המשנה לנשיאה א' ריבלין:

השאלה המתעוררת בתיק זה שלפנינו היא האם יש תחולה לכיסוי ביטוחי במקום שבו אירעה תאונת-דרכים והנהג – בהיותו נהג חדש – הפר את ההוראה המחייבת ליווי של נהג מלווה (סעיף 12א1 לפקודת התעבורה (נוסח חדש), התשכ"ה-1961). בית-המשפט העליון הכריע בעבר בשאלה זו אולם זאת בהתייחס לתביעה לפי חוק פיצויים לנפגעי תאונות דרכים, התשל"ה-1975 (להלן: חוק הפיצויים ), וקבע כי הזכאות לפיצויים אינה נשללת מכוח סעיף 7(3) לחוק הפיצויים ומכוח הוראות הפוליסה (ע"א 8183/01 סיפאשוילי נ'
מנורה חברה לביטוח בע"מ , פ"ד נח(6) 106 (2004)); בית-המשפט העליון נסמך בהקשר זה על ההלכה שנפסקה בדנ"א 10017/02 קרנית נ' מגדל חברה לביטוח בע"מ , פ"ד נח(5) 639. בענייננו, לא מ דובר על תביעה בגין נזקי גוף אלא על תביעה בגין נזקי רכוש: הרכב שנהג בו המשיב 1 פגע ברכב אחר שחנה בצד הדרך, וגרם לו נזק. המשיב 1 נמצא אחראי לתאונה זו, והמחלוקת היום נסבה על השאלה אם קמה חבות למבקשת שביטחה את הרכב שבו נהג. השאלה היא איפוא האם הלכת סיפאשוילי יפה גם למקרה כגון זה שלפנינו. בית-המשפט המחוזי, בדעת רוב, סבר כי כך הדבר, ובדין פסק כך.

הניסיון ליצור אבחנה בין הלכת סיפאשוילי לבין המקרה דנן נשען בעיקרו של דבר על התכלית הסוציאלית של חוק הפיצויים, אשר לפי הנטען אינה קיימת במקרה כגון זה שלפנינו הנסוב על תביעה נזיקית בגין נזקי רכוש. אינני סבור כי יש לאבחנה זו מקום בהקשר הנדון. השופט י' כהן, שכתב את דעת הרוב בבית-המשפט המחוזי, עמד על אי-הוודאות שעלולה להיווצר בשל אי-אחידות בתשובה לשאלת קיומו או היעדרו של רשיון נהיגה בתוקף, לצורך הכיסוי הביטוחי. הוא הטעים גם כי הלכת סיפאשוילי איננה אחוזה במטרות הסוציאליות של חוק הפיצויים. אף אנו סבורים כי בהקשר הנדון אין מקום לפרשנות שונה של תנאי הפוליסה על-פי השאלה אם מ דובר בנזק גוף או בנזק רכוש, וכי שאלת הנפקות של הפרת חובת הליווי על הכיסוי הביטוחי צריכה לקבל מענה אחיד. ודוק: הוראת הפוליסה שנדונה בהלכת ספיאשוילי דומה להוראת הפוליסה כאן, לאמור: תחולת הפוליסה הוגבלה למי שהם "בעלי רשיון נהיגה בר תוקף בישראל לנהיגת כלי-רכב מסוג הרכב המבוטח...". בהלכת ספיאשוילי נקבע כי הפרת חובת הליווי אינה הופכת את הנהג למי שאינו מחזיק ברשיון לסוג הרכב שבו נהג. כך שם, וכך גם כאן. אציין כי המבקשת העלתה טענה חלופית בענין אשם תורם מצד המשיב 1 אולם טענה זו לא נתבררה בערכאות הקודמות ואין מקום לבררה כעת לראשונה.
התוצאה היא כי דין בקשת רשות הערעור להידחות. המבקשת תישא בשכר טרחת עורך-הדין של המשיבים 1 ו-2 בסכום של 10,000 ש"ח.
