החלטה

בקשת רשות ערעור על החלטת בית המשפט המחוזי בבאר שבע, אשר דחה סידרה של טענות מקדמיות של המבקשת (להלן: רשות השידור ) לדחיית התובענה על הסף. בתמצית שבתמצית, ענייננו בתובענה שהוגשה על ידי המשיבים, כ-120 קיבוצים (להלן: הקיבוצים ). בתובענה עתרו הקיבוצים למתן פסק דין הצהרתי בדבר זכאותם לקזז מחובם הקיים או העתידי כלפי רשות השידור את סכומי ההנחה לה היו זכאים, לטענתם, בגין גבייה מרוכזת מחברי הקיבוצים שהחזיקו במקלטי טלויזיה בין השנים 1994-1981.
אציין, כי במסגרת תביעה זו כבר ניתנה החלטת ביניים שהגיעה לפתחו של בית משפט זה, אשר קבע כי יש לכמת את סכום הקיזוז, ובהתאם לכך לשלם אגרה (החלטת השופט (בתוארו אז) א' גרוניס ברע"א 3027/07 מיום 9.8.2009).

בבקשה לדחייה על הסף העלתה רשות השידור שורה ארוכה של טענות מקדמיות, ובין היתר: כי בניגוד להחלטה הנ"ל התביעה לא כומתה במדוייק אלא הועמדה על דרך האומדן על סך של כ-21,000,000 ₪; כי הקיבוצים לא שילמו עבור כל מקלטי הטלויזיה שהוחזקו על ידי החברים; כי הקיבוצים לא פעלו כלל בדרך של גבייה מרוכזת, וממילא לא היו זכאים להנחה בגין גבייה מרוכזת; כי הקיבוצים לא גבו מכלל החברים שהחזיקו במקלטים; כי הקיבוצים ממילא לא זכאים להנחה מאחר ששילמו מלכתחילה אגרה מוקטנת; כי הקיבוצים נחשבו כ"מחזיק" והם מנועים כיום מלטעון אחרת; כי הקיבוץ לא רשאי לייצג את חבריו; וכי לא עומדת לקיבוצים זכות קיזוז בשל ק"ן טעמים, ובין היתר, בשל התיישנות טענת הקיזוז.
כל הטענות דלעיל נדחו על ידי בית משפט קמא ועל כך נסבה בקשת רשות הערעור שבפני.
גם היועץ המשפטי לממשלה מצא להצטרף להליך מכוח סמכותו מכוח סעיף 1 לפקודת סדרי הדין (התייצבות היועץ המשפטי לממשלה) [נוסח חדש]. לעמדת היועץ המשפטי לממשלה, לא ניתן לקזז חוב לא מוכח מתוך תשלום חובה סטטוטורי, במיוחד לאחר חלוף תקופת ההתיישנות.
הקיבוצים התנגדו לבקשה ותמכו בהחלטתו של בית משפט קמא.

אומר בקצרה, כי הסוגיות המועלות בבקשה הן סוגיות נכבדות, ובעיקר הסוגיה של קיזוז והתיישנות, סוגיה שיש לה גם השלכות רוחב החורגות מעניינה של הבקשה שלפני. אילו הייתי עוצר הילוכי כאן, היה מקום ליתן רשות ערעור. אלא שבבקשת רשות הערעור לא טרחה רשות השידור להסביר ולפרט מדוע יש צורך להכריע כבר בשלב זה בשלל הטענות המקדמיות, ולא להותירן לסוף הדרך.

סעיף 41(ב) לחוק בתי המשפט [נוסח משולב], התשמ"ד-1984 קובע כי רשות ערעור על "החלטה אחרת" של בית משפט מחוזי " תינתן אם שוכנע בית המשפט כי אם הערעור על ההחלטה יידון במסגרת הערעור על פסק הדין ולא באופן מיידי, יהיה בכך כדי להשפיע באופן ממשי על זכויות הצדדים או שעלול להיגרם לצד להליך נזק של ממש, או שעלול להתנהל הליך מיותר או בדרך שגויה ".
אכן, אין ספק כי הכרעה בטענות המקדמיות שהועלו על ידי רשות השידור, עשויה לייתר את המשך ניהול התובענה, אם וככל שטענות אלה תתקבלנה. אולם בכך לא סגי על מנת שערכאת הערעור תתערב בהליך ביניים. זאת, במיוחד נוכח המגמה, שבאה לידי ביטוי בחוק בתי המשפט כמצוטט לעיל, לצמצם במספר הליכי הערעור על החלטות ביניים (ראו החלטת הנשיא גרוניס ברע"א

בית משפט זה חזר והבהיר פעמים רבות כי נטיית ערכאת הערעור היא שלא להתערב כל עוד לא סיימה הערכאה הדיונית את מלאכתה, באשר ייתכן כי בסוף היום תתייתרנה ממילא הטענות כנגד החלטת הביניים (החלטת השופטת חיות ברע"א 8946/12 חברת נמל חיפה בע"מ נ' בתי זיקוק לנפט בע"מ (21.3.2013)). אני נכון להניח כי במקרה דנן, הטענות המקדמיות שהועלו על ידי רשות השידור לא תתייתרנה, מאחר שבית המשפט קמא הורה, למעשה, לעבור לשלב כימות התביעה. אך בכך, כשלעצמו, אין כדי להצדיק מתן רשות ערעור על הליך ביניים. הלכה מושרשת עמנו כי אין ליתן רשות ערעור על החלטה בעניין "החבות" לפני שלב כימות הסעד. זאת, הן בשל שיקולי יעילות; הן מאחר שהחלטות הביניים, חשובות ככל שיהיו, נבלעות בפסק הדין הסופי (ראו, לדוגמה, החלטות השופט זילברטל ברע"א 4153/12 הראל חברה לביטוח בע"מ נ' הזרע ג'נטיקס בע"מ (12.8.2012); רע"א 1077/12 פלוני נ' מדינת ישראל (26.6.2012)), ולאור זאת שבמסגרת הערעור הכולל "ניתן לבחון את ההחלטה באופן טוב ומקיף יותר על רקע מכלול החומר, כל הקביעות והתוצאה האופרטיבית של ההליך" (החלטת השופט סולברג ברע"א 9385/12

לאור זאת, אני דוחה את בקשת רשות הערעור, מבלי להביע כל עמדה בשאלות הנכבדות שהועלו על ידי רשות השידור בבקשה. רשות השידור תישא בהוצאות המשיבים בסך 10,000 ₪.
