החלטה

לפני בקשת רשות ערעור על פסק דינו של בית המשפט המחוזי בתל אביב-יפו מיום 14.4.2014 (ע"א 43952-06-13, השופטת ר' לבהר שרון ). בפסק הדין התקבל בחלקו ערעורם של המבקשים על פסק דינו של בית משפט השלום בתל אביב-יפו מיום 13.5.2013 (ת"א 67281/07, השופטת י' רוטנברג ).

המבקשים רכשו מן המשיבה 1, הפניקס הישראלי חברה לביטוח בע"מ (להלן: הפניקס ) פוליסה לביטוח דירה ותכולתה (להלן: הפוליסה ). ביום 16.1.2007, בשעה שהמבקשים לא היו בביתם, נפרץ הבית ונגנבו ממנו חפצי ערך רבים. המבקשים הגישו לבית משפט השלום תביעה כנגד הפניקס, ובה עתרו לתשלום תגמולי ביטוח בסך של 163,771 שקל. בית משפט השלום דחה את התביעה, לאחר שקבע כי המבקשים הפרו את תנאי הפוליסה אשר על-פיהם נדרשו להתקין סורגים על כל חלונות הבית, להתקין בו מערכת אזעקה וכן להציב בבית כספת שבה יישמרו התכשיטים השייכים להם. בית משפט השלום עמד על כך שהמבקשים לא התקינו כספת בבית, וכן על כך שבפועל הפורצים חדרו לבית דרך חלון שלא היה מסורג בעת שמערכת האזעקה לא פעלה. בית משפט השלום ציין עוד כי עדה מטעם הפניקס הצהירה כי לו ידעה הפניקס שדרישות המיגון אינן מתקיימות, לא הייתה מסכימה לבטח את המבקשים אף תמורת תשלום נוסף, וכי היא מעריכה כי גם חברות ביטוח אחרות היו נוהגות כך. לכן, קבע בית משפט השלום כי התקיימו תנאי סעיף 18(ג)(2) לחוק חוזה הביטוח, התשמ"א-1981 (להלן: חוק חוזה הביטוח ), ובהמשך לכך פטר את הפניקס כליל מתשלום תגמולי
ביטוח למבקשים.

המבקשים הגישו ערעור על פסק דינו של בית משפט השלום, וזה התקבל כאמור באופן חלקי בבית המשפט המחוזי. בית המשפט המחוזי קבע כי יש לבחון את התוצאות הנובעות מאי התקנתם של אמצעי המיגון בידי המבקשים לפי ההסדר הקבוע בסעיף 21 לחוק חוזה הביטוח, ממנו נובע שהפרת החובה להתקין אמצעי מיגון או להפעילם לא תשלול אוטומטית מן המבוטח את הזכות לקבל תגמולי ביטוח. בית המשפט המחוזי התייחס בהקשר זה להלכה שנקבעה ברע"א 3260/10 חתמי לוידס נ' סלוצקי (15.9.2013) (להלן: עניין סלוצקי ) וציין כי ההסדר המאפשר למבטח לשלם למבוטח תגמולי ביטוח מופחתים או אף פוטר אותו מתשלום כליל בנסיבות מסוימות הוא למעשה הסדר המיטיב עם המבטח (מאחר שהנחת היסוד היא שכל עוד לא בוטל חוזה הביטוח נדרש המבטח לשלם למבוטח את מלוא תגמולי הביטוח). בית המשפט המחוזי ציין עוד בהקשר זה כי בעניין סלוצקי נקבע כי הנטל להוכיח שמבטח סביר לא היה מתקשר בחוזה הביטוח לו ידע כי המבוטח לא התקין אמצעים להקלת הסיכון או לא הפעילם מוטל על המבטח, וכי כדי לעמוד בנטל זה יש להגיש ראיה חיצונית, כגון תצהיר של אקטואר.

