החלטה

בית-המשפט לתעבורה בירושלים הרשיע את המבקש, בהעדרו, בנהיגה במהירות מופרזת, לאחר שנמצא נוהג בדרך עירונית במהירות של 114 קמ"ש . בהמשך, נדון המבקש לקנס בסך 1500 ש"ח, פסילה מלקבל או להחזיק ברישיון נהיגה במשך 3 חודשים, ופסילה על תנאי בת חודשיים. בקשה שהגיש המבקש לביטול פסק-הדין, אליה צירף תצהיר לפיו אחר נהג ברכב בעת ביצוע העבירה, נדחתה. ערעור שהוגש לבית-המשפט המחוזי בירושלים, נדחה אף הוא, לאחר שנמצא כי למבקש נשלחו שתי הזמנות בדואר רשום, והוא לא טרח להגיש את התצהיר למשטרה עובר לדיון בעניינו.

בבקשה שבפני עותר המבקש ליתן לו רשות לערער, ולכך אין בידי להיעתר. להשקפתו, עניינו מחייב דיון בשתי סוגיות של מהות – חזקת הבעלות, לפיה מוטלת על בעל רכב אחריות לביצוע עבירה, אלא אם הוכיח בפועל כי לא הוא שנהג; וחזקת המסירה, לפיה מוטל על הנאשם להוכיח כי לא קיבל לידיו הודעות והזמנות שנשלחו אליו מטעם בית-המשפט. לשיטתו, חזקות אלה משיתות נטל כבד על נאשם, ובכך חותרות תחת זכויות היסוד שלו ואף תחת אושיות הדין הפלילי.

דינה של הבקשה להידחות. אם סבר המבקש כי בפיו סוגיות נכבדות המחייבות ליבון, היו לו שתי הזדמנויות להעלותן - הראשונה, בעת שזומן כדין לבית המשפט לתעבורה; והשנייה, כאשר ערער בפני בית המשפט המחוזי כנגד הרשעתו. מטעמים השמורים עמו הוא לא עשה זאת, ובהעדר הכרעה של ערכאות קמא, אין מקום ללבן סוגיות אלו בערכאה שלישית.
למעלה מן הדרוש אוסיף, כי אותן סוגיות משפטיות אינן דורשות ליבון כלל ועיקר. אכן, על דרך הכלל, נטל ההוכחה בפלילים רובץ על שכמה של התביעה. עם זאת, נקבעו במשפט הפלילי חזקות חיוניות, המתבססות לרוב על עניינים שבעובדה הידועים או אמורים להיות ידועים בעיקר לנאשם. את החזקות הללו יכול נאשם להפריך על נקלה, ועל כן לא גלומה בהן פגיעה של ממש בהגנתו. כך היא חזקת המסירה הקבועה בתקנה 44א לתקנות סדר הדין הפלילי, התשל"ד-1974, וכך היא החזקה בדבר אחריות בעל הרכב הקבועה בסעיף 27ב' לפקודת התעבורה.
משכך הם פני הדברים, הבקשה נדחית ועִמה נדחית גם הבקשה לעיכוב ביצוע העונש.
