החלטה
המבקש הועמד לדין בבית משפט השלום בחיפה (פל 2313/05) בגין עבירה של תקיפה הגורמת חבלה ממש, לפי סעיפים 382ג ו-380 לחוק העונשין, התשל"ז-1977.
על פי המתואר בכתב האישום, ביום 8.2.2005 בסמוך לשעה 22:30, בביתם בכפר פרדיס, תקף המבקש את אשתו (להלן: המתלוננת ) שלא כדין כך שדחפה בחוזקה, וכשניסתה להימלט מהדירה תפס את ראשה והטיחו בקיר ובנוסף לכך סחב אותה בשערותיה והכה אותה באגרופים ובבעיטות ברגליים ובבטן ובשאר חלקי גופה עד אשר התעלפה. כתוצאה נזקקה המתלוננת לטיפול רפואי בגין כאבים חזקים שנגרמו בבטנה.
בשלב מסוים של ההליך הועבר התיק לדיון בפני בית משפט השלום בחדרה (פל 1011/07), זאת לאור עומס תיקים בבית משפט השלום בחיפה.
ביום 26.6.2007 הרשיע בית משפט השלום (כבוד השופט א' קפלן ) את המבקש בעבירות שיוחסו לו בכתב האישום וזאת על בסיס הודאתו.
ביום 9.3.2008 גזר עליו בית המשפט 8 חודשי מאסר בפועל ו-6 חודשי מאסר על תנאי למשך שלוש שנים והתנאי הוא שלא יעבור עבירה של אלימות פיזית נגד אדם שעונשה שנתיים מאסר ומעלה. בית המשפט שקל מחד את השיקולים לקולא, כגון עבור הזמן מיום ביצוע העבירה, המלצת תסקיר שירות המבחן אשר המליץ להסתפק בענישה מותנית, הודייתו של המבקש ואי הישנותם של מעשים דומים, אולם מאידך ציין כי מ דובר בעבירה שהיא במדרג הגבוה של עבירות האלימות במשפחה וכי הפן השיקומי מתגמד לנוכח הצורך בהרתעה.
על גזר דינו של בית משפט השלום ערער המשיב לבית המשפט המחוזי בחיפה (ע"פ 3290/08).
בית המשפט המחוזי (כבוד השופטים ר' שפירא , ע' גרשון ו צ' קינן ) דחה בפסק דינו מיום 12.6.2008 את ערעורו של המבקש בשל היעדר התייצבותו. בית המשפט ביטל באותו מעמד את עיכוב ביצוע עונשו של המבקש והורה על מעצרו המיידי.
מכאן בקשת רשות הערעור שבפניי, בגדרה עותר המבקש להקלה בעונש שהושת עליו מכמה עילות כגון העובדה כי שיקם את יחסיו עם אשתו, אי הישנות המעשים בכתב האישום, עברו הפלילי הלא מכביד, הודייתו וחרטתו, תסקיר שירות המבחן החיובי והיות העונש שנגזר עליו מופלג בחומרתו. עוד מלין המבקש על החלטת בית המשפט המחוזי לדחות את ערעורו בשל אי התייצבות שכן טוען הוא כי הגיש בקשה לדחיית מועד הדיון שבדיעבד הסתבר שלא התקבלה במזכירות בית המשפט. בד בבד עם בקשת רשות הערעור הגיש המבקש גם בקשה לעיכוב ביצוע העונש שהוטל עליו.
מנגד, טוענת המשיבה כי דין בקשת רשות הערעור להידחות הן מהטעם כי היא אינה מעוררת כל שאלה משפטית עקרונית והמבקש לא הצביע על עילה המצדיקה דיון בגלגול שלישי, והן לגופו של עניין שכן לאור סעיף 208 לחוק סדר הדין הפלילי [נוסח משולב], התשמ"ב-1982 (להלן: חוק סדר הדין הפלילי ), דחייתו של בית המשפט המחוזי את הערעור הייתה מוצדקת לאור העובדה שהמבקש לא מסר כל הסבר מדוע לא התייצב לדיון בערעור וכי הוא אף לא הגיש בקשה לביטול דחיית הערעור בשל אי התייצבות לפי סעיף 208א לחוק סדר הדין הפלילי.
דין בקשת רשות הערעור להידחות.
הלכה היא, כי אין מעניקים רשות לערעור שני, אלא אם כן עולה מבין טענות הצדדים טענה בעלת חשיבות כללית, בין משפטית ובין ציבורית, החורגת מעניינם הפרטי (ראו 103/82 חניון חיפה בע"מ נ' מצת אור (הדר חיפה) בע"מ , פ"ד לו(3) 123 (1982)(להלן: חניון חיפה )). בענייננו, בקשת רשות הערעור איננה מעוררת כל שאלה משפטית עקרונית שכזו והמבקש לא הצביע על עילה המצדיקה דיון "בגלגול שלישי", בהתאם להלכת חניון חיפה .
זאת ועוד, הלכה היא, כי טענות בנוגע לחומרת העונש כשלעצמה, אינן מקימות עילה למתן רשות ערעור בפני בית משפט זה, אלא בנסיבות של סטייה ניכרת ממדיניות הענישה (ראו רע"פ 1174/97 רפאלי נ' מדינת ישראל (לא פורסם, 24.3.1997); רע"פ 7201/97 בשירי נ' היועץ המשפטי לממשלה (לא פורסם, 11.12.1997)). בנסיבות המקרה, לא מצאתי כל סטייה שכזו מנורמת הענישה המקובלת בעבירות אותן ביצע המבקש. מסיבות אלו בלבד, דין הבקשה להידחות.
מעבר לדרוש יוער, כי אף לגופו של עניין, דין הבקשה להדחות. המבקש הורשע בעבירה חמורה מאוד. בית משפט השלום נתן דעתו למכלול השיקולים לקולא בעניינו של המבקש ואף בחר שלא למצות עמו את הדין בשל כך. באשר להחלטת בית המשפט המחוזי, הרי שהמבקש לא הציג הסבר המצדיק את אי התייצבותו לדיון בערעור ואף לא הלך לפי המסלול הקבוע בחוק סדר הדין הפלילי לפיו יש ביכולתו לבקש את ביטול דחיית ערעורו בשל היעדר התייצבות, באם הייתה לו סיבה מוצדקת לאי ההתייצבות או לשם מניעת עיוות דין. המבקש אף לא טרח לציין בפני בית משפט זה כי עשה דין לעצמו ולא קיים את החלטת בית המשפט המחוזי במשך תקופה ארוכה, החל מיום 12.6.2008, שכן לא התייצב לריצוי עונשו עד היום וזאת ללא כל החלטה על עיכוב ביצוע עונשו.
אשר על כן, בקשת רשות הערעור נדחית בזאת, וממילא מתייתר הדיון בבקשה לעיכוב ביצוע.
