עניינה של עתירה זו בהשגות העותרים על התנהלותן של לשכות ההוצאה לפועל בכל הנוגע למשלוח החלטות לחייבים, ובפרט על כך שהחלטות שאורכן עולה על 17 שורות, אינן נשלחות לחייבים בדואר ועליהם לפנות ללשכת ההוצאה לפועל על מנת לקבלן.

בעתירה, שהוגשה בשנת 2011, נטען כי במקרים בהם ניתנת החלטה המחזיקה יותר מ-17 שורות נשלחת לחייבים הודעה על קיומה של החלטה בעניינם בלבד ולא ההחלטה עצמה. בנוסף, העותרים טענו כי קיים פגם בכך שהחלטות נשלחות בדואר רגיל ולא בדואר רשום, וכי חייבים נדרשים לשלם 4 שקלים בעבור צילום כל עמוד מן ההחלטה, אף במקרים בהם ההחלטה לא נשלחה אליהם בשל אורכה. לבסוף, השיגו העותרים על תוקפן של החלטות רשמי הוצאה לפועל אשר הסתמכו על החלטות קודמות שלא נשלחו לחייבים בשל אורכן.

בהחלטת בית המשפט מיום 25.7.2011 (הנשיא א ' גרוניס , השופטת ע ' ארבל והשופט ס '
ג ' ובראן ) נקבע כי אין ממש בטענות העותרים כי יש לשלוח כל החלטה באמצעות דואר רשום. תקנה 24(א) לתקנות ההוצאה לפועל, תש"מ-1979 קובעת כי מלבד סוגי החלטות המנויות בתקנות, אותן יש לשלוח בדואר רשום, די בשליחתן של יתר ההחלטות בדואר רגיל. בנוסף, צויין, כי בניגוד לטענת העותרים, המשיבים פירטו כי נדרש תשלום על סך 3 שקלים בלבד עבור צילום כל עמוד, ותשלום זה לא נדרש עבור צילום החלטות שלא נשלחו לחייבים. העותרים מצידם לא הגישו מסמכים המעידים כי אכן נגבה סכום גבוה יותר, והמשיבים התחייבו כי יחדדו את הנחיות הגבייה לעניין היעדר חובת תשלום עבור צילום ראשון של החלטה שלא נשלחה לחייב. לאור זאת, נקבע בהחלטה כי במסגרת העתירה ידונו רק טענותיהם של העותרים בכל הנוגע למשלוח החלטות שאורכן עולה על 17 שורות. בתגובתם המקדמית, הכירו המשיבים בכך שקיים פגם באי משלוח החלטות אלה, אולם הבהירו כי הדבר נובע ממגבלות טכניות בהדפסת ההחלטות, וכי צפויה החלפה של מערכת המחשוב בלשכות ההוצאה לפועל עד לסיום שנת 2011, אשר תאפשר את פיתרון הסוגייה. המשיבים הדגישו כי עד להתקנת המערכת ישנה אפשרות לקבל את תוכן ההחלטות בטלפון או באמצעות הגעה ללשכות ההוצאה לפועל.

בעקבות זאת, קבע בית המשפט כי המשיבים יגישו הודעה מעדכנת על ההתקדמות בהתקנתה של המערכת החדשה ועל האפשרות למשלוח החלטות שאורכן עולה על 17 שורות. יצוין, כי בהמשך נקבע כי הליך זה יישמע יחד עם העתירה בבג"ץ 804/12, אשר תקפה את הנחיות לשכות ההוצאה לפועל שלא למסור לחייבים העתקים של החלטות שהתקבלו בלשכה אחרת. הדיון בעתירות אוחד משום שסוגייה זו צפוייה הייתה להיות מושפעת אף היא מהתקנתה של מערכת המחשוב החדשה.

נוכח מורכבותה של מערכת המחשוב החדשה ותקלות שונות שהתגלו בה, חלו עיכובים חוזרים ונשנים בהתקנת המערכת. בשל כך, נקבע ביום 19.6.2013 (הנשיא א' גרוניס , השופט נ' הנדל והשופטת ד' ברק-ארז ) כי יתוקן ויובהר נוהל המנחה את לשכות ההוצאה לפועל, כך שניתן יהיה לקבל החלטות דחופות והחלטות שאורכן עולה על 17 שורות, בכל אחת מלשכות ההוצאה לפועל, ולא רק בלשכה בה מצוי תיקו של החייב. לאחר עדכונו של הנוהל ובהסכמת העותרים בבג"ץ 804/12 נמחקה ביום 14.8.2013 העתירה באותו הליך.

מהודעותיהם המעדכנות של המשיבים מהימים 6.2.2014 ו-10.4.2014 עולה כי חלה התקדמות בהתקנתה של מערכת המחשוב, אשר מופעלת כעת במסגרת פיילוט בלשכת ההוצאה לפועל בכפר סבא. בנוסף, המשיבים עדכנו כי עם התקנת המערכת, הותקן גם מודול ייחודי המאפשר משלוח של החלטות שאורכן למעלה מ-17 שורות בכל לשכות ההוצאה לפועל בארץ. בתגובתם להודעות אלה, הלינו העותרים על כך שמשלוח ההחלטות לחייבים אינו נעשה בדואר רשום כך שאין אישור קבלה של ההחלטות. עוד טענו העותרים כי אין צפי ברור להתקנת מערכת המחשוב בכל לשכות ההוצאה לפועל, וכי לא קיים פיקוח של פקידי לשכת ההוצאה לפועל על פתיחתם של הליכים שונים.

אנו סבורים כי עם הסדרתו של המודול המאפשר משלוח החלטות שאורכן עולה על 17 שורות בדואר מכל לשכות ההוצאה לפועל, התממש הסעד המבוקש בעתירה והיא התייתרה. טענותיהם של העותרים בכל הנוגע למשלוח החלטות דווקא בדואר רשום נדחו בהחלטת בית משפט זה מיום 25.7.2011. יתר טענותיהם של העותרים, המתייחסות לעצם התקנתה של מערכת המחשוב החדשה והפיקוח הנדרש על פתיחתם של הליכי הוצאה לפועל, חורגות מגדרי הסעדים המבוקשים בעתירה, ואין זה המקום להעלותן.

לפיכך, אנו מורים על מחיקתה של העתירה. לכאורה ראוי היה לפסוק הוצאות לזכות העותרים, שהרי העתירה השיגה את מטרתה. היינו, להביא לכך שגם החלטות של רשמי ההוצאה לפועל המשתרעות על יותר מ-17 שורות יישלחו לחייבים. מנגד, לא ניתן להתעלם מכך שהעותרים הגישו אין ספור הודעות ובקשות במהלך חייה של עתירה זו, כאשר חלקן הגדול לא היה נדרש כלל. זאת ועוד, חלק מכתבי בי-דין שהגישו העותרים נוסחו בצורה בלתי מקובלת (בלשון המעטה). בית המשפט וכן המשיבים נדרשו להקדיש זמן רב ומיותר לטיפול בהודעות ובבקשות שהגישו העותרים. על כן, לא ראינו לנכון לפסוק הוצאות לזכותם.
