המדינה מבקשת להאריך זו הפעם הרביעית את מעצרו של המשיב לפי סעיף 62 לחוק סדר הדין הפלילי (סמכויות אכיפה – מעצרים), התשנ"ו – 1996.
כתב אישום שהוגש על ידי המדינה נגד המשיב מייחס לו כי רצח בכוונת תחילה את חמותו (להלן: המנוחה ) ב- 45 דקירות. בכתב האישום נטען כי המשיב הגיע אל בית חמותו על מנת להתקין עבורה מכשיר כלשהו, ובשלב מסוים נטל חפץ נוקשה ומוארך והחל לדקור, לפצוע ולהכות את המנוחה בצווארה, בפניה ובבית החזה, בכוונה להמיתה. כתוצאה מן הדקירות איבדה המנוחה דם רב ונפטרה.
עם הגשת כתב האישום נעצר המשיב עד תום ההליכים. ערר שהגיש על ההחלטה לעצרו עד תום ההליכים נדחה (בש"פ 11444/05). בקשה לעיון חוזר בהחלטה על המעצר נדחתה אף היא. מאז חלפה תקופת המעצר הסטטוטורית הוארך המעצר פעם אחר פעם ועתה עומדים אנו כאמור בפני בקשה להארכה רביעית של המעצר. עד כה התקיימו בתיק 13 דיוני הוכחות, 36 עדי תביעה נשמעו ועדויותיהם של חמישה עדי תביעה נוספים הוגשו בהסכמה. בתיק היו קבועים עד לא מזמן 6 מועדים לישיבות הוכחות נוספות.

ביום 13.11.06 אושפז המשיב כשהוא סובל מדימומים במוח והיה מחוסר הכרה משך כשלושה שבועות. לפני כחודשיים חזרה אליו ההכרה ומיום 19.12.06 הוא מאושפז במרכז לשיקום בבית החולים לוינשטיין (להלן: המרכז לשיקום ), כשהוא תחת השגחת שירות בתי הסוהר ואזוק, למעט כאשר הוא מקבל טיפול רפואי. ימים מספר לאחר שאיבד את הכרתו, הגיש בא כוח המשיב בקשה לעיון חוזר לבית המשפט המחוזי, לאור מצבו הרפואי של המשיב. לאחר דיון וקבלת עמדות הצדדים וחוות דעת מקצועיות, דחה בית המשפט המחוזי את הבקשה לעיון חוזר. יצוין כי במועד זה חזר כבר המשיב להכרה.
ביום 30.1.07 הוגשה חוות דעת רפואית בעניינו של המשיב מטעם המרכז לשיקום, ובעקבותיה פנה בא כוח המשיב בבקשה לבית המשפט המחוזי בבקשה למתן הוראות בה ביקש כי בית המשפט יורה כי המשיב אינו כשיר לעמוד לדין לפי סעיף 15(א) לחוק טיפול בחולי נפש, תשנ"א – 1991 ויבטל את כל מועדי ההוכחות הקבועים בתיק. בבקשה זו טרם ניתנה החלטה לגופה, אך מועדי הישיבות בוטלו כולם.

המדינה טוענת בבקשתה כי מצבו הרפואי של המשיב נמצא במגמה של שיקום ושיפור ולא ניתן לחזות בשלב זה מתי בדיוק מבחינה פיזיולוגית וקוגניטיבית הוא ישוב ויהווה סיכון לסובבים אותו. היא עומדת על כך שמסוכנותו של המשיב נלמדת מעצם העבירה המיוחסת לו ומתעצמת נוכח הנסיבות האכזריות של ביצועה, המלמדות כי מדובר באדם בלתי צפוי, נטול מעצורים וחסר עכבות. המדינה מפנה לתסקיר שירות המבחן בעניינו של המשיב שהוכן בחודש אוגוסט 2006, עוד בטרם נפל למשכב ואשר בו, חרף ההערכה לחלופה המוצעת אצל קרובי משפחה של המשיב, לא המליץ שירות המבחן על שחרור לחלופה זו בשל הערכתו כי המשיב יתקשה לעמוד בסייגים הנדרשים בחלופת מעצר. בתסקיר צוין עוד כי בהתנהגותו הרגשית של המשיב רב הנסתר על הגלוי והיא מעוררת אי אמון מסוים וכן הובעה התרשמות מרמה מסוימת של מניפולטיביות בהתנהגותו ובהתנהלותו. שירות המבחן אף סבר כי קיימת אפשרות להשפעה על עדים או שיבוש ראיות וציין כי קיים ספק אם תינקט על ידו אלימות חוזרת. המדינה מוסיפה כי העונש הכבד הצפוי למשיב אם יורשע מקים חשש מובנה להימלטותו מן הדין, ואם מצבו הרפואי ישתפר, הרי שהימצאותו במוסד רפואי שאינו סגור וללא השגחה, מגבירה את סכנת הימלטותו. לדבריה, מכיוון שהמשיב מצוי במוסד רפואי ההולם את כל צרכיו, הרי שאין הפגיעה בחירותו כתוצאה מן ההשגחה עליו גדולה ביותר.
בדיון בפניי הוסיפה באת כוח המדינה והדגישה את מורכבות המצב. היא סבורה כי כל עוד לא נקבע כי המשיב אינו כשיר לעמוד לדין, יש להורות על מעצרו. היא מבהירה כי יש צורך בהמשך השמירה על המשיב כיוון שזהו המענה היחיד הקיים במצב בו אין זה ברור מתי ישתנה מצבו של המשיב.

