החלטה

בהחלטתי מיום 10.6.2014 קיבלתי את בקשתה של המבקשת לאחד את הדיון בארבעה הליכים המתבררים בין בעלי הדין בשלושה בתי משפט שלום שונים. פיצול ההתדיינות ארע מאחר שהמבקשת נאלצה להגיש התנגדויות לארבע בקשות שונות לביצוע שטרות שהגישה נגדה המשיבה, בשלוש לשכות הוצאה לפועל בשני מחוזות (ראו, תקנה 28א לתקנות ההוצאה לפועל התש"ם-1979, הקובעת שיש להגיש, ככל הניתן, בקשה אחת לביצוע כמה שטרות נגד אותו החייב; וכן החלטתי לאחרונה בבש"א 3759/14 פרל נ ' בנק מרכנתיל דיסקונט בע"מ , פיסקה 3 (13.6.2014)). בהחלטתי מיום 10.6.2014 ציינתי כי "המשיבה מסכימה לאיחוד הדיון, אך מסתייגת מאופן ניסוח הבקשה ומכך שתחוייב בהוצאות". לא למותר לציין, כי בעמדתה שצורפה לבקשה לאיחוד דיון הדגישה המשיבה כי אין מנוס מלפעול לאיחוד הדיון בהליכים. בהחלטתי הנזכרת חויבה המשיבה בשכר טרחה בסכום של 5,000 ש"ח.

בבקשה לעיון מחדש מבקשת המשיבה את ביטול החיוב בהוצאות שהוטל עליה במסגרת החלטתי מיום 10.6.2014. יצוין, כי המשיבה מדגישה כי אינה חולקת על ההחלטה בדבר איחוד הדיון בהליכים. לאחר ששבתי ועיינתי בחומר איני רואה מקום לשנות מהחלטתי מיום 10.6.2014. סבורני, בייחוד נוכח עמדתה של המשיבה בדבר הצורך באיחוד הדיון, כי ראוי היה שמלכתחילה תפעל המשיבה לאחד את בקשותיה במסגרת בקשה אחת לביצוע השטרות. כך היה נחסך זמנם של בעלי הדין, כמו גם זמנו של בית המשפט. התנהלות זו היא אשר הצדיקה לטעמי את חיובה של המשיבה בהוצאות שחויבה בהן.