בית המשפט המחוזי קבע כי הפניקס לא עמדה בנטל המוטל עליה להוכיח כי מבטח סביר לא היה מוכן לבטח את ביתם של המבקשים תמורת פרמיה גבוה יותר ואף לא הציגה פוליסה חלופית שעל בסיסה ניתן לקבוע מה צריכים להיות תגמולי הביטוח המופחתים בהתאם לסעיף 18(ג) לחוק חוזה הביטוח. בית המשפט המחוזי קבע כי נוכח האמור לכאורה היה מקום לחייב את הפניקס בתשלום מלוא תגמולי הביטוח, אך הדבר מעורר "קושי מסוים". בית המשפט המחוזי התייחס בהקשר זה להערתה של המשנה לנשיא מ' נאור בעניין סלוצקי שציינה כי עד שניתן פסק הדין באותו עניין שאלת נטלי ההוכחה בהתייחס לסעיף 18 לחוק חוזה הביטוח לא הייתה ברורה. לפיכך, קבע בית המשפט המחוזי כי בנסיבות העניין מדובר במקרה "גבולי" בהתחשב בכך שהדיון בבית משפט השלום התקיים לפני שניתן פסק דין סלוצקי ולכן קבע שיש לחלק את האחריות בין המבקשים לבין הפניקס באופן שהאחרונה תשא במחצית מגובה תגמולי הביטוח.

הבקשה דנן מופנית כנגד פסק דינו של בית המשפט המחוזי. המבקשים טוענים כי עניינם מעורר שאלה כללית הנוגעת למועד אשר ממנו חלה ההלכה שנקבעה בעניין סלוצקי . המבקשים מוסיפים וטוענים כי תוצאת פסק הדין אשר לפיו נשללו מהם מחצית מתגמולי הביטוח גורמת להם לעיוות דין ונעדרת כל נימוק. המבקשים מדגישים בהקשר זה כי הנזק שנגרם להם עקב הפריצה עומד למעשה על סך של 316,566 שקל, אך הם העמידו את סכום התביעה על כמחצית מכך עקב הגבלת השיפוי בפוליסה, וכך יוצא כי הם זכו בסופו של דבר בתגמולי ביטוח בשיעור של כרבע מנזקם בלבד. לגופו של עניין, טוענים המבקשים כי בית המשפט המחוזי כלל לא נימק את הכרעתו לשלול מהם את מחצית מתגמולי הביטוח שתבעו וכי עוד בטרם ניתן פסק הדין בעניין סלוצקי כבר נקבע בפסיקה כי נטל ההוכחה מוטל על המבטח המבקש לשלם למבוטח תגמולי ביטוח מופחתים או להיות פטור כליל מתשלום תגמולי הביטוח.

לאחר שעיינתי בבקשה על נספחיה מצאתי כי דינה להידחות אף מבלי להידרש לתגובת המשיבים. כידוע, במקרים שבהם אין מתעוררת שאלה בעלת חשיבות כללית או ציבורית החורגת מעניינם של בעלי הדין או לא נדרשת התערבותו של בית משפט לשם מניעת עיוות דין, לא תינתן רשות ערעור ב"גלגול שלישי" (ראו: ר"ע 103/82 חניון חיפה בע"מ נ ' מצת אור ( הדר חיפה ) בע"מ , פ"ד לו(3) 123 (1982)) . הבקשה דנן אינה מעוררת שאלה כללית שכן השאלות הנוגעות להחלתו של הסדר התשלום היחסי הקבוע בסעיפים 21-18 לחוק חוזה הביטוח על מקרים בהם לא הותקנו או לא הופעלו אמצעים להקלת הסיכון כבר הוכרעו בידי בית משפט זה בעניין סלוצקי . באותו עניין אף הוכרעה שאלת נטלי ההוכחה בכל הנוגע להסדר האמור. אם כן, אין עוד ספק כעת כי אי נקיטת אמצעים להקלת הסיכון אינה שוללת באופן מיידי את זכותו של המבוטח לתשלום תגמולי הביטוח וכי מבטח המעוניין בפטור מתשלום תגמולי הביטוח או בתשלום תגמולי ביטוח מופחתים עקב אי הפעלת או אי התקנת אמצעים להקלת הסיכון – עליו הנטל להוכיח את התנאים הקבועים בסעיף 18 לחוק (ראו: עניין סלוצקי , בפסקאות 43-40). במקרה דנן לא התעלם בית המשפט המחוזי מההלכה שנקבעה בעניין סלוצקי , וטענותיהם של המבקשים מכוונות רק כנגד יישומה בנסיבות העניין. לטענות מסוג זה אין מקום במסגרת בקשת רשות ערעור ב"גלגול שלישי". על כן, אינני נדרשת להכריע בהן. כן אציין כי לא התרשמתי כי בשים לב למכלול נסיבות העניין נגרם למבקשים עיוות דין.
7.
סוף דבר: הבקשה נדחית. בנסיבות העניין, ומשלא התבקשה תגובת המשיבים, אין צו להוצאות.
