השופט א' רובינשטיין:
רקע
א.
לפנינו בקשה שהוכתרה כהליך של בזיון בית המשפט, בטענה כי לא קוים פסק דיננו מיום 19.12.11, כפי שיפורט. בעתירה שביסודה נתבקש, כי בית המשפט יורה למשיבים להעביר את מערכת קוי החשמל העילית ביישוב אלקנה כך שתהיה תת קרקעית, טרם אכלוס בתי השכונה. כן ביקשו העותרים, כי המשיבים יחויבו להעביר שנאי חשמל ממקומו הנוכחי אל מקום המרוחק מבתי המגורים בפרויקט, וכי ההוראה בדבר אישור תכנית חשמל (אלקנה-שכונת אשקוביות) (יהודה ושומרון) התש"ע-2009, תבוטל עם אכלוס המבנים
על ידיהם.
ב.
העותרים טענו, כי הקמת מערכת עילית נעשתה בניגוד להוראות תכנית המתאר החלה על השטח, והצבתו של שנאי בסמיכות לבתי תושבי היישוב מהוה סיכון לתושבים. כן נטען, כי הותרת ההוראה בדבר אישור תכנית חשמל (אלקנה-שכונת אשקוביות) על כנה לאחר אכלוס הפרויקט תהוה פגיעה בזכויות העותרים, וכי אכלוס הפרויקט מהוה שינוי נסיבות מהותי המחייב את שינויה.

בתשובת המדינה מיום 15.12.11 צוין, כי "בעקבות נסיבות חדשות שהתבררו לאחרונה במסגרת הטיפול בעתירה...בכוונת קמ"ט חשמל במנהל האזרחי לפנות לחברת החשמל ולמועצה המקומית אלקנה, להביא בפניהן את העובדות החדשות שהתבררו, ולבקש כי יפעלו-בתיאום עמו-על מנת להביא לפתרון הסוגיה המתעוררת בעתירה והטמנת קו המתח הגבוה העובר בתחום תכנית המתאר המפורטת, בהקדם". צוין, כי בשל הדמיון בצבעים ובאופן שבו נעשה בהם שימוש לסימון קוי מתח עיליים ותת קרקעיים בתכנית החשמל, סברו גורמי התכנון בטעות כי קוי המתח הגבוה המסומנים בתכנית החשמל הם תת קרקעיים. אשר לשנאי החשמל נטען, כי בהתאם לחוק החשמל, התשי"ד-1954 ולתקנים מקצועיים, המרחק המינימלי להצבת שנאי חשמל מבתי מגורים הוא 3 מטרים , ובענייננו מדובר ב- 10 מטרים .
ד.
בעקבות תגובה זו, המכירה בטעות, ושיח ושיג שהתקיים עם הצדדים בדיון שנערך ביום 19.12.11 (בהרכב המשנה לנשיאה ריבלין והשופטים רובינשטיין ופוגלמן) ניתן פסק דין כדלקמן:
"רשמנו לפנינו את הודעת נציגת קמ"ט חשמל כי בכוונת משרד השיכון לקדם פיתרון שיאפשר את הטמנתו של קו המתח הגבוה בלא להמתין לפיתוח יתר השכונה. הקמ"ט החל כבר בטיפול בנושא.
רשמנו לפנינו את התחייבות משרד השיכון להקים שנאי במקום חלופי.
נציגת המדינה הודיעה לנו כי להערכתה ידרשו עשרה חודשים להשלמת הפתרון, ולאחריהם ניתן יהיה להטמין את קוי החשמל ולהקים את השנאי במקום החלופי.
בכפוף לכך תימחק העתירה ללא צו להוצאות".
הבקשה והתגובות
ה.
ביום 3.1.13 הגישו העותרים בקשה לפי פקודת בזיון בית המשפט, בטענה כי המשיבים עוסקים "בהטחת האשמות זה בזה ובמשיכת זמן מיותרת, תוך שהם מותירים את העותרים כשבויים בנבכי הבירוקרטיה וללא פתרון לבעיה אשר המשיבים בעצמם הודו כי בטעות יסודה".
ו.
