לפני בקשה מטעם העותרים לפסיקת הוצאות בגין ההליך שבכותרת. עניינה של העתירה (מיום 15.11.07) היה בהשגה על החלטת הוועדה לתשלום לפנים משורת הדין לנפגעים על רקע לאומני (להלן: המשיבה) שלא ליתן לעותרים פיצוי בגין מותו של העותר מספר 1 (להלן: העותר). ביום 29.3.09 הורו כב' השופטים (הנשיאה ד' ביניש, השופטת א' פרוקצ'יה, השופט ח' מלצר) על מחיקת העתירה לאחר שעניינם של העותרים הובא לבחינתה החוזרת של הוועדה (בהמלצת בית משפט זה במהלך דיון שנערך ביום 19.1.09); ובדיון מחודש זה הוחלט – בדעת רוב – ליתן הסעד. נותר עניין ההוצאות.

לאחר עיון בחומר שלפני ובטענות בעלי הדין, נחה דעתי כי דין הבקשה לפסיקת הוצאות כנגד המשיבים
בהליך זה – להדחות. יצוין תחילה – כי מלכתחילה גדריה של בקשה מעין זו הם עדינים למדי: כך הדבר, ראשית , שכן העתירה הוגשה כאמור כנגד החלטתה של וועדה שהוקמה על פי החלטת היועץ המשפטי לממשלה (מיום 20.4.1999) וכל פעולתה הוא "לפנים משורת הדין". זאת, שכן מוסמכת היא לזכות בפיצויים מי שאינו זכאי לפצויים מכוח הדין הרלבנטי (חוק התגמולים לנפגעי פעולות איבה, התש"ל – 1970) והתשלום ניתן אפוא "לפנים משורת הדין" (ראו: הודעה לתשלום לפנים משורת הדין לנפגעים על רקע לאומני – קריטריונים לתשלום ונהלי עבודה, י"פ 4908 מיום 9.8.2000). שנית ,
בית משפט זה לא העניק לעותרים את הסעד שנתבקש אלא שבמהלך דיון שנתקיים (ביום 19.1.09) הוחלט כי "אנו ממליצים כי הוועדה תשוב ותבחן את עניינים של העותרים, שכן על פי רף הראיות הנדרש להכרעה של הוועדה הפועלת לפנים משורת הדין, נראה כי ההסתברות היא שיש מקום להעריך כי עניינו של המנוח הוא בגדר אותם מקרים שראוי שהוועדה תשקול בחיוב". הנה כי כן, מתבקש לפני חיוב המשיבה בהוצאות המשפט של העותרים שהגישו עתירה על אי מתן סעד לפנים משורת הדין; וזאת כאשר הסעד ניתן גם הוא על יסוד "המלצה לשקול בחיוב"; המלצה שנתקבלה לבסוף בדעת רוב משהוחזר הדיון לוועדה.

