נגד המבקש הוגש כתב אישום, ב בית המשפט
לתעבורה בפתח תקוה (תיק ת' 7452/08) בגין עבירה של נהיגה במהירות העולה על המותר, לפי תקנה 54(א) לתקנות התעבורה, התשכ"א-1961. על פי המתואר בכתב האישום נהג המבקש בכביש בו המהירות המותרת הינה 90 קמ"ש במהירות של 147 קמ"ש .
לטענת המבקש, במועד הדיון הראשון שנקבע, ביום 10.9.2008 הופיע עורך דין מטעמו וביקש לדחות את הדיון ליום 2.11.2008. על פי הנטען, בשל טעות משרדית שנפלה במשרד עורכי הדין, לא הוקלד מועד הדיון ביומנם, ומשכך לא הופיעו בא כוח המבקש או הוא עצמו לדיון.
לפיכך, ניתן פסק דין נגד המבקש בהעדר התייצבות, בגדרו הורשע בעבירה שיוחסה לו, והושת עליו עונש של פסילה בפועל מלהחזיק או לקבל רשיון נהיגה למשך חודשיים; פסילה על תנאי מלהחזיק או לקבל רשיון נהיגה לארבעה חודשים למשך שנתיים; וקנס בסך 1000 ש"ח.
ביום 15.12.2008 הגיש המבקש בקשה לביטול פסק הדין בטענה שהיתה סיבה מוצדקת להיעדר ההתייצבות בדיון, והיא הטעות שנפלה במשרד עורכי דינו. עוד צוין בבקשה כי ברכב נוהגים נהגים נוספים וכי לא זכור לו כי נהג ברכב במועד העבירה, אך לא צוין מי הוא שנטען כי נהג בפועל ברכב. הבקשה נדחתה.
המבקש ערער על ההחלטה שלא לבטל את פסק הדין בפני בית המשפט המחוזי מרכז (עפ"ת 1171-01-09). בכתב הערעור המקורי חזרה בעיקרה רק הטענה כי המקור להיעדר ההתייצבות היה הטעות במשרד עורכי הדין.
ביון שנערך ביום 8.3.2009 ציין בא כוח המבקש כי ידוע לו במועד זה מי נהג ברכב אף שהדבר לא נזכר בכתב הערעור. לאור זאת ובהתחשב בכך שבשל טעות לא היה בידי המשיבה עברו התעבורתי של המבקש, התיר בית המשפט המחוזי (כבוד השופטת נ' אהד ) למבקש להגיש הודעת ערעור מתוקנת בכפוף להטלת הוצאות לטובת אוצר המדינה.
ביום 15.3.2009 הוגשה הודעת ערעור מתוקנת בה צוין כי אחר, קובי בן לולו (להלן: בן לולו ), ולא המבקש הוא שנהג ברכב וביצע את העבירה ואף צורף תצהיר מטעמו.
ביום 30.3.2009, לאחר שנשמעו טענות הצדדים, ניתן פסק דינו של
בית המשפט
המחוזי, בגדרו נדחה ערעור המבקש. נקבע, כי אין בטעות ביומנו של עורך הדין כדי להצדיק ביטול פסק דין על פי הפסיקה הנוהגת. עוד נקבע כי בנסיבות הענין אין הסבר מדוע הגרסה כי בן לולו הוא שנהג ברכב הועלתה באיחור ניכר אך בכתב הערעור המתוקן, ומשכך אין לייחס לה משקל רב. עוד צוין עברו התעבורתי המכביד של המבקש, לחובתו 92 הרשעות קודמות בעבירות תעבורה, מהן אף עבירות חמורות. לפיכך נמצא כי אף העונש שהושת על המבקש אינו מחמיר ואף מקל בהתחשב בעברו התעבורתי.
מכאן בקשת רשות הערעור שבפניי, בגדרה שב בא כוח המבקש על טענותיו בגדר הערעור המתוקן וטוען כי אין מקום לפקוד את שגיאת עורכי הדין על המבקש ויש לאפשר לו את יומו ב בית המשפט , ובמיוחד בנסיבות העניין כאשר יש תצהיר של אחר המודה בביצוע העבירה.
לאחר שעיינתי בבקשה על נספחיה ובפסקי הדין של הערכאות הקודמות, נחה דעתי כי דין הבקשה להידחות, וזאת אף מבלי לבקש את תגובת המשיבה.
כידוע, רשות ערעור בפני ערכאה שלישית, תינתן אך במקרים חריגים בהם מתעוררת סוגיה בעלת חשיבות משפטית או ציבורית החורגת מעניינם הפרטני של הצדדים (ר"ע 103/82 חניון חיפה בע"מ נ' מצת אור (הדר חיפה) בע"מ , פ"ד לו(3) 123 (1982)). עניינו של המבקש נדון בפני שתי ערכאות שיפוטיות, והמבקש לא הצביע על עילה, המצדיקה דיון נוסף בסוגיה בפני ערכאה שלישית. די בכך כדי לדחות את הבקשה.
מעבר לנדרש יוער, כי דין הבקשה להידחות אף לגופה. כשם שציין בית המשפט המחוזי אין בטענה כי נפלה טעות במשרדו של עורך דינו של המבקש כדי להצדיק דרך כלל את ביטול פסק הדין. לא ראיתי גם כי בנסיבות הענין יש לסטות מכלל זה. כאמור, עיקר גרסתו של המבקש, היינו כי בן לולו הוא שנהג ברכב, לא הובאה בפני בית משפט השלום בבקשה לביטול פסק הדין, או אף בהודעת הערעור המקורית שהוגשה ב בית המשפט המחוזי, אלא רק בהודעת הערעור המתוקנת. בנסיבות אלו, אין אלא לציין כי תמוה הוא פרק הזמן הממושך שלקח למבקש להציג את גרסתו ובמיוחד כאשר מצוין בבקשה לרשות ערעור כי המאורע זכור היטב הן למבקש והן לאותו בן לולו. בנסיבות אלו, לא ראיתי כי נפל כל פגם בפסק דינו של בית המשפט המחוזי, וודאי לא פגם כזה המצדיק את מתן רשות הערעור.
אשר על כן, הבקשה נדחית.
