א.
בקשה להארכת מעצרו של המשיב לפי סעיף 62 לחוק סדר הדין הפלילי (סמכויות אכיפה – מעצרים), תשנ"ו-1996, בתשעים ימים החל מיום 5.1.09 או עד מתן פסק הדין בתפ"ח 1031/08 בבית המשפט המחוזי בתל אביב, לפי המוקדם.
ב.
כתב האישום, אשר הוגש ביום 4.4.08, מייחס למשיב שני אישומים בעבירות של מעשים מגונים ומעשה מגונה בפומבי בקטינות, ילידות 2002. עם הגשת כתב האישום נתבקש מעצרו של המשיב עד תום ההליכים. הוחלט, כי המשיב יישאר במעצר עד להגשת חוות דעת פסיכיאטר ותסקיר מבחן בעניינו. בחוות הדעת הפסיכיאטרית שהוגשה לבקשת המשיב נקבע, כי הוא כשיר לעמוד לדין; תסקיר המבחן שהוגש לא המליץ על חלופת מעצר וציין, כי קיים סיכון להישנות התנהגות מינית סוטה מצדו בעתיד, וכי חלופת המעצר בבית אמו בבאר שבע אינה מתאימה. עם זאת נטען, כי אם תוצע חלופת מעצר ראויה ניתן יהיה לשקול שחרורו בכפוף להשתלבות בהליך טיפולי. בתסקיר המשלים נאמר, כי מעשיו של המשיב הם בעלי אופי פדופילי וכי פיתח סטייה מינית הקשורה למשיכה לקטינות, שהוא מתקשה לרסן.

ביום 2.7.08 הורה בית המשפט (השופט נויטל) על מעצרו של המשיב עד לתום ההליכים, תוך הנחיה לאפשר לרופא מטעם המשיב ליתן לו זריקה לפי הנוהלים. ביום 22.7.08 דחה בית המשפט (השופטת שבח) את בקשת המשיב לעיון חוזר בהחלטה. הובעה תקוה לסיום בקרוב של המשפט, וכן נתנה ההנחיה בענין הזריקה. על כך הוגש ערר שנדחה על ידי בית משפט זה (בש"פ 6725/08, החלטה מיום 5.8.08 - המשנה לנשיאה ריבלין). נאמר בהחלטה, כי "בעבירות חוזרות מסוג זה שקרבנם קטינים וקטינות, אין ככלל, מקום להמיר את המעצר, כאשר קיימות ראיות לכאורה, לחלופת מעצר", אך הובעה תקוה כי "בית המשפט המחוזי יביא לסיום ההליכים מבעוד מועד, כדי שניתן יהיה להתחיל במתן הטיפול הרפואי למשיב – טיפול אותו הוא מבקש, לפי טענתו היום, שירות בתי הסוהר יעשה מצידו ככל הניתן במסגרתו, להחשת תחילת מתן הטיפול הרפואי לעורר אף עוד קודם שנסתיימו ההליכים כנגדו".
ד.
עד עתה נדחו הדיונים בתיק העיקרי מספר פעמים לבקשת המשיב ולצורך ניהול משא ומתן בין הצדדים. נאמר פעם אחר פעם, כי המחלוקת בין הצדדים אינה רחבה וכי לא יהיה צורך במועדים רבים לשמיעת הראיות. הדיון הבא לשמיעת הראיות נקבע ליום 6.4.09.
ה.
בבקשה ובדיון נטען מטעם המדינה, כי יש להאריך את מעצרו של המשיב נוכח המסוכנות הרבה הנשקפת ממנו לציבור בכלל לציבור הקטינות בפרט. נטען, כי המעשים המיוחסים לו והודעותיו שלו במשטרה מעידים על סטייה בולטת. מסוכנותו מקבלת משנה תוקף נוכח הרשעתו הקודמת במעשים דומים, בגינם נגזרה עליו ענישה טיפולית, אך ללא הועיל. לבסוף נטען, כי אמנם שמיעת הראיות בתיק טרם החלה, אך מרבית הדחיות בתיק מונחות לפתחה של ההגנה, וכי נוכח יריעת המחלוקת המצומצמת, יש להניח, כי שמיעת הראיות לא תתארך.
