עניינה של העתירה שלפנינו בבקשת העותר, שהינו נכה תאונת עבודה, כי בית הדין הארצי לעבודה יורה למוסד לביטוח לאומי לקיים דיון מחודש בשאלת אורך הקיצור שנגרם ברגלו בעקבות התאונה, תוך שקילת ראיות חדשות שנתגלו – לטענתו – לאחר הבדיקה האחרונה שנערכה לבחינת אורך הרגל.

העותר הוכר על ידי המשיב 2 כנפגע בתאונת עבודה ביום 31.1.88. ועדה רפואית שבדקה אותו קבעה לו 49% נכות לצמיתות החל מיום 2.1.95. ביום 6.12.07 הגיש העותר בקשה להחמרת מצב למוסד לביטוח לאומי. ועדה רפואית שבחנה את הבקשה ביום 25.11.07 העלתה את אחוזי הנכות שנקבעו לעותר ל-58% לצמיתות, אך קבעה כי אין להפעיל בעניינו את תקנה 15(ב) לתקנות הביטוח הלאומי (קביעת דרגת נכות לנפגעי עבודה), תשט"ז-1956 (להלן: תקנה 15), הקובעת כי " הועדה תתחשב במקצועו של הנפגע כאשר לדעתה הוא אינו מסוגל לחזור לעבודתו או לעיסוקו והנכות הביאה לירידה ניכרת ולא לזמן מוגבל בהכנסותיו". המוסד לביטוח לאומי ערר על החלטה זו לפני הועדה הרפואית לעררים, אשר קיבלה את הערר לעניין הנכות הנפשית ולעניין שיעור הפגיעה בברך, אך לא לעניין הפגיעה בגבו ובידו השמאלית של העותר. הועדה לא ראתה לקבוע רמת נכות שונה לעניין שיעור הקיצור ברגלו של העותר, לאחר שקבעה כי מדובר בפגיעה קבועה שאינה משתנה. לצד זה, קיבלה הועדה את חוות דעתו של רופא העיניים שקבע כי אין החמרה במצבו של המבקש ואת עמדתה של ועדת הרשות לעניין הפעלת תקנה 15, שלפיה אין להפעיל את תקנה 15 בעניינו של העותר. נוכח מסקנותיה, קבעה הועדה כי נכותו הצמיתה של העותר עומדת על 54%. העותר ערער על ההחלטה לפני בית הדין האזורי לעבודה (כב' השופט א' איטח ), אשר דחה את הערעור, בקובעו, בין היתר, לעניין מידת הקיצור ברגלו של העותר, כי מדובר בהחלטה חלוטה אשר לא הוגש עליה ערעור ואין לשנותה במסגרת הליך להחמרת מצב; ולעניין הפעלת תקנה 15, כי לא נפל פגם בהחלטתה של הועדה לעררים.
העותר הגיש בקשת רשות ערעור על החלטה זו בפני בית הדין הארצי לעבודה (כב' השופט י' פליטמן ), אשר דחה את הבקשה ככל שהיא מתייחסת לשאלת אורך הקיצור ברגלו של העותר, אך קיבל אותה בהתייחס לשאלת הפעלתה של תקנה 15, והורה להשיב את עניינו של המבקש לועדה הרפואית. במאמר מוסגר יצוין, כי בפסק דינו מיום 15.3.10, קיבל בית הדין הארצי לעבודה את ערעורו של העותר בנוגע להפעלה של תקנה 15, וקבע כי "יש להחזיר את עניינו של העותר לועדה הרפואית לעררים, שתתייעץ בשנית ותפעיל שיקול דעת עצמאי לעניין הפעלת תקנה 15 עקב ירידה בהכנסות, נוכח הטענה כי אותה ירידה הינה תוצאת התאונה בעבודה".

העתירה שלפנינו מתייחסת, כאמור, להחלטתו של בית הדין הארצי לעבודה בשאלת אורך הקיצור שנגרם ברגלו של העותר, שלגביה לא ניתנה לעותר רשות ערעור. לטענת העותר, עתירתו מעלה שאלה משפטית חשובה, היא השאלה האם ניתן לבטל החלטה חלוטה של ועדה רפואית ולקיים בה דיון מחדש, משנתגלו ראיות חדשות בשאלה, כתוצאה מהתפתחות טכנולוגית. לטענת העותר, אף בהיעדר הסדר חקיקתי בעניין, גוברים שיקולים של צדק על שיקולים של "מעשה בית דין", ומשנמצאו ראיות חדשות, הרי שיש להעמיד את אחוזי הנכות שנקבעו לעותר לבחינה מחודשת.

דין העתירה להידחות על הסף. הלכה היא כי בית משפט זה, בשבתו כבית משפט גבוה לצדק, אינו משמש ערכאת ערעור על החלטותיו של בית הדין הארצי לעבודה, ואף שמסורה לו סמכות להתערב בפסיקתו, תיעשה התערבות זו במשורה, בריסון ובאיפוק, ותיוחד למקרים חריגים שבהם מתגלה טעות משפטית מהותית בפסק הדין וכשהצדק מחייב לעשות כן (ראו בג"צ 10359/09 אביגל שירותי כ"א ועבודה בע"מ נ' בית הדין הארצי לעבודה (לא פורסם, 7.1.10); בג"צ 10255/09 יתח נ' בית הדין הארצי לעבודה , סעיף 2 (לא פורסם, 3.1.10);
בג"צ 6522/06 כוכבי נ' בית הדין הארצי לעבודה (לא פורסם, 22.4.10)). המקרה שלפנינו אינו בגדר המקרים יוצאי הדופן המצדיקים את התערבותו של בית משפט זה. הועדה הרפואית בחנה את שאלת הקיצור שנגרם באורך רגלו של העותר וקבעה כי לא חל שינוי מאז הקביעה הקודמת שלפיה הרגל קוצרה בעקבות תאונת העבודה ב- 7.5 ס"מ . הגם שההליך שבמסגרתו פעל העותר הוא של בקשה להחמרת מצב, אין הוא טוען למעשה כי חלה החמרה במצבו, אלא רק כי קיימת טכנולוגיה מודרנית שיש בה כדי להצביע כי שיעור הקיצור ברגלו גבוה יותר. בהיעדר החמרה או שינוי אחר במצבו הרפואי של העותר, ומשמדובר בהחלטה חלוטה שהעותר נמנע מלערער עליה, לא ראה בית הדין לעבודה – האמון על בחינתן של שאלות משפטיות – להיעתר לבקשתו של העותר לדון מחדש בשיעור הקיצור ברגלו. לא מצאנו כי נפלה בהחלטתו טעות משפטית מהותית המצדיקה את התערבותו של בית המשפט הגבוה לצדק.
העתירה נדחית איפוא.
