סעיף 15 לתוספת השלישית לחוק התכנון והבניה, התשכ"ה-1965 (להלן – התוספת השלישית ) קובע, כי ממועד התשלום של היטל ההשבחה, יתווספו אל ההיטל ריבית והפרשי הצמדה, על-פי חוק הרשויות המקומיות (ריבית והפרשי הצמדה על תשלומי חובה), התש"ם-1980. מ דובר
ב"ריבית צמודה" בשיעור של 0.75% לחודש, בתוספת או בהפחתה של הפרשי הצמדה (ראו סעיף 1 לחוק האמור; וראו גם, אהרן נמדר היטל השבחה , 400-399 (2011)). יצוין, כי ככלל, מועד תשלום ההיטל הינו מועד "מימוש הזכויות" במקרקעין, כהגדרתו של מונח זה בסעיף 1(א) לתוספת השלישית.

המשיבה הגישה לבית המשפט לענינים מינהליים מרכז-לוד בקשה לנהל תובענה ייצוגית נגד המבקשת, בשל האופן בו היא מחשבת את ריבית הפיגורים הנ"ל. טענתה המרכזית של המשיבה הייתה, כי המבקשת מחשבת את ריבית הפיגורים בגין מלוא התקופה שמיום מימוש הזכויות ועד יום התשלום בפועל. זאת, אפילו במצבים בהם קיים צורך לבצע הליכי שומה לאחר יום מימוש הזכויות, לצורך קביעת סכומו המדויק של ההיטל, וכאשר לא ניתן לייחס אשם לנישום בעצם התארכות הליכי השומה. עמדת המשיבה התבססה על פסקי דין שונים שניתנו בבתי משפט השלום, בהם נקבע כי אין להטיל על נישום בהיטל השבחה ריבית פיגורים, ביחס לתקופות שמיום המימוש ועד ליום התשלום, ככל שאלה התארכו שלא באשמת הנישום (זאת, פרט לסכומים שאינם שנויים במחלוקת). בית המשפט לענינים מינהליים מרכז-לוד (כבוד השופטת מ ' נד"ב ) נעתר לבקשת האישור (להלן – החלטת האישור ) ומכאן בקשת רשות הערעור.

דין הבקשה להידחות בלא להידרש לטענות המבקשת לגופן. בתשובתה לבקשת האישור טענה המבקשת, כי היא פועלת בהתאם לפסקי הדין העקרוניים שנדרשו לסוגיה בבתי משפט השלום, ובפרט בהתאם לפסק דין שניתן על ידי בית משפט השלום בראשון לציון בשנת 2007 (ע"א 154/06 (שלום – ראשון לציון) גרינשטיין נ '
ועדה מקומית לתכנון ולבניה נתניה (30.7.2007)). המבקשת הגישה לבית המשפט תצהירים התומכים בטענה עובדתית מובהקת זו. עם זאת, במהלך הדיון שהתקיים ביום 7.4.2013 הודיעה המבקשת כי היא מושכת את תצהיריה. כפועל יוצא מכך, לא הוצבה לפני בית המשפט לענינים מינהליים תשתית עובדתית מבוססת בתמיכה לטענותיה העובדתיות של המבקשת, בדבר האופן בו היא מחשבת את ריבית הפיגורים על היטל ההשבחה. מטעם זה בלבד, איני רואה מקום להידרש בעיתוי הנוכחי לטענות המבקשת המופנות נגד החלטת האישור. אכן, בהליך דנא מתעוררת שאלה לא פשוטה הנוגעת למידת השונוּת בין חברי הקבוצה ולעניין התאמתו של ההליך לבירור במסגרת הדיונית של תובענה ייצוגית. עם זאת, בשל המהלך הדיוני האמור של המבקשת, אין מקום להידרשותה של ערכאת הערעור לסוגיה בעיתוי הנוכחי. מובן, כי אם יוגש בעתיד ערעור על פסק הדין הסופי בהליך, כל טענותיה של המבקשת, לעניין החלטת האישור, תהיינה שמורות לה, כולל הטענה לעניין השונוּת בין חברי הקבוצה.

בקשת רשות הערעור נדחית, בלא שנתבקשה תשובה, ובלא להידרש לטענות לגופן.
