בקשה לפטור מאגרה ועירבון
החלטה
לפניי בקשה לפטור מתשלום אגרה ומהפקדת עירבון בגדרי בקשת רשות ערעור על פסק-דין של בית המשפט המחוזי בתל-אביב-יפו. בפסק-הדין נדחה ערעורו של המבקש על החלטה של כבוד רשמת בית המשפט המחוזי, אשר פטרה את המבקש מתשלום אגרה בגדרי הליך ערעורי שהגיש, אך חייבה אותו בהפקדת עירבון בסך של 4,000 ₪.
אומר מיד כי המבקש מרבה בנקיטת הליכים בערכאות השונות, לרבות בבית משפט זה, ולעניין השיקולים הנוגעים לבקשות הפטור מטעמו אני מפנה, למשל, להחלטתי מיום 15.12.2011 בע"א 7699/11, ולפסק-הדין של כבוד השופט ג'ובראן מיום 10.1.2012 בבש"א 9707/11. עוד אציין כי המבקש אינו זכאי לפטור אוטומטי-סטטוטורי מתשלום אגרה לפי תקנה 20(4) לתקנות בתי המשפט (אגרות), התשס"ז-2007, זאת משום שמדובר בהליך ב"גל גול
שלישי" בעניין העירבון (ראו רע"א 3898/07 אחים טופז יהלומים נ' בנק הפועלים לישראל בע"מ (לא פורסם, 31.10.2007); וכן בש"א 9674/07 אחים טופז יהלומים נ' בנק הפועלים לישראל בע"מ (לא פורסם, 15.4.2008)).
לגוף הדברים, מדובר כאמור בבקשת רשות ערעור ב"גל גול שלישי" שעניינה אי-מתן פטור מלא מהפקדת עירבון. הנושא נדון בשתי ערכאות, ולאחר עיון בבקשת רשות הערעור לא שוכנעתי כי ההליך מגלה עילה להתערבותו של בית משפט זה בשבתו כערכאת ערעור שנייה, ומכל מקום סיכויי ההתערבות נחזים להיות קלושים. זאת בפרט משלא הראה המבקש, על פני הדברים, כי סוגיית העירבון בתיק המסוים המונח לפני בית המשפט המחוזי מעוררת שאלה משפטית בעלת חשיבות כללית. די באמור כדי להביא לדחיית הבקשה לפטור מלא מתשלום אגרה ומהפקדת עירבון, זאת אף בהנחה שמצבו הכלכלי של המבקש אינו טוב – וזו אכן הנחתי.
בשולי הדברים מצאתי לנכון לציין כי העירבון שנקבע בע"א 7699/11 הנ"ל, הופקד. עוד יש לציין כי כפי שעולה מבקשת הפטור ומהחלטות קודמות שניתנו בעניינו של המבקש, הוא אינו משלם הוצאות הנפסקות לחובתו, ומכאן הצורך בקיומה של בטוחה בדמות הפקדת עירבון.
לאור האמור, בהתחשב במצבו הכלכלי של המבקש ובשים לב למהותו של ההליך (הנסב כאמור על קביעת עירבון בבית המשפט המחוזי בסך של 4,000 ₪), אני מורה בזאת כי על המבקש לשלם בגדרי ההליך הנוכחי אגרה מינימאלית בסך של 200 ₪, ועירבון בסכום נמוך של 2,000 ₪. בהיעדר תשלום והפקדה תוך 21 ימים מעת המצאת החלטה זו (ימי הפגרה במניין), יימחק ההליך או יירשם לדחייה, לפי העניין, ללא הודעה נוספת.
