המבקש עותר להרשות לו לערער על החלטת בית המשפט המחוזי מרכז (עת"א 37223-07-10) לפיה נדחתה עתירתו נגד החלטת המשיב שלא לשנות את סווגו מאסיר בעל סיכון בריחה גבוה לאסיר רגיל.
המבקש הורשע בעבירות של גניבה והסגת גבול , איומים ,
תקיפה , הפרעה לשוטר במילוי תפקידו ובריחה ממשמורת חוקית ונידון לעונש מאסר בפועל לשלוש שנים ועשרה חודשים. בין היתר, הורשע המבקש בכך שהפר את תנאי השחרור שהוטלו עליו בהליכי המעצר. המבקש יצא מביתו בניגוד לתנאי השחרור , בהמשך איים במספר הזדמנויות על איש משטרה ונמלט מהשוטרים שבאו לעצור אותו. על רקע הנסיבות בהן הורשע, הוגדר המבקש על ידי המשיב כאסיר בעל סיכון בטחוני גבוה לבריחה. עתירת המבקש לשנות את סיווגו האמור על מנת שיתאפשר לו לצאת לחופשות נדחתה, מכאן הבקשה שבפניי.
המבקש מעוניין להשתקם ולשם כך פנה אל כל הגורמים כדי שיסייעו לו לעבור לבית סוהר שיקומי. אולם, אלה אינם יכולים לסייע לו כל עוד לא יוסר הסיווג שנקבע לו. לדבריו: "בעברי עשיתי המון טעויות אבל היום אני רוצה מאוד להשתקם ולטפל בעצמי".
המשיב מתנגד לבקשה. לשיטתו, הבקשה אינה מעלה שאלה משפטית המצדיקה דיון בגלגול שלישי ובכל מקרה לא נפל כל פגם בהחלטת בית המשפט המחוזי. נטען כי פקודת נציבות שירות בתי הסוהר מס' 04.09.00 מגדירה אסיר בעל סיכון גבוה כ"אסיר אשר עברו , התנהגותו , מצבו הנפשי ,
מידע אודותיו , מצביעים על קיום רמת סיכון גבוה לבריחתו ממשמורת חוקית". על פי הפקודה, המשמעות של הסיווג הינה שהאסיר לא יצא לחופשות , תנועתו בבית הסוהר תיעשה תחת לווי ותנועתו מחוץ לבתי הסוהר תיעשה אף היא בלווי כשהוא כבול ואזוק. הפקודה מאפשרת לשנות את הסיווג מעת לעת בעקבות אירועים שונים , מידע חדש או שינויים שחלו באסיר (סעיף 4ב לפקודה). יוצא, כי המשיב פעל כדין תוך הפעלת שיקול דעתו בהתאם לנסיבות המקרה. יצוין כי המבקש ברח ממשמורות חוקית פעמיים , בזמן שהיה בחלופת מעצר בבית על עבירת גניבה. בפעם הראשונה ברח דרך חלון ביתו כאשר השוטרים התייצבו על מנת לעכבו בשל חשד לעבירת גניבה. בפעם השנייה נמלט
בראותו שוטרים ברחוב. במעשים אלה הוכיח שהוא מסוגל להימלט מהדין.
המסקנה המתבקשת היא כי סבירה הגדרת המבקש כאסיר בעל סיכון גבוה לבריחה. תפקודו של המבקש כ"אסיר רגיל" במהלך ארבעת החודשים הראשונים, אין בו כדי לאיין את מעשיו החמורים שהתרחשו פחות משנה עובר להחלטת המשיב. עוד הודגש כי בתאריך 26.12.10 נבחנה שוב הגדרתו של המבקש על ידי הוועדה המחוזית אשר המליצה שלא לשנות את סיווגו. המלצה זו אושרה על ידי סגן מפקד המחוז.

הלכה היא כי רשות ערעור על החלטת בית משפט בעתירות אסיר אינה ניתנת כעניין שבשגרה. רשות כזו תינתן רק מקום בו מתגלה שאלה משפטית עקרונית או שאלה שחשיבותה כללית וחורגת מנסיבות המקרה הקונקרטי (רע"ב 7/86
וייל נ' שירות בתי הסוהר (לא פורסמה ,
26.6.1986) ורע"ב 5828/09 סאמר חיראלדין נ' שירות בתי הסוהר (לא פורסמה , 4.2.2010)). המבקש לא הצביע על כל שאלה משפטית המצדיקה מתן רשות ערעור. יתרה מכך, לא מצאתי כל טעות משפטית בהחלטת המשיב שלא לשנות את סיווגו של המבקש כאסיר בעל סיווג בריחה גבוה. צדק המשיב בהחלטתו ליתן משקל לנסיבות המקרה ולעובדה שבפרק זמן קצר יחסית ,
נמלט המבקש מרשויות האכיפה , עת היה אמור להקפיד על תנאי השחרור שנקבעו לו על ידי בית המשפט. פרק הזמן שחלף מביצוע העבירות הינו קצר. על פי החומר, החלטת המשיב מוצדקת בנסיבות העניין.