אכן, עתירה לחיוב בהוצאות בנסיבות מעין אלו מעמידה עצמה על יסוד לא פשוט מלכתחילה, גם בשים לב לכללים שנקבעו בעניין פסיקת הוצאות בבג"ץ 842/93 אל נסאסרה נ' שר הבינוי והשיכון , פ"ד מח(4) 217, (1993) (ראו למשל: בג"ץ 10181/08 רס"ב מאיר ברום נ' הועדה להכרה לנכות לפנים משורת הדין – משרד הביטחון (לא פורסם, 24.5.09); בג"ץ 772/05 אורי כהן נ' ראש תחום רכב רפואי, אגף השיקום משרד הביטחון (לא פורסם, 13.3.06)).
האם מכאן נובע כי לעולם לא תיעתר בקשה לפסיקת הוצאות המבוססת על נסיבות מעין אלו של לפני-פנים-משורת הדין? אין הכרח כי זו תהא המסקנה. כך הדבר, שכן הגם שמלכתחילה יש להבחין הבחן היטב בין חיוב שעל פי הדין לבין חיוב שלפנים משורת הדין (וראו גדרי הוויכוח שבע"א 350/77 כיתן בע"מ נ' וייס , פ"ד לג(2) 785 (1979)), עדיין יש מקרים בהם פעולה שלפנים משורת הדין, או שמא מחדל מלפעול לפנים משורת הדין, יכול ויצמיחו ביקורת שיפוטית. כך בייחוד מקום
בו המ דובר ברשות ציבורית, ובבחינה של הליך קבלת החלטות ראוי (וראו עוד והשוו, רון ש' קליינמן, "כפיית נורמות של 'לפנים משורת הדין' על גופים ציבוריים", ספר שמגר (מאמרים – חלק א', 469 (2003)). ואם קום תקום עילה לביקורת שיפוטית, יכול גם ותקום עילה לפסיקת הוצאות בגין איזה מן התנאים שנקבעו בפסיקה בפרשת אל-נסארסה הנזכרת (ראו למשל: (ראו למשל: בג"ץ 9117/07
נטליה מולר נ' שר הפנים ואח' (לא פורסם, 2 2.6.08) בג"ץ 4110/03 הועד הארצי לראשי הרשויות המקומיות הערביות בישראל ואח' נ' שר הפנים (טרם פורסם, 25.5.03)). אלא שמקרים אלו של עילה – וממילא של זכות להוצאות – יהיו מקרים מיוחדים בהם יהא על הטוען להוצאות נטל מוגבר בביסוס התנאים לפיהם הגשת העתירה היתה מוצדקת וקבלת הסעד באה – כעניין שבמהות – בשל הגשת העתירה (וראו פרשת אל נסארסה , הנ"ל). כך הדבר, שאם לא כן נמצא הגבול שבין מידת הדין לבין מידת לפנים משורת הדין הולך ומטשטש (וראו דברי השופט שמגר בפרשת כיתן הנזכרת, בעמ' 805).

על רקע זה יש לשוב למקרה שלפני. העתירה הוגשה תוך טענה כי מכלול הנסיבות הקשורות במותו של המנוח, מקליע רובה, מתיישבות עם הגירסה לפיה המוות נגרם בשל פעולה על רקע לאומני, וקשורה היתה בעבודתו של המנוח במסיק זיתים. באין הסבר אחר, טענו העותרים כי יש לקבל גירסה זו ולהעניק פיצוי לפנים משורת הדין. המשיבה סברה אחרת במובן זה שלא הובאו לפניה ראיות מנהליות המבססות דיין גרסה זו. כך בין היתר, נוכח פגמים ראייתיים בכל הקשור ביכולת לזהות את הכלי היורה ובשוני בין סוג הנשק ממנו נורה הקליע לבין כלי הנשק שהחזיקו אותם התושבים להם יוחס הירי הנטען. עוד נטען, כי נסיבות האירוע כפי שעלו מעדויות שנגבו אינן בהכרח אלו הנטענות על-ידי העותרים, במובן זה שגם אם נפגע עותר מס' 1 מירי, לא היה זה כתוצאה ממניע לאומני או גזעני ובוודאי שלא במטרה עיקרית וממילא אין המקרה נופל לקריטריונים שנקבעו בנוהל על פיו פועלת הוועדה. בית משפט זה המליץ כאמור לוועדה לשוב ולשקול בחיוב את עמדתה והיא עשתה כן והחליטה כפי שהחליטה בדעת רוב. בנסיבות אלו, לא מצאתי כי לבד ממתן הסעד לאחר הגשת העתירה, יש לראות את המשיבה כחבה בהוצאות העותרים. וועדת לפנים משורת הדין קיבלה ההמלצה לשוב ולדון בעניין ובכך אין בנסיבות המקרה משום ביסוס התנאי לפיו
העתירה היתה מוצדקת.
5.התוצאה היא, אפוא, כי דין הבקשה לפסיקת ההוצאות להידחות וכך אני מורה.
