פסק דין
בקשת רשות ערעור על החלטת בית המשפט המחוזי בחיפה בת"א 247/06 (כב' השופטת ב' טאובר ) מיום 16.4.2012, בגדרה נדחתה בקשת המבקש לתקן את כתב התביעה.

ענייננו בתביעת שיבוב של המבקש (להלן: המל"ל ).
בחודש ינואר 2010 ביקש המל"ל להצטרף כתובע לתביעת נאיף אלקעיאן (להלן: הנפגע ) אשר נפגע בתאונת עבודה ביום 27.12.2003. בית המשפט התיר צירוף המל"ל כתובע נוסף וביום 7.2.2011 הורה על הגשת כתב תביעה מעודכן, לאחר שהנפגע והמשיבים הגיעו להסדר פשרה ביניהם. בבקשה לתיקון כתב התביעה ביקש המל"ל לכלול בתביעת השיבוב גם את גמלת הניידות שהחל לשלם לנפגע בחודש יולי 2010, דהינו, לאחר הגשת כתב התביעה המקורי. להוכחת טענתו בדבר גובה הגמלה ומועד תחילת תשלומה, צירף המל"ל תעודת עובד ציבור בה מפורטים התשלומים שבוצעו.
המשיבים התנגדו לתיקון כתב התביעה, בין היתר, בטענה כי לבקשה לא צורף תצהיר כנדרש על פי סעיף 92 לתקנות סדר דין אזרחי התשמ"ד – 1984 (להלן: התקנות ); וכי המל"ל ידע כי הנפגע הגיש תביעה לתשלום גמלת ניידות כבר בעת הגשת כתב התביעה המקורי.

בהחלטתו מיום 16.4.2012 קיבל בית משפט קמא את טענת המשיבים ודחה את הבקשה לתיקון כתב התביעה. בהחלטתו, ציין בית משפט קמא כי מהחומר שצורף על ידי המשיבים עולה כי הנפגע הגיש בקשה להכרה כמוגבל בניידות כבר בשנת 2005 וכי וועדה רפואית לעניין ניידות של המל"ל בדקה אותו כבר בשנה זו ומצאה כי הוא מוגבל בניידות בשיעור של 100% החל מיום 1.6.2005. הנפגע הגיש תביעה להטבה על פי הסכם הניידות בחודש נובמבר 2009 כך שהמל"ל ידע או צריך היה לדעת על זכאותו של הנפגע לגמלת ניידות עובר להגשת בקשתו להצטרף כתובע נוסף. בנסיבות אלה, קיימת חשיבות לתשתית העובדתית, ומשלא צורף לבקשה לתיקון כתב תביעה תצהיר לאימות העובדות לגבי המועד בו נודעו העובדות למל"ל, אין המדובר אך בפגם דיוני אלא בפגם מהותי.

על החלטה זו נסבה הבקשה שבפני.
לאחר שעיינתי בבקשה ובתשובת המשיבים, ומכוח סמכותי לפי תקנה 410 לתקנות , החלטתי לדון בבקשת רשות הערעור כאילו ניתנה רשות והוגש ערעור לפי הרשות שניתנה, ולקבל את הערעור.

כפי שעולה מתשובת המשיבים, למעשה, אין מחלוקת עובדתית בין הצדדים. הגם שהנפגע הוכר כמוגבל בניידות כבר בשנת 2005 והגם שהגיש תביעתו בחודש נובמבר 2009, המל"ל החל לשלם לו גמלת ניידות רק בחודש יולי 2010. מכאן, שבעת הגשת תביעת השיבוב בחודש ינואר 2010, המל"ל לא יכול ולא צריך היה לכלול גמלה זו בתביעתו.
המשיבים הפנו להוראת סעיף 328(א) לחוק הביטוח הלאומי [נוסח משולב], התשנ"ה-1995 ולפיה רשאי המל"ל לתבוע שיבוב מצד שלישי "על הגמלה ששילמו או שהם עתידים לשלם". מכאן טענת המשיבים כי המל"ל צריך היה לכלול את תביעת השיבוב בגין גמלת הניידות כבר בכתב התביעה המקורי.
איני רואה לקבל את הטענה. סעיף 328(א) עניינו בגמלאות העתידיות שטרם שולמו, לאחר שנקבעה זכאותו של הנפגע והגמלה החלה להשתלם, שאז, כדבר שבשגרה, תביעת השיבוב כוללת את השווי המהוון של הגמלאות שישתלמו בעתיד.

קיצורו של דבר, ש העובדות הרלוונטיות לתיקון שנתבקש, קרי, תשלום גמלת הניידות ומועד תשלומה, הוכחו בתעודות עובד ציבור וכוחן של אלה אינו נופל מכוחו של תצהיר. בהתחשב בכך שהמל"ל הוא גוף ציבורי אשר כדבר שבשגרה מוכיח תשלום גמלאות בתעודת עובד ציבור, ובהתחשב בכך שאין מחלוקת עובדתית בין הצדדים, לא היה מקום לדחיית הבקשה לתיקון כתב התביעה עקב אי צירוף תצהיר. לכך יש להוסיף, כי תיקון התביעה נתבקש זמן קצר יחסית לאחר הגשת כתב התביעה המקורי, בסמוך למועד תחילת תשלום גמלת הניידות לנפגע, כך שאין בתיקון המבוקש כדי להרע את מצבם של המשיבים.

אשר על כן דין הערעור להתקבל, כך שיתאפשר למבקש לתקן תביעתו באופן שתכלול גם את גמלת הניידות ששולמה ושעתידה להשתלם לנפגע.
המשיבים ישאו בשכ"ט המשיב בסך 7,500 ₪.
