החלטה
לפניי בקשה לפסיקת הוצאות מטעם העותרת.

ביום 19.1.2009 החליטה ועדת הערעורים לפי חוק נכי רדיפות הנאצים, התשי"ז-1957 (להלן: החוק) לקבל את ערעורה של העותרת ולהכיר בעותרת כ"נרדפת" על פי החוק. המשיבה קיבלה את החלטת הוועדה ביום 21.1.2009 והגישה עליה ערעור לבית המשפט המחוזי. בעתירה, שהוגשה ביום 27.4.2009, ביקשה העותרת להורות למשיבה לשלם לעותרת את התגמולים המגיעים לה בהתאם לחוק. על פי הנטען בעתירה, לאחר החלטת הוועדה פנתה העותרת בכתב למשיבה בכתב ארבע פעמים בדרישה לסיום הטיפול בתיק, אך פניותיה נותרו ללא מענה. העתירה הוגשה לאחר המתנה של שלושה חודשים לקבלת התגמולים, כאשר לטענת העותרת היא זקוקה נואשות לכספים כדי להקל, ולו במעט, על מצוקתה הכלכלית. עם הגשת העתירה הורתה כב' הנשיאה כי על המשיבה להגיש את תגובתה תוך 30 ימים.

ביום 1.6.2009 הוגשה תגובת המשיבה ולפיה העתירה התייתרה ודינה להידחות. נטען בתגובת המשיבה כי ביום 21.1.2009 התקבלה אצל המשיבה החלטת ועדת הערר והחל הטיפול בתביעה לצורך קביעת דרגת הנכות של העותרת ותשלום התגמולים בהתאם. לאחר השלמת הבדיקות הנדרשות הועבר עניינה של העותרת לוועדה הרפואית לצורך קביעת דרגת הנכות. ביום 3.5.2009 התכנסה הוועדה הרפואית וקבעה לעותרת 25% נכות. מכתב בנדון נשלח לבא-כוח העותרת ביום 5.5.2009.

בעקבות תגובת המשיבה הגישה העותרת (ביום 8.7.2009) בקשה למחיקת העתירה תוך חיוב המשיבה בהוצאות. נטען בבקשה כי הגשת העתירה היא שהביאה לכך שהמשיבה החלה לטפל בתיקה של העותרת, באופן ששולמו לה התגמולים בסוף חודש יוני 2009. העותרת סבורה כי הגשת העתירה הייתה מוצדקת, וזו הוגשה לאחר ארכות מספר שניתנו למשיבה. העותרת טוענת כי תשלום תגמולים ל"נרדף", כמעט חצי שנה לאחר שהוכר ככזה, אינו בבחינת התנהלות רגילה של המשיבה, כפי שהמשיבה מנסה להציג בתגובתה. ומכל מקום מדובר בהתנהלות בלתי ראויה. נטען כי לו עניינה של העותרת היה מטופל באופן מיידי, הייתה נחסכת הגשת העתירה וההוצאות הכרוכות בכך. העותרת מציינת כי העתירה הומצאה כבר ביום הגשתה (27.4.2009) לידי המשיבה ורק לאחר מכן החל הטיפול בעניינה ברשות המוסמכת.

המשיבה, מנגד, סבורה כי דין הבקשה לפסיקת הוצאות להידחות. המשיבה בתגובתה עמדה על סדר הפעולות של הרשות המוסמכת בטיפולה בתביעה לקבלת תגמולים. הוסבר כי ככל שנקבע כי התובע היה "נרדף" פונה הרשות המוסמכת לבדוק האם מתקיימים בעניינו תנאי הסף המוגדרים בחוק, וככל שהתנאים מתקיימים מועבר התיק לרופא הראשי של הלשכה על מנת לקבוע באם התובע אכן חולה במחלות שבגינן הוא תובע הכרה והאם ישנו קשר סיבתי בין מחלות אלו לנרדפותו. משהוכרו המחלות, מועבר התיק לוועדה רפואית לצורך קביעת דרגת הנכות, ובהתאם לשיעור הנכות נמסרת הוראת תשלום. באשר לעניינה של העותרת, נטען כי הטיפול בתביעה, מראשיתו (בינואר 2009) ועד השלמתו (בסוף חודש יוני 2009) נעשה כחלק מהטיפול הסדיר של המשיבה בתביעות מסוג זה ולא הושפע כהוא זה מן העתירה שהוגשה. נטען כי המשיבה קיבלה את החלטת ועדת הערר ביום 21.1.2009 והחלה בהליך הטיפול לצורך קביעת דרגת הנכות של העותרת. לאחר השלמת הבדיקות הנדרשות הועבר עניינה לוועדה הרפואית אשר התכנסה ביום 3.5.2009. מכתב על כך נשלח לעותרת ביום 5.5.2009 כחלק מהליך הטיפול הסדיר בתביעה, אף בטרם הגיע דבר קיומה של העתירה לידיעתה של פרקליטות המדינה. המשיבה הדגישה כי להגשת העתירה לא הייתה כל תרומה או השפעה על סיום הטיפול בעתירה ומשכך אין לחייב את המשיבה בהוצאות הגשתה. המשיבה אף מציינת כי העתירה לא היתה נחוצה מלכתחילה, מאחר שבאי-כוח העותרת מקיימים עם המשיבה קשר טלפוני ובלתי אמצעי יומיומי, בעניינים רבים, ומכירים את הליכי עבודתה.

