השופט י' עמית :

כנגד העותרים נרשם דו"ח בסך של 100 ₪ בגין עבירה של חציית כביש שלא במעבר חציה. העותרים 2-1 לא שילמו את הדו"ח וביקשו להישפט. בית המשפט לתעבורה הרשיע אותם בעבירה שיוחסה להם – לאחר שאף ערך ביקור במקום – ו הטיל על כל אחד מהם קנס בגובה 250 ₪. ערעור שהגישו העותרים 2-1 לבית המשפט המחוזי נדחה, וכן נדחה בקשת רשות ערעור לבית משפט זה (החלטתו של השופט א' רובינשטיין ברע"פ 5998/11 סאלח חוסין סאלהה נ' מדינת ישראל (24.8.2011)).

העותרים, המייצגים את עצמם, טענו כי בעת רישום הדו"חות לעותרים, בקרבת תחנת המשטרה בכרמיאל, ביצעה השוטרת שרשמה את הדוחות "בעת ובעונה אחת שלוש עבירות תנועה מסוכנות שסיכנו והפריעו בצורה איומה" למשתמשים בדרך, כלהלן: החנתה את הניידת בצורה אלכסונית ליד אבני שפה צבועים אדום לבן, לאחר מכן העבירה את הניידת למדרכה של הולכי הרגל, ובכך ביצעה את העבירה השלישית שהיא חסימת רשות הרבים בפני שימוש הולכי הרגל.
העותרים פנו למחלקת תלונות על שוטרים ובעקבות התערבות מבקר המדינה נתקבלה התלונה ונגבו עדויותיהם. התלונה נדחתה בהחלטה מיום 11.5.2011 מחוסר עניין לציבור. על כך הגישו העותרים ערר לפרקליטות המדינה, אך הערר נדחה בהחלטת הפרקליטות מיום 13.2.2012. בהחלטה נאמר, כי הנילונה אכן אישרה כי עצרה את מכוניתה במקום הנטען, שכן הדבר היה נחוץ לביצוע תפקידה – על מנת לרשום את הדו"ח במקרה זה. משכך, עומדת לנילונה ההגנה הקבועה בתקנה 32(א) לתקנות התעבורה, התשכ"א-1961 (להלן: תקנות התעבורה ).
חזרו העותרים ופנו אל פרקליטות המדינה בבקשה לקיים דיון חוזר, באשר לשיטתם התקנה הנ"ל חלה על מקרים חריגים מאוד כמו הצלת חיים, והשוטרת יכולה הייתה להיכנס בניחותה לחניון משטרת כרמיאל הנמצא בקרבת מקום, או לחניון של הקניון.
הבקשה לערר חוזר נדחתה על ידי פרקליטות המדינה בהחלטתה מיום 8.3.2012.
העותרים פנו למבקר המדינה, אך זה דחה פנייתם במכתבו מיום 20.1.2013 בו נאמר כי המשרד מנוע מלברר התלונה לפי סעיף 38(4) לחוק מבקר המדינה, תשי"ח-1958, באשר החלטות פרקליטות המדינה הן החלטות מעין שיפוטיות.

לא נתקררה דעתם של העותרים והגישו העתירה דכאן, בה נטען כי החלטת פרקליטות המדינה מהווה הפליה חמורה בין איש השלטון לבין האזרח. בסיפא לעתירה נתבקש בית משפט זה לבטל את החלטת הפרקליטות, לרשום לחובתה של המשיבה 3 שלושה דוחות תנועה, וליידע אותם אם בחרה לשלם את סכומי הקנסות או אם בחרה להישפט, ואם בחרה להישפט, מה תוצאות הכרעת הדין וגזר הדין ומספר תיק בית המשפט.

דין העתירה להידחות.
ראשית, העתירה הוגשה בשיהוי, למעלה משנה לאחר שנתקבלה החלטת הפרקליטות.
שנית, דומה כי העתירה היא קנטרנית ונועדה לשמש משקל נגד לדוחות שנרשמו לעותרים.
שלישית, העתירה אינה מגלה עילה על פניה. לא עלה בידי העותרים להראות, ולו לכאורה, מה פגם נפל בהחלטת הפרקליטות המסתכמת על הוראת תקנה 32(א) לתקנות התעבורה הקובעת כלהלן:
רכב של משטרת ישראל שהנוהג בו או הנמצא בו ממלא תפקיד רשמי בפועל לא יחולו לגביו הוראות חלק ב' אם היה בקיומן כדי למנוע את מילוי התפקיד.
משנ בדק העניין ונמצא כי השוטרת פעלה במסגרת מילוי תפקידה, לא סגי בטענת הפליה סתמית. אכן, תקנה 32 אין פירושה כי שוטר רשאי, במסגרת תפקידו, להפר באופן גורף את הוראות החוק החלות על כלל הנהגים. מנגד, פרשנותם של העותרים, לפיה תקנה זו חלה רק במצבים של סיכון חיים, אינה מעוגנת בלשון התקנה ואינה מעוגנת בהגיונם של דברים ובשכל הישר.
ולבסוף, אזכיר את ההלכות המוכרות והידועות כי התערבותו של בית משפט זה בשיקול דעת רשויות התביעה בנושאי חקירה פלילית והעמדה לדין היא מצומצמת ביותר ומוגבלת למקרים בהם ההחלטה לוקה ב"עיוות מהותי" או ב"חוסר סבירות קיצוני". לא זה המקרה שבפנינו.

אשר על כן, אנו דוחים העתירה על הסף. העותרים ישאו בהוצאות בסך 3,000 ₪ לטובת אוצר המדינה.