ו.
בא כוח המשיב טען, כי המ דובר
בשחרור לחלופה טיפולית שעליה המליץ שירות המבחן, בישיבה בראשות הרב בן-זקן המטפל באנשים בעלי בעיות דומות, תוך פיקוח מלא; וכי נקודת האיזון משתנה עתה, כתום תשעת החודשים, על פי הדין. נטען גם, כי הדחיות נתבקשו מטעם המשיב גם כדי לזרז את הדיונים, כיון שסלע המחלוקת מצומצם. עוד נטען, כי שירות בתי הסוהר אינו נותן למשיב זריקות שהומלצו. לכך השיב בא כוח המדינה, כי הזריקות ניתנות כטיפול של שיקום לאסיר, אך לא לעצור.
ז.
עיינתי בתסקירים ובחוות הדעת הפסיכיאטרית. אכן, לא הומלץ בתסקיר הראשון על חלופה בבית האם, אך נאמר בתסקיר משלים כי על פי ניסיון העבר (בלא בדיקה קונקרטית למקרה דנא), הישיבה בראשות הרב בן זקן נמצאה כחלופה ראויה לעברייני מין. עוד נאמר כי הרופא פרופסור רסלר מסר, שהמשיב מסכים בעיקרון לטיפול תרופתי להפחתת הדחף המיני. הומלץ כי אם יוחלט על שחרור לחלופה בישיבה, יועמד המשיב בפיקוח מעצר לשם השתלבות בטיפול. חוות דעת שני פרופסורים (ויצטום ורסלר) קבעה (במאי 2008) אבחנת פדופיליה והתאמה – בהסכמה – לטיפול בזריקות דקהפפטיל להורדת הדחף המיני; זאת לפחות לחמש שנים, יחד עם טיפול התנהגותי בקבוצה במסגרת שירות המבחן. ואולם, מנהל החטיבה לפסיכיאטריה משפטית במרכז לבריאות הנפש מב"ן-שב"ס כתב לבא כוח המשיב בעקבות פנייתו, כי "על פי נהלי שב"ס, הטיפול אינו ניתן לעצורים, אלא לאנשים שנשפטו, וגם זאת, על סמך אבחנה וקריטריונים מקצועיים, הכוללת בין השאר את תקופת המאסר שנקצבה" (בכפוף לאפשרות הארכה). כך גם עולה ממכתב שב"ס מ-8.12.08.
ח.
עוד נתתי אל לבי לפרוטוקולים אחדים של בית המשפט המחוזי, שבהם נתבקשה דחיה מטעם המשיב, בעקבות משא ומתן שניהל – בין היתר ב-24.6.08, 14.7.08, 8.9.08 ו-23.9.08.
ט.
שני היבטים מעוררים קושי בתיק זה. האחד – הדחיות הרבות שכביכול הנה הנה מגיע הסדר, אך הסדר לא הגיע, והמשיב במעצר. תמהני מה יכול היה הזמן החולף לתרום לגישור על פני אותו "פער קטן" בין הצדדים, וחבל שהגענו עד הלום. אוסיף, לאו דווקא לענין מקרה זה, כי בית המשפט המחוזי באשרו דחיות למשא ומתן צריך ליתן דעתו למגבלת תשעת החודשים שקבע המחוקק למעצר.
י.
