בקשה לפטור מאגרה ועירבון
החלטה
לפניי בקשה לפטור מתשלום אגרה ומהפקדת עירבון. הבקשה הוגשה במסגרת בקשת רשות ערעור על פסק-דין של בית המשפט המחוזי בחיפה, שבו נדחה ערעורו של המבקש על החלטה של כבוד רשמת בית המשפט המחוזי, שלא לפטור את המבקש מתשלום אגרה.
לאחר בחינת הבקשה שלפניי, תגובת המדינה והחומר שבתיק, ראיתי לנכון לקבל את הבקשה באופן חלקי. זאת על-יסוד השיקולים שלהן:
ראשית , בהליך מסוג זה – בקשת רשות ערעור ב"גל גול שלישי" לעניין פטור מאגרה – לא קמה זכאות לפטור סטטוטורי מתשלום אגרה לפי תקנה 20(4) ל תקנות בתי המשפט (אגרות) , התשס"ז-2007 ( ראו רע"א 3898/07
אחים טופז יהלומים נ' בנק הפועלים לישראל בע"מ (לא פורסם, 31.10.2007); וכן בש"א 9674/07
אחים טופז יהלומים נ' בנק הפועלים לישראל בע"מ (לא פורסם, 15.4.2008)). בוודאי גם אין פטור אוטומטי מהפקדת עירבון. יש אפוא לבחון את הבקשה לפי הקריטריונים הרגילים, קרי: הוכחת חוסר יכולת כלכלית וסיכויי הליך מספקים.
שנית , המבקש הוכרז (בשנת 2010) פושט רגל ולטענתו, מצבו הכלכלי קשה. לא הונחה לפניי טענה נוגדת באשר למצב הכלכלי, והמדינה בתשובתה מתמקדת בסיכויי ההליך.
שלישית , המבקש לא הוכיח כדבעי כי אינו יכול לגייס סכום כלשהו מסביבתו הקרובה. יצוין בהקשר זה כי למבקש ארבעה ילדים, שלושה מהם נשואים. המבקש מציין כי אחד מקרוביו סייע לו כשנדרש להציג ערבות להבטחת הוצאות בבית המשפט המחוזי. עיון בבקשה שלפניי מלמד כי אין פירוט הולם לגבי מצבם הכלכלי של בני המשפחה הקרובים ונכונותם לסייע, ולא הובאו לעניין זה מסמכים כלשהם (ראו גם בש"א 6411/11 שני נ' עו"ד חבר, נאמן לנכסי החייב (טרם פורסם, 3.10.2011); בש"א 9998/09 ונדר נ' בנק דיסקונט למשכנתאות בע"מ (טרם פורסם, 17.12.2009)).
רביעית , לגבי סיכויי ההליך, בלי לקבוע מסמרות אציין כי כאן ניצב המבקש מול משוכה גבוהה למדיי. כך במיוחד בשים לב לעובדה שנושא האגרה כבר נבחן בבית המשפט המחוזי בשני "גל גול ים". יובהר, כי הבסיס העיקרי לשלילת הפטור מאגרה בבית המשפט קמא נעוץ בסכום התביעה ה"אסטרונומי" (36,000,000 ₪), שבית המשפט קבע כי הוא מופרז ולא נשען על פירוט וביסוס הולמים.
לאור כל האמור, ובשים לב לתגובת המדינה שאינה מתנגדת להפחתה מסוימת בסכום העירבון, הריני לקבוע כדלקמן: המבקש יהא פטור מתשלום אגרה בתיק זה, ועליו להפקיד עירבון בסך של 3,000 ₪ תוך 21 ימים מעת המצאת החלטה זו. בהיעדר הפקדה יירשם ההליך לדחייה ללא הודעה נוספת.
