החלטה
בקשה שניה להארכת מעצרו של המשיב בתשעים ימים לפי סעיף 62 ל חוק סדר דין פלילי (סמכויות אכיפה – מעצרים) , התשנ"ו- 1996 (להלן: חוק המעצרים ).

ביום 14.3.10 הוגש לבית המשפט המחוזי בבאר שבע כתב אישום נגד המשיב
המייחס לו עבירות של סיכון חיי אדם בנתיב תחבורה לפי סעיף 332(2) לחוק העונשין, תשל"ז-1977 (להלן: החוק ) ; חבלה בכוונה מחמירה לפי סעיף 329(א)(2) לחוק; הפרעה לשוטר במילוי תפקידו לפי סעיף 275 לחוק; ונהיגה ללא רשיון נהיגה לפי סעיפים 10 ו-62 לפקודת התעבורה, התשכ"א-1961.

העובדות הצריכות לעניין פורטו בהחלטתו של כב' השופט פוגלמן שדן בערר על ההחלטה לעצור את המשיב עד תום ההליכים (בש"פ 2954/10) ואחזור על הדברים בתמצית. כנטען בכתב האישום, ביום 11.3.10 נהג המשיב ברכב בעיר ערד, מבלי שקיים ברשותו רישיון נהיגה תקף. לאחר ששוטרים הורו למשיב לעצור את רכבו, הוא האיץ את מהירות נסיעתו וחלף על פניהם. קצין משטרה החל לדלוק בעקבותיו, תוך שהוא מפעיל סירנה ואורות כחולים, וכורז למשיב שיעצור. המשיב המשיך לנסוע במהירות, תוך שהוא גורם לרכבים הנוסעים בסביבתו לבלום בפתאומיות ולהולכת רגל לברוח חזרה למדרכה. התייצבותה של ניידת המשטרה נגד כיוון התנועה מול רכבו של המשיב לא הביאה אף היא לעצירתו, והלה פנה שמאלה, עלה על אי תנועה של כיכר ועקף את הניידת במהירות גבוהה. רק לאחר שהמשיב נכנס לרחוב ללא מוצא הוא נאלץ לעצור את רכבו.

בד בבד עם הגשת כתב האישום הוגשה בקשה למעצרו של המשיב עד תום ההליכים. העורר לא חלק על
קיומן של ראיות לכאורה ועילת מעצר, אך עתר לשחרורו לחלופת מעצר, בקשה שנדחתה על ידי בית משפט קמא, וערר על ההחלטה נדחה אף הוא (בש"פ 2954/10 הנ"ל).

משחלפו תשעה חודשים ומשפטו של המשיב טרם הסתיים, הוארך מעצרו של המשיב בתשעים ימים בהסכמתו (בש"פ 8839/10). כעת, מוגשת הבקשה שבפניי להאריך את מעצרו של המשיב בתשעים ימים נוספים או עד למתן פסק דין במשפטו.
לטענת המבקשת, הימשכות ההליכים בעניינו של המשיב נובעת מבקשות דחיה מטעם המשיב לשם מיצוי המשא ומתן והסדרת ייצוגו, כמו גם בשל שביתת הפרקליטים. לטענת המבקשת, המשיב מהווה סכנה מוחשית לציבור, סכנה הנלמדת מהמעשים המיוחסים לו בכתב האישום ואשר מתחדדת נוכח עברו הפלילי המכביד.
המשיב הצביע על כך שאין לזקוף לחובתו את התמשכות ההליכים ובהקשר זה הצביע על כך שהיה נכון בכל עת להליכי גישור; כי עתר לצרף תיק זה לתיק אחר שנדון בבית המשפט המחוזי בתל-אביב ואשר בגינו הושת עליו עונש מאסר של 24 חודשים; וכי מועד ההוכחות שנקבע בתיק בוטל שלא בעטיו אלא בשל שביתת הפרקליטים.