בתגובה ביקשו המשיבים 3-2 (המדינה) להבהיר, כי אינם מתנערים מהתחייבותם לפעול לתיאום עם כלל הנוגעים בדבר כדי לקדם פתרון. עם זאת הודגש, כי בפסק הדין מיום 19.12.11 לא ניתן צו אופרטיבי המורה למשיבים לפעול באופן מסוים, ומכל מקום פקודת בזיון בית המשפט אינה חלה על המדינה.
ז.
לגופם של דברים נטען, כי המשיבים פעלו לשם קידום מציאת פתרון ונפגשו עם נציגי המועצה המקומית אלקנה ועם נציגי חברת החשמל בחודש אפריל 2012. במסגרת הפגישה הועלתה חלופה אפשרית להעתקת השנאי ולהטמנת קוי המתח הגבוה והנמוך, אולם בשל תקלה חל עיכוב בבחינת החלופה שהוצעה, ורק לאחרונה חלה התקדמות בבחינת החלופות להעתקת השנאי ולהטמנת התשתיות. לאחרונה גם הועברו נקודות הציון המדויקות להעתקת שנאי קו המתח הגבוה בהתאם לחלופה האפשרית לגורמים הרלבנטיים, אולם קמ"ט החשמל במנהל האזרחי סבר שעלולים להתעורר קשיים שונים ביחס לחלופה זו, וביקש את קמ"ט חשמל ממשרד השיכון לבחון נקודת ציון אלטרנטיבית להצבת השנאי. חלופה כאמור נמצאה.
ח.
הוסבר, כי בהמשך עתיד משרד השיכון לפנות לחברת החשמל בבקשה לפתיחת הזמנה לביצוע העתקת השנאי והטמנת התשתית. נטען, כי ככל שתאושר תכנית החשמל לפי החלופה הנבחנת היום על ידי קמ"ט חשמל, הנה להערכת גורמי משרד השיכון יימשכו הליך העתקתו של השנאי והטמנת קוי המתח הגבוה בקרקע, ממועד אישור התכנית, כמחצית שנה. לבסוף הודגש, כי הצבת השנאי במקומו הנוכחי עומדת בתקנים המקצועיים שנקבעו לעניין זה, ואינה מהוה סכנה בריאותית לתושבים.
ט.
המשיבה 1 (חברת החשמל) טענה כי דין הבקשה להידחות, שכן לא הוצא צו אופרטיבי כלשהו מלפני בית המשפט. לעיצומם של דברים נטען, כי עד מועד מתן התגובה לא הועברה לה תכנית בת יישום אשר תהוה בסיס לתכנון הטמנתם של כבלי החשמל והעברת השנאי, ואשר בהיעדרה אין באפשרות חברת החשמל לקדם כל פתרון שבמסגרתו יוקם השנאי במקום חלופי. המשיבה 4, המועצה המקומית אלקנה, טענה כי עשתה כל שבידה לתרום להמשך עבודות הפיתוח בפרויקט, וכי אף שהושגה הסכמה בדבר פתרון חלופי זמני, לא פעלו המשיבים 3-2 באופן שיאפשר זאת. לטענת המשיבה 5, חברת דונה, משלא ניתן צו אופרטיבי, אין מקום להפעלתה של פקודת בזיון בית המשפט, ובכל מקרה המשיבה 5 לא נתנה כל הצהרה או התחייבות כלשהי.