הסנגור סבור כי במצב בו מתבקשת הארכת מעצר רביעית, כאשר כל הדיונים בתיק בוטלו נוכח מצבו של המשיב ומשפטו אינו מתקדם, אין מקום להארכת המעצר. הוא עומד על מצבו הקשה של מרשו וטוען כי אינו מבחין בין טוב לרע, אינו מדבר ונזקק לסיוע נשימתי. במצב זה, הוא סבור, אין המשיב מהווה סכנה לציבור.

ראשית אבקש להתייחס למצבו של המשיב. מסיכום ביניים של המרכז לשיקום שצורף לבקשת המדינה עולה כי קיים פער בין התמונה שמצייר הסנגור לבין מצבו של המשיב. מסיכום זה עולה כי מצבו של המשיב
מצוי במגמת שיפור. בין היתר הוא מצליח לעלות ולרדת במדרגות אם מושטת לו עזרה קלה ובתמיכת מעקה, מצליח ללכת בהשגחה צמודה למרחק של כ- 200 מטרים , קם מישיבה לעמידה בהשגחה ואינו נזקק עוד לטיפול נשימתי. יחד עם זאת אין ספק כי עדיין נותרה כברת דרך שעליו לעבור בטרם יחלים – בתחום הקוגניטיבי והפיסיולוגי גם יחד.
דומני כי אין מקום לספק כי אלמלא מצבו הפיסיולוגי והקוגניטיבי של המשיב לא היה מקום לשקול שחרור לחלופת מעצר וזאת בשים לב למסוכנותו הגבוהה של המשיב הנובעת מחומרת העבירה המיוחסת לו והאכזריות בה בוצע הרצח ונוכח תסקיר שירות המבחן והעובדה שמשפטו מתקדם. לכך יש להוסיף את החשש מפני הימלטות שאינו נראה במקרה מעין זה מבוטל.
יחד עם זאת, במצב הנוכחי – נוכח מצבו של המשיב והעובדה כי בפועל משפטו "מוקפא" לאחר שבוטלו כל הדיונים בתיק - נראה כי יש לשקול את אפשרות השחרור לחלופת מעצר בפיקוח ותוך קביעת תנאים מגבילים מתאימים. מטרידה היא העובדה שאין זה ידוע מתי ישובו למשיב יכולותיו הפיזיולוגיות והקוגניטיביות שיאפשרו לו לתפקד באופן עצמאי, שאז תשוב על כנה מסוכנותו. לפיכך אני סבורה כי יש להביא את עניינו של המשיב בפני בית המשפט המחוזי שיבחן, לאחר שיוגש לו תסקיר שירות המבחן, את האפשרות לשחרר את המשיב לחלופת מעצר. ככל שיסבור בית המשפט המחוזי כי אכן יש להורות על שחרור לחלופת מעצר, אני סבורה כי יש לעשות כן תוך קביעת הסדרי פיקוח מתאימים, קביעת ערבונות כספיים משמעותיים והוצאת צו איסור יציאה מן הארץ נגד המשיב.
עוד אוסיף, ערה אני לכך שלאחר ששוחרר אדם ממעצרו קשה יותר היא ההחלטה על השבתו אל מאחורי סורג ובריח (וראו ההתייחסות לעניין זה בבש"פ 8029/06 בו נדונה בקשה להארכת מעצר של המשיב שבפניי). יחד עם זאת, איני סבורה כי די בטעם זה כדי להביא להארכת המעצר פעם נוספת, במצבו הנוכחי של המשיב. מכל מקום ברי כי ככל שמצבו של המשיב ישתפר במידה כזו שמסוכנותו שוב תהא ממשית, ניתן יהא לראות בכך משום נסיבות חדשות המחייבות החזרתו למעצר.

אני מאריכה אפוא את מעצרו של המשיב מיום 20.2.07 בתשעים ימים או עד למתן פסק הדין בת"פ 4160/05 בבית המשפט המחוזי בחיפה, לפי המוקדם. יחד עם זאת, אם ימצא בית המשפט המחוזי, לאחר שיוגש לו תסקיר שירות המבחן, כי קיימת חלופת מעצר ראויה והולמת, ישוחרר המשיב ממעצר תוך קביעת תנאי השחרור כמפורט לעיל.
