החלטה
בפניי בקשה להארכת מועד להגשת הליך ערעורי על פסק דינו של בית המשפט המחוזי בחיפה מיום 31.1.2010 ועל החלטתו מיום 18.7.2010 בהם נדחו ערעורים שהגיש המבקש על החלטת הוועדה הפסיכיאטרית לדחות ערר על החלטת הפסיכיאטר המחוזי אשר הורה לאשפז את המבקש באופן כפוי וליתן לו טיפול מרפאתי כפוי.
לטענת המבקש הזמן הממושך אשר חלף למן מועד פסק הדין וההחלטה נובע מכך שתקופה ארוכה היה מאושפז ובדצמבר 2013 פנה ללשכה לסיוע משפטי על מנת שיסיעו לו, ובקשתו סורבה ועל כן נאלץ להגיש את הבקשה בעצמו. המבקש מדגיש כי דיון בבקשתו נדרש לצורך דיון עקרוני בחוקתיות החוק אשר מכוחו אושפז.
ואולם, עיון בבקשת רשות הערעור שהגשתה מתבקשת מלמד כי לטענת המבקש היה הוא מאושפז בחודשים ינואר-פברואר 2010 וקיבל טיפול מרפאתי כפוי עד לחודש ספטמבר 2010. המבקש לא הבהיר מדוע לאחר ששוחרר מן האשפוז לא הגיש כל בקשה או הליך מטעמו, ומדוע המתין שהות כה ארוכה בעניין, וממילא לא הרים את הנטל להוכחת קיומו של "טעם מיוחד" בעניינו. כמו כן המבקש עצמו ציין כי פנה ללשכה לסיוע משפטי בבקשה כי יסייעו בידו אך בדצמבר 2013 (לאחר שחלק מן הראיות הגיעו לידיו לטענתו בינואר 2013), וכן לא הבהיר בבקשתו מדוע לכל הפחות באותה עת לא פנה לבית משפט זה בבקשה למתן ארכה והמתין שהות נוספת ניכרת עד ליום 4.5.2014, מועד הגשת הבקשה.
בנוסף, משהטיפול הכפוי במבקש הסתיים לטענתו עוד בשנת 2010 הרי שההליך שהגשתו מתבקשת הינו תיאורטי מבחינת המבקש עצמו, וכידוע ככלל ובהעדר נסיבות חריגות, אשר על פני הדברים נראה כי אינן מתקיימות בענייננו, בית משפט זה אינו דן בהליכים תיאורטיים אשר עילתם הקונקרטית הפכה בלתי מעשית (ראו: בג"ץ 8680/08 התנועה למען איכות השלטון בישראל נ' שרת החינוך (29.9.2013); רע"א 2409/05 פלונית נ' פקידת הסעד לחוק הנוער (10.7.2005)). דומני כי בהינתן האמור סיכוייו של ההליך אינם תומכים אף הם במתן הארכה המבוקשת.
בנסיבות המתוארות והגם שנתתי דעתי לכך שהמבקש אינו מיוצג ולרגישות ההחלטות שעל הפרק, סבורני כי אין מקום להאריך את המועד להגשת ההליך בחלוף תקופה כה ממושכת למן מועד מתן פסק הדין וההחלטה.
אשר על כן, הבקשה נדחית.
