החלטה

לפניי בקשה למתן רשות ערעור על פסק דינו של בית המשפט המחוזי בנצרת (השופטים א' הלמן , א' קולה , י' שיטרית ) בע"פ 33082-07-13, מיום 17.12.2013 .
רקע והליכים

נגד המבקש הוגש לבית משפט השלום בנצרת כתב אישום בו הואשם בעבירה של מתן שוחד, לפי סעיפים 291 + 294(ב) לחוק העונשין, תשל"ז-1977. על פי כתב האישום, ביום 29.1.2010, עת שנערך למבקש מבחן נהיגה מעשי, לצורך קבלת רישיון נהיגה במשאית, ניסה הוא לשחד את בוחן הנהיגה שבחן אותו.

ביום 18.4.2013, הרשיע בית משפט השלום בנצרת (ת"פ 30740-11-10, השופט ד' פורת – סג"נ) את המבקש, לאחר ניהול הוכחות, בעבירה שיוחסה לו בכתב האישום. בית המשפט השלום ביסס את הכרעתו על עדותו של בוחן הנהיגה (להלן: המתלונן ), אדם נוסף שנבחן אף הוא וישב בארגז המשאית בזמן שהתבצע ניסיון השוחד, השוטר שהיה חוקר תורן בשעת הגעתם של המתלונן והמבקש למשטרה, מורה הנהיגה של המבקש, המבקש עצמו, ושוטרים נוספים שהיו קשורים בחקירת המבקש. במוקד הכרעת הדין היו הגרסאות הסותרות של המתלונן והמבקש. לפי גרסת המתלונן, המבקש ניסה לשחדו באמצעות מעטפה ובה 400 ש"ח, עליה הצביע, ואמר כי היא שייכת למתלונן. על פי גרסת המבקש, הוא רק הבחין בדף מקופל ושאל אם הוא שייך למתלונן. לאחר שבחן את גרסאות המבקש והמתלונן לאירועים, יחד עם שאר העדויות, העדיף בית המשפט השלום את גרסת המתלונן מטעמים שונים, אשר נמנו ופורטו. בית משפט השלום נתן דעתו גם למחדלי החקירה אשר הצביע עליהם המבקש, אך מצא שאלה לא פגעו במארג ראיות התביעה.

ביום 14.7.2013 נגזר דינו של המבקש. בית המשפט דן בטענות הצדדים לעונש, וערך דיון מקיף בערך החברתי שנפגע מהעבירה שעבר המבקש, במדיניות הענישה הנוהגת לגביה, ובנסיבות הקשורות בביצועה. כן דן בית המשפט בנסיבות האישיות של המבקש, והשית עליו עונש של שישה חודשי מאסר אשר ירוצו בעבודות שירות, עשרה חודשי מאסר על תנאי, קנס בסך 5,000 ש"ח ופסילת רישיון לנהוג במשאית.

המבקש ערער על הכרעת הדין לבית המשפט המחוזי בנצרת. בערעורו טען המבקש כי בגרסתו של המתלונן סתירות רבות אליהן לא נתן בית משפט השלום את דעתו. עוד טען המבקש כי מחדלי החקירה הם חמורים ופגעו באופן אנוש בהגנתו, ודי בכך כדי לזכותו. ביום 15.12.2013 דחה בית המשפט המחוזי ברוב דעות את ערעורו של המבקש. דעת הרוב קבעה, בפסק דין מפורט, כי הערעור כולו מופנה כלפי קביעות עובדה ומהימנות, אשר אין מקום להתערב בהם. דעת המיעוט סברה לעומת זאת, בחוות דעתה המפורטת אף היא, כי בית משפט השלום טעה בהסקת מסקנות מן העדויות והראיות שהיו בפניו ועל כן יש לזכות את המבקש.
הבקשה

במסגרת בקשת רשות הערעור, חזר המבקש על טענותיו כפי שנטענו בבית המשפט המחוזי, וביקש לחזקן באמצעות דעת המיעוט בבית המשפט המחוזי.
הכרעה

אין בידי להיעתר לבקשה למתן רשות ערעור. הלכה היא, כי אין מעניקים רשות לערעור שני, אלא אם כן עולה מטענות הצדדים טענה בעלת חשיבות כללית, בין משפטית בין ציבורית, החורגת מעניינם הפרטני, או אם ישנם שיקולי צדק ייחודיים (ראו: רע"א 103/82 חניון חיפה בע"מ נ' מצת אור (הדר חיפה) בע"מ , פ"ד לו(3) 123 (1982)). אין זהו המקרה. טענות המבקש נוגעות לעניינו הפרטני בלבד , ואינן מעוררות כל סוגיה כללית. כמו כן, לא מצאתי כל שיקולי צדק ייחודיים אשר יש בעניינו.

טענות המבקש נוגעות לממצאים עובדתיים וקביעות מהימנות של הערכאה הדיונית. אלה נבחנו על ידי שתי ערכאות בפירוט רב. כפי שציינה דעת הרוב בבית המשפט המחוזי, ערכאת הערעור לא תתערב ללא סיבה כבדת משקל בממצאים העובדתיים שנקבעו על ידי הערכאה הדיונית (ראו: ע"פ 2932/00 אלמקייס נ' מדינת ישראל , פ"ד נה(3) 102 (2001)). הלכה זו מקבלת משנה תוקף שעה שמדובר בגלגולו השלישי של ההליך.

לפני סיום ולמעלה מן הצורך, מצאתי להעיר כי בית משפט השלום לא יישם את תיקון 113 לחוק העונשין כלשונו, ולא קבע מתחם ענישה. אמנם, אין בכך בהכרח כדי להביא להתערבות בית משפט זה, אך ראוי כי ייקבע מתחם ענישה, כפי שהורה המחוקק (ראו גם: ע"פ 4815/13 מדינת ישראל נ' אלעוקבי , פסקאות 12-11 לפסק דינו של השופט א' שהם

סוף דבר, הבקשה נדחית בזאת. לפיכך, מתייתרת ההחלטה בבקשה לעיכוב הביצוע. המערער יתייצב לריצוי עבודות השירות, בהתאם לפסק דינו של בית המשפט המחוזי, ביום 19.1.2014, עד השעה 8:00, במתחם תחנת משטרת טבריה, בפני המפקח הממונה על עבודות השירות.