דין הבקשה להתקבל.
בכל הליך הארכת מעצר לפי סעיף 62 לחוק המעצרים, על בית המשפט לאזן
בין חזקת החפות של הנאשם וזכותו לחירות לבין האינטרס להבטיח את שלום הציבור ולהבטיח את ניהולו התקין של ההליך. במסגרת זו, לצד בחינת קצב התקדמות המשפט, על בית המשפט לבחון אם חלוף הזמן איין או הקהה את מסוכנותו של הנאשם (ראו, לדוגמה, בש"פ 8265/09 מדינת ישראל נ' אלמליח (לא פורסם, 28.10.09)).
אני נכון לזקוף לזכותו של המשיב את רצונו הכן לקדם את ההליך, ויש להצר על כך שמועד ההוכחות שנקבע בשעתו בוטל בשל שביתת הפרקליטים. יש לשקול זאת לזכותו של המשיב, אך לא בגדר שיקול מכריע המאיין את השיקולים האחרים (לשביתת הפרקליטים כחלק ממכלול הנתונים הצריכים לעניין השוו להחלטות כב' השופט פוגלמן בבש"פ 288/11 פלוני נ' מדינת ישראל (לא פורסם, 18.1.2011), פסקאות 7-8; בש"פ 301/11 מדינת ישראל נ' כנפו (לא פורסם, 18.1.2011)).

במקרה דנן, מסוכנתו של המשיב עולה מעצמה נוכח התנהגותו במהלך האירוע מושא כתב האישום. התופעה של בריחה ומרדף בכלל, ובכבישי הדרום בפרט, מהווה סיכון של ממש לשלום הציבור, כפי שבא לידי ביטוי בהעלאת רף הענישה לגבי עבירות אלה. עוד נזכיר כי הנהיגה הפרועה של המשיב נעשתה מבלי שהיה בידו רישיון נהיגה תקף. לכך יש להוסיף את עברו הפלילי המכביד של העורר (הכולל הרשעות בעבירות של קשר לפשע, סיוע לאויב במלחמה, איסוף ידיעות סודיות והחזקתן, הסעת תושב זר השוהה שלא כדין, נסיון הצתה, התחזות לאדם אחר במטרה להונות, נהיגה בזמן פסילה, נהיגה ללא רשיון נהיגה והפרעה לשוטר במילוי תפקידו). ואם לא די בכל אלה, הרי שביום 28.12.10 נגזר דינו של המשיב בשל עבירות של קשירת קשר לביצוע פשע וחבלה חמורה בנסיבות מחמירות, והושת עליו עונש מוסכם של 24 חודשי מאסר בפועל בניכוי ימי מעצרו. המשיב טען כי נוכח התקופה הארוכה בה ישב במעצר הוא אמור בקרוב לגשת לועדת השליש, וכי יש להניח שהועדה תנכה מעונשו. גם בהנחה שכך יהיה, ההרשעה הנוספת שאך זה מקרוב באה, מתווספת לעברו הפלילי המכביד של המשיב ומהווה חיזוק למסוכנותו.
לא נעלם מעיני כי שמיעת הראיות נקבעה ליום 17.5.2011 לשמיעת עדי התביעה בלבד, ויש להניח שמשפטו של המשיב לא יסתיים תוך שלושת החודשים הקרובים. דיה לצרה בשעתה, ומכל מקום, אם וככל שהמשיב לא יזכה לניכוי שליש מהמאסר שהושת עליו ביום 28.12.2010, הרי שבעוד שלושה חודשים ממילא ימשיך לשהות במאסר וגם עובדה זו מהווה שיקול רלוונטי.

סופו של דבר שאני נעתר לבקשה ומאריך מעצרו של המשיב בתשעים ימים החל מיום 14.3.11 או עד למתן פסק דין ב ת.פ . 24014-03-10 בבית המשפט המחוזי בבאר שבע , לפי המוקדם מביניהם.
