהקשר זה נפסק כי נטל ההנמקה הרובץ על מבקש העיון הוא קל יחסית, זאת בהתחשב בחשיבותו הרבה של עקרון פומביות הדיון (ראו למשל בג"ץ 5917/97 האגודה לזכויות האזרח בישראל נ' שר המשפטים (8.10.2009)). סבורני, כי בנסיבות העניין המבקש עמד בנטל מינימאלי זה בהסבירו – גם אם בניסוח כללי – כי העיון דרוש לו לצורך הליך אחֵר שהוא מנהל.
המשיבה 2 מצדה לא עמדה בנטל להראות כי קיים טעם כבד משקל המצדיק למנוע את העיון (ראו ע"א 8849/01 פקיד שומה למפעלים גדולים נ' פז-גל חברה לשווק בע"מ , פ"ד נט(5) 385, 392 (2005)). בהקשר זה אציין, כי מעיון בתיק עולה שהמשיבה 2 לא הגישה תשובה מנומקת לבקשת רשות הערעור, אלא רק הודעה שלפיה היא מותירה את העניין לשיקול דעתו של בית המשפט. מעבר לכך ומכל מקום, בתגובתה לבקשה שלפניי לא הצביעה המשיבה 2 על פגיעה כלשהי – לא כל שכן על פגיעה קונקרטית ומבוססת – שעלולה להיגרם לה עקב העיון המבוקש (ראו בג"ץ 10076/02 רוזנבאום נ' נציב שירות בתי הסוהר (22.8.2005)).
אשר על כן, ניתנת בזאת למבקש רשות לעיין בתיק. העיון ייעשה במזכירות בית-המשפט בהתאם לנוהל המקובל. אין צו להוצאות.