ברי מחד גיסא, כי באופן משפטי טכני-פורמלי לא היה כאן בזיון בית המשפט, כיון שכפי שציינו חלק מן המשיבים לא כלל פסק הדין מיום 19.12.11 הוראה אופרטיבית. אך מאידך גיסא במשפט מינהלי עסקינן וברשויות ובנלויהן. הכל חייבים בכיבוד פסקי דין, והמדינה על כולנה; אין ענייננו בבעל דין "רגיל", אלא ברשות מינהלית שעליה חלות חובות מוגברות, וגם המדינה, דומני, שאינה חולקת כך. אכן, אין בפנינו התחייבות "חקוקה בסלע", ומסגרת הזמן לא היתה קשיחה, אך יפים לכך, בשינויים המחויבים, הדברים הבאים:
"העובדה שפסק הדין בעתירה שלפנינו ניתן על דרך של רישום התחייבות המדינה ולא הוצא בו צו מוחלט אינה מעלה ואינה מורידה לעניין סופיות הדיון והחובה הברורה והיסודית לקיים פסקי דין. אכן, במקרים בהם המדינה מקבלת על עצמה התחייבות לבצע פעולה כלשהי או להימנע מפעולה, נמנע בית המשפט, לעתים, מהוצאת צו אופרטיבי מתוך כיבוד הדדי בין הרשויות. אולם, מרגע שההתחייבות כלולה בפסק דין, מדובר בחובה לקיים את פסק הדין לכל דבר ועניין. ייתכן, כי לעובדה שלא הוצא צו אופרטיבי עשויה להיות השפעה על האפשרות להגיש הליך של בזיון בית המשפט, במקרה בו פסק הדין לא קוים (ראו, לעניין האפשרות לפתוח בהליכי בזיון בית משפט בשל אי-קיום צו הצהרתי: בג"ץ 306/85 כהנא נ' יו"ר הכנסת , פ"ד לט(4) 485 (1985)). שאלה זו לא עמדה לפנינו, ועל כן אין אנו נדרשים לה" (בג"צ 9060/08 עבד-אלג'אני יאסין ח'אלד עבדאללה ואח' נ' שר הביטחון (7.5.12) מפי הנשיא גרוניס, פסקה 11).
ערים אנו לכך שאין זהות משפטית מוחלטת בין המקרים, שכן בנידון דידן היתה "הערכה" ולא התחייבות קשוחה – אך גם להתחייבות "גמישה" יש גבולות סבירים.
יא.
בנסיבות, תחת "עשרה חודשים להשלמת הפתרון", כאמור בפסק הדין ולוא בצורה שאינה קשיחה, מצויים אנו ארבעה עשר חודש לאחר פסק הדין, ופתרון אין גם באופק הקרוב. זאת – בשל עיכוב בקידום חלופה שהוצעה באפריל 2012 (רק אז, כנראה, נתכנסו חכמי הנושא לדיון משותף) ובשל צפי עתידי לבחינת החלופה הנבחנת כתום מספר חודשי בחינה מקיפה ועוד מחצית שנת ביצוע, מה שיביאנו לסוף שנת 2013 במקרה הטוב, קרי, שנתיים לאחר פסק הדין. בית משפט זה צריך לראות עצמו בלית ברירה כ"שמרטף", כדי לוודא שהרשויות ימלאו חובתן בקצב סביר; ראו בג"ץ 5587/07 עוזיאל נ' מס רכוש (2008), פסקה ו', שם נאמר:
"תפקיד בית המשפט
במקרה זה, כמו במקרים דומים לא מעטים בגדרי המשפט המינהלי, לא היה בכתיבת פסק דין משפטי מלומד, אלא בליווי הרשויות תוך עידוד וזירוז פעולתן, מעשה אומנת או שמרטף; זאת - כדי לקדם את מימוש חובתן על פי הדין במבוכי המינהל הציבורי, שלא לומר בירוקרטיה. תפקיד זה משמעו שהתיק אינו נסגר ונגנז אלא נותר חי, עד להסדר סביר של הבעיה שהועלתה בעתירה. אף במקרה דנא לא היה בית המשפט נכון לסגור את התיק עד שעיקר הנושא ייפתר".
זו תרומתו של בית המשפט לרווחת אזרחים הנצרכים לשירותי הרשויות, שלעתים הם כ"מי השילוח ההולכים לאט" ( ישעיהו ח', ו').
יב.
על כן, עם שאין לפנינו – כאמור – ביזיון במובן המשפטי-טכני, והמדובר בתיק שלכאורה נסגר, נבקש הודעת עדכון ממשיבי המדינה בתוך ארבעה חודשים מהיום. המשיבים האחרים והעותרים יוכלו להגיב בתוך 15 יום לאחר מכן. בעקבות זאת נחליט באשר לצורך בהמשך ה"שמרטפות".