לאחר עיון בבקשה, בתגובה לה ובחומר המצוי בתיק וכן בשים לב לאמות המידה שנקבעו ב בג"צ 842/93 אל נסאסרה נ' שר
הבינוי והשיכון , פ"ד מח (4) 217, באתי לכלל מסקנה כי דין הבקשה להתקבל. על פי הכללים בהלכה הפסוקה, יש לבדוק האם היה צידוק בהגשת העתירה; האם לא הזדרז העותר בפניה לבית המשפט ומיצה את כל האפשרויות הפתוחות בפניו ופעל כראוי אצל הרשויות המוסמכות; האם לא היה שיהוי בהגשת העתירה; והאם הגשת העתירה היא שהניעה את המשיב ולהעניק לעותר את הסעד המבוקש בעתירה. העותרת קבלה בעתירה על עיכוב בתשלום תגמולים בעקבות הכרתה כ"נרדפת" לפי חוק נכי רדיפות הנאצים. היא ניסתה לקבל סעד מן המשיבה טרם הפנייה לבית המשפט. היא פנתה בכתב לרשות המוסמכת ארבע פעמים טרם הגשת העתירה, אך ללא הועיל. יוער כי בתגובת המשיבה אין כל הסבר לכך שלא ניתן מענה לפניות העותרת. את המחדל שבאי מתן מענה לפניות העותרת לא ניתן לתלות ב"טיפול הסדיר" בתביעות מסוג זה. אי מתן מענה במשך שלושה חודשים אינו יכול להיחשב "טיפול סדיר" בפנייה לרשות ציבורית, לא כל שכן בפנייה של "נרדף" לרשות המוסמכת לפי חוק נכי רדיפות הנאצים. יש לזכור כי מדובר בפונים מבוגרים, אשר נוכח גילם ומצבם הרפואי, לחלוף הזמן בעניינם יש משקל ניכר. כל אלה מחייבים מתן מענה הולם לפונים לרשות המוסמכת, ובתוך זמן סביר. ניתן אף לצפות כי מי מוש ן של החלטות שיפוטיות בעניין תשלום תגמולים, ייעשה אף הוא במהירות האפשרית.

על רקע זה שוכנעתי כי מתקיימים בעתירה התנאים המביאים לפסיקת הוצאות. נוכח פניותיה של העותרת למשיבה והמתנתה למענה, אין לומר כי העתירה הייתה מוקדמת וכי לא קדם לה מיצוי הליכים. בנוסף, ניתן לקבוע כי הגשת העתירה הייתה מוצדקת. נוכח הזמן המ מוש ך שחלף מהחלטתה של ועדת הערר והעדר מענה לפניות העותרת, כמו גם גילה של העותרת ומצבה הרפואי והכלכלי, בראייה אובייקטיבית הגשת העתירה הייתה מוצדקת. זאת בין אם הטיפול בעניינה של העותרת היה "טיפול סדיר" ובין אם לאו. לעניין זה מרכז הכובד מצוי בשאלה האם מנקודת מבטו של עותר סביר, הגשת העתירה הייתה נחוצה והכרחית, ולא בשאלת הקשר הסיבתי בין הגשת העתירה לבין הסעד שהתקבל. עצם העובדה שפניות העותרת לא נענו הצדיק הגשת העתירה במועד בו הוגשה. אוסיף כי גם אם לא ניתן לקבוע כי הגשת העתירה, כשלעצמה, היא שהובילה למתן הסעד המבוקש, הרי שנוכח העובדה שהעתירה הומצאה לרשות המוסמכת עוד ביום 27.4.2009, אין בידי לשלול את האפשרות כי הגשת העתירה תרמה תרומה מסוימת להחשת הטיפול בעניינה של העותרת. חיזוק להשערה זו ניתן למצוא בכך שבמסגרת תגובות המשיבה לא ניתן פירוט של הפעולות שנעשו בעניינה של העותרת מינואר 2009 ועד העברת התיק לוועדה הרפואית שהתכנסה ביום במאי 2009.

אשר לשיעור ההוצאות, מדובר בעתירה שאינה מורכבת, שנסתיימה בלא צורך בכתבי בי דין נוספים ובקיום דיון. בשים לב למכלול השיקולים ולכלל נסיבות העניין, יעמדו ההוצאות על סך של 12,000 ₪. סכום זה נקבע גם באין ראיות מטעם העותרת לעניין שכר טרחה והוצאות משפט. סכום זה ישא הפרשי הצמדה וריבית כדין, מיום ההחלטה ועד התשלום בפועל.
