החלטה
לפניי בקשה לפטור מערבון בהליך שבכותרת, שנקבע לסך של 10,000 ₪.

ההליך נסוב על פסק דינו של בית המשפט המחוזי בתל-אביב-יפו בערעור על פסק דין של ועדת העררים לפי חוק נכי רדיפות הנאצים, התשי"ז- 1957 (להלן: חוק נכי רדיפת הנצים). בפסק דינה של ועדת העררים נדחה ערר כנגד הרשות המוסמכת, שדחתה את תביעת המנוח משה רוטשילד ז"ל (להלן – המנוח) להכרה כנכה רדיפות הנאצים. יצוין כי המנוח נפטר שעה שעניינו היה תלוי ועומד בפני הוועדה. הערר נדחה לאחר שהוועדה לא מצאה עדות התומכת בגרסת המנוח כי בשנת 1943 גויס על ידי הנאצים לעבודות כפייה שכללו חפירת שוחות ותעלות אנטי-טנקים. בית המשפט המחוזי לא מצא מקום להתערב בקביעות העובדתיות של הוועדה, המבוססות על חומר הראיות והתרשמות מן העד שהעיד לפניה. מכאן הבקשה לרשות ערעור.

בבקשה לפניי, שהוגשה על ידי רעייתו של המנוח אשר ירשה את עזבונו, נטען כי אין לרעיית המנוח את האמצעים לממן את הערבון שנקבע. לדבריה, היא פנסיונרית המתקיימת מקיצבת זקנה ושארים בגובה של כ-1,966 ₪ ומקרן פנסיה בסכום דומה. בתמיכה לבקשה הוגש תצהיר של רעיית המנוח ותדפיס פעולות בחשבון הבנק. המשיבה מתנגדת לבקשה, הן בטענה כי סיכויי ההליך נמוכים והן בטענה כי לא הונחה תשתית עובדתית מספקת להוכחת המצב הכלכלי.

החובה להפקיד ערבון בהליך של בקשה לרשות ערעור קבועה בתקנה 404 לתקנות סדר הדין האזרחי, התשמ"ד-1984. תקנה זו חלה, לכאורה, גם על בקשה לערעור לפני בית המשפט העליון בהליכים לפי חוק נכי רדיפות הנאצים, (תקנה 11 לתקנות נכי רדיפות הנאצים (ערעור בפני בית המשפט המחוזי), תש"ל-1969). יוער כי על פי תקנות סדרי הדין המיוחדים שהותקנו בעניין שמיעת הערעור לפני בית המשפט המחוזי בהליכים על פי החוק, לא הוטלה חובה להפקיד ערבון. אולם סדרי הדין המיוחדים אינם חלים, כך נראה, בהליכים לפני בית משפט זה ומכאן שקיימת, ככלל, חובה להפקיד ערבון. בדומה להליכים אחרים, על המבקש פטור מעירבון לעמוד בשני תנאים מצטברים: חוסר יכולת כלכלית להפקיד העירבון וקיום סיכויים טובים להליך. כדי לעמוד בתנאי הראשון על מבקש הפטור לפרוש לפני בית המשפט תשתית עובדתית מלאה ועדכנית בדבר מצבו הכלכלי. המבקש לא עמד בנטל זה במלואו. אמנם, מהבקשה עולה כי המבקש מתקיים מקצבאות זעומות. אולם הבקשה חסרה פירוט בדבר רכושה, לרבות פיקדונות וחסכונות, ובדבר האפשרות להסתייע בקרובים לצורך גיוס כספי ערבון. לכך יש להוסיף כי מעיון בהחלטות בתי המשפט דלמטה עולה כי על פני הדברים, סיכוייה של הבקשה לרשות ערעור להתקבל אינם טובים. יחד עם זאת, בשים לב לתשתית החלקית שהוצגה, ולכלל נסיבות העניין, יופחת הערבון לסך של 1,000 ₪. יוער כי בקביעת שיעור הערבון המופחת נלקח בחשבון גם אופיו המיוחד של ההליך, וזהות בעלי הדין. אין המ דובר בהליך אזרחי רגיל ובמשיבה רגילה. ההליך הוא הליך בעל סממנים יחודיים, הן בהיבט הסוציאלי והן בהיבט ההיסטורי-ערכי והמשיבה היא רשות שלטונית המופקדת על הענקת תגמולים למי שנרדף על ידי הנאצים וסובל מנכות כתוצאה מכך. בשל אופיו של ההליך ומעמדה של המשיבה, נמנע, על פי רוב, בית משפט זה מלהטיל הוצאות לטובת המשיבה, גם כאשר ההליך נדחה. על רקע זה, ובהתחשב בכך שהתכלית העומדת ביסוד החובה להפקיד ערבון היא הגנה על זכותו של בעל הדין הנתבע לממש את גביית ההוצאות שנפסקו לטובתו באופן זמין וודאי (ראו, בש"א 1528/06 ורנר נ' כונס הנכסים הרשמי
(טרם פורסם, 17.10.2007)), ניתן להסתפק בערבון נמוך.
סיכומו של דבר, הערבון יועמד על 1,000 ₪ ויופקד תוך 14 ימים מעת המצאת החלטה זו.
