החלטה

אמנם המבקש איחר בהפקדת הערבון, אולם לא מצאתי די באיחור זה בכדי להביא לתוצאה של דחיית ההליך כולו, בייחוד בשים לב למשך האיחור, לעובדה כי מ דובר
במועד שנקבע על-ידי בית המשפט, ולעובדה שהערבון הופקד בבית המשפט בכפוף להחלטה בנדון. אין בידי לקבל את עמדת המשיב לפיה נובע מהחלטת כב' הרשמת ש' ליבוביץ מיום 1.2.07 כי ההליך ידחה בלא שיקול דעת בנדון, בייחוד נוכח רישומו לדחייה ולא דחייתו בפועל. המזור לאיחור שנוצר, כמו גם לצורך של המשיב בתגובה לעניין זה, הינו בהארכת המועד להפקדת הערבון כמבוקש, תוך חיוב המשיב בהוצאות.

התוצאה היא כי הבקשה להארכת המועד מתקבלת, אולם המבקש ישא בשכר טרחת עורך-דין בגין בקשה זו בסך 1,500 ₪. סכום זה ישא ריבית והצמדה כדין מיום ההחלטה ועד התשלום בפועל.
