בקשה פטור מאגרה ועירבון
החלטה
לפניי בקשה לפטור מתשלום אגרה ומהפקדת עירבון. לאחר עיון בטענות הצדדים החלטתי להיעתר לבקשת הפטור שלפניי. שלושה נימוקים עיקריים לכך: הראשון , כי ההליך עצמו נסב על החלטה בדבר הפקדת עירבון. השני , כי כבוד הרשמת ת' שרון-נתנאל, בהחלטתה מיום 3.5.2012, קבעה כי נראה ש"למבקש קשיים של ממש לגייס את הסכומים הנדרשים" (לרבות בעזרת הסביבה הקרובה), ונתנה לו פטור מתשלום אגרה (ופטור חלקי מהפקדת עירבון). ו השלישי , כי כבוד השופט דנציגר ביקש את תשובת המשיב לבקשה לעיכוב ביצוע ולבקשת רשות הערעור גופה, ובינתיים הורה על עיכוב ביצוע ארעי. במצב דברים זה איני רואה לשלול את סיכויי ההליך בגדרי הבקשה שלפניי, ואיני מביע כל עמדה לכאן או לכאן.
לנוכח הצטברות השיקולים שלעיל, וחרף טענות המשיב שלא נעלמו מעיני, באתי לכלל מסקנה כי יש מקום ליתן פטור מתשלום אגרה ומהפקדת עירבון בהליך זה, וזאת כאמור בלי להביע עמדה לגבי סיכוייו.