ההיבט השני, כרוך בהתייחסות בעייתית, ולא אומר יותר מכך, לנושא הטיפול הרפואי לעברייני מין, שאמנם איני יודע את שורשיה ובודאי יש לה הסבר, אך תמהני כשלעצמי כיצד משורת
על-ידיה אינטרס הציבור להפחית ממסוכנותם של עברייני מין. ידוע לנו, ולא אחת נדרשנו לכך ללא הועיל, כי שירות בתי הסוהר מתחיל בטיפול בעברייני מין בתקופה האחרונה לפני שחרורם, והבענו דעתנו בנושא זה. והנה ברי כי מעצר יכול להתמשך זמן רב, והמקרה הנוכחי יוכיח, והרופאים הבכירים המליצו על 5 שנות טיפול לפחות. מדוע איפוא לא יישקל מתן הזריקות לפני כן? כדי להבין את הגישה, אבקש מעבר לתוצאה האופרטיבית בתיק, הסבר מורחב של שב"ס לענין זה – המדיניות הננקטת ויישומה – שיוגש באמצעות הפרקליטות בתוך שבועיים.
יא.
באשר לגוף התיק, תפקידו של בית משפט זה בתיקים לפי סעיף 62 לחוק המעצרים, הוא בקרת ההליך. למרבה הצער, אף שהמשיב במעצר, ומשלא גושר אותו "פער קטן" ב-23.9.08, נקבעו מועדי הוכחות כתום קרוב לשבעה חודשים, ב-6.4.09, 16.4.09 ו-5.5.09; זאת בתיק שבו מספר מועט יחסית של עדים (10, כולל שלוש מתלוננות, חמישה שוטרים ושתי חוקרות ילדים). אין חולק על העומס בבית המשפט המחוזי בתל-אביב, אך המשמעות של מתן הארכה כיום לשלושה חודשים בתיק זה, גם אם חלק מן הזמן הוצא על דחיות שביקשה ההגנה, היא הסכמה מראש להארכה נוספת. דבר זה, מכל מקום בתיק בסדר גודל כזה של ראיות, נראה לי קשה להלמו; ראו בש"פ 2968/08 מדינת ישראל נ' ורסנו (השופטת ארבל) (לא פורסם).
יב.
ולכל אלה, מתווסף היעדר הטיפול, שנראה לי על פניו כהחמצה, וגם כיוצר מעגל שוטה, כי הסיכון לעבירות נוספות גדול יותר בלעדי הטיפול, כפי שהשכל הישר מורה.
יג.
מכאן הצורך לבחון – בלא קביעת מסמרות – חלופה, תוך דגש על אי סיכון המתלוננת. ועם זאת, לא תיקבע חלופה אלא כזאת שתצמצם עד למינימום הסיכון להפרה ולסיכון קטינות.
יד.
ואולם, תסקיר שירות המבחן לא בחן קונקרטית, במפגש לצורך תיק זה, את החלופה המוצעת בישיבה, ואיני יכול להיות שקט לגביה בלא שתיבחן, היא או חלופה אחרת שתוצע, ושתבטיח, ככל הניתן, את הציבור מעבירות אפשריות על ידי המשיב; ראו בש"פ 11559/04 כהן נ' מדינת ישראל (לא פורסם) (השופטת חיות); בש"פ 5438/07 שיבלי חוסין נ' מדינת ישראל (לא פורסם), פסקה ט(2).
טו.
לכן, יוכן תסקיר מעצר חדש, שיונח תוך 21 יום על שולחנו של בית המשפט המחוזי, ובו בחינת חלופה, לרבות ובעדיפות מעצר בית מלא בבית פרטי שיוצע; וכמובן ייכללו בכל הצעת חלופה, לבד ממעצר מלא, איזוק אלקטרוני, הפקדות וערבויות, צו עיכוב יציאה, הפקדת דרכון ויכולת פיקוח של המשטרה. הדגש הוא בטחון הציבור, ולענין זה בטחון קטינות, והוא עיקר – ולצידו יכולת המשיב לקבל טיפול.
טז.
עד להחלטת בית המשפט המחוזי, ואיני קובע מסמרות לגביה, יישאר המשיב במעצר. לתשומת לב, גם האמור בסעיף י' למעלה.
