נגד העותרים מתנהלים הליכי הוצאה לפועל שהמשיב 4 – בנק הפועלים הוא הזוכה בהם. כפי שמצויין בעתירה בעניינים שונים הגיעו ההליכים שבין הצדדים אף לפתחו של בית משפט זה (רע"א 147/09 סרי נ' בנק הפועלים בע"מ (טרם פורסם, 5.1.2009); רע"א 199/09 סרי נ' בנק הפועלים בע"מ (טרם פורסם, 5.2.2009)). מכל מקום, במסגרת הליכי ההוצאה לפועל מונה ב"כ המשיב 4 ככונס נכסים לדירה של העותרים. על פי הנטען בעתירה הדירה כעת ריקה ונקבע שב"כ המשיב 4 יהיה רשאי לתפוס את הדירה ביום 20.4.2009.

הטענה בעתירה היא נגד חיובי הריבית שהוטלו על העותרים במסגרת תיק ההוצאה לפועל כאשר לטענתם בכל תיקי ההוצאה לפועל בהם בנקים הם זוכים מחושבת ריבית שלא כדין. העותרים טוענים כי בנקים כזוכים נהנים מריבית שהיא מעבר לריבית המותרת בחוק. העותרים מוסיפים וטוענים כי שיעור הריבית שרשאי בנק כזוכה בהוצאה לפועל לגבות מוגבל גם על פי צו הריבית (קביעת השיעור הריבית המקסימלי), התש"ל-1970 ואין להתיר גביית ריבית גבוהה יותר. העותרים טוענים כי העלו את הטענות דנן בפני ראש ההוצאה לפועל (כב' הרשם רט עמיעד) אך מאחר שזה לא קיבלן פנה העותר 2 לשר המשפטים בדרישה להפסיק את העסקתו של הרשם רט. כמו כן הוגשה בקשת רשות ערעור על החלטות הרשם רט שטרם הוכרעה. העותרים הוסיפו וטענו כי גם הבקשה שהוגשה בהוצאה לפועל לעיכוב ההליכים עד להחלטה בטענות לא התקבלה. לטענת העותרים אין להסתפק בהליך של בקשת רשות ערעור על אותן החלטות ומאחר שמ דובר
בטענות כבדות משקל ובשם עקרון הצדק יש להפסיק את העסקתו של הרשם רט ולהורות למערכת ההוצאה לפועל בכל המדינה שלא לגבות מעבר לריבית המותרת. עם העתירה התבקש גם צו שימנע את תפיסת דירתם של העותרים. כן התבקש צו עשה נגד ראש ההוצאה לפועל לדון לאלתר בטענות העותרים.

דין העתירה להדחות על הסף. העתירה אינה מגלה על פניה עילה להתערבותו של בית המשפט הגבוה לצדק. יתר על כן, טענות העותרים בעניין חישובי הריבית הועלו בפני ראש ההוצאה לפועל ואכן זהו המסלול הנכון לדון בכך כדי שתתקבל הכרעה שיפוטית מושכלת. כידוע "על הכרעה שיפוטית מושכלת להיות קשורה בטבורה לעובדות קונקרטיות העולות מהמקרה" (דברי ב- בג"ץ 7190/05 לובל נ' ממשלת ישראל , פסקה 6 לפסק דיני (טרם פורסם, 18.1.2006)). העותרים אומנם אינם שבעי רצון מההחלטות שהתקבלו ובפרט מכך שלא עוכבו הליכי ההוצאה לפועל הננקטים נגדם ואולם בית משפט זה אינו יושב כערכאת ערעור על החלטות המתקבלות במסגרת הליכי הוצאה לפועל ובענייננו אין מקום לסטות מכלל זה (בג"ץ 8490/05 עידן נ' ראש ההוצאה לפועל בפתח תקווה (טרם פורסם, 14.9.2005); בג"ץ 2235/07 שער מזרח – נכסים בע"מ נ' בית המשפט המחוזי בתל אביב (טרם פורסם, 9.3.2007); והשוו בג"ץ 9162/06 בלומנוב נ' מדינת ישראל (טרם פורסם, 28.1.2009)). זאת ועוד: לעותרים קיים גם סעד חלופי ואף שהם מעוניינים "לדלג" ישירות לבית משפט זה אין מקום לאפשר זאת. כפי שכבר נקבע:
"ככל שעותר מרגיש עצמו נפגע מהליכי הוצאה לפועל נגדו, קיימים מסלולים בחוק בהם עליו ללכת ועליהם לא ניתן לדלג ישירות לבית משפט זה, בשבתו כבית משפט גבוה לצדק" (בג"ץ 8695/00 שיין נ' הנהלת בתי המשפט (לא פורסם, 30.11.2000)).

כמובן שאיננו מביעים כל עמדה לגופן של טענות העותרים והם רשאים לנקוט בהליכים העומדים לרשותם על פי כל דין ואם מבוקשם הוא לזרז מתן החלטה בערכאות אחרות עליהם לפנות בבקשה מתאימה לאותן ערכאות (בג"ץ 10739/06 פחימה נ' רשם בית משפט השלום בת"א (טרם פורסם, 27.12.2006); כן ראו בג"ץ 4622/99 לשם הפקות בע"מ נ' הנהלת בתי-המשפט (טרם פורסם, 19.7.1999)).

העתירה נדחית אפוא על הסף וממילא נדחות הבקשות לצווים זמניים. משלא נתבקשו תגובות לא יעשה צו להוצאות.
