החלטה
בקשה שלישית להארכת מעצר של המשיב בארבעים וחמישה יום, לפי סעיף 62 לחוק סדר דין פלילי (סמכויות אכיפה – מעצרים), התשנ"ו-1996 (להלן: חוק המעצרים ) בצירוף סעיף 10יג לחוק הנוער (שפיטה ענישה ודרכי טפול) התשל"א-1971.

העובדות הצריכות לעניין פורטו בהחלטתה של כב' השופטת ארבל בבש"פ 8770/11 מיום 4.12.2011 ולכן איני רואה להאריך בסקירת העובדות והקורא מופנה להחלטה זו. בקליפת אגוז, כנגד המשיב ואחרים (שעניינם נדון בנפרד בבש"פ 270/12) הוגש כתב אישום המייחס למשיב יידוי של אבנים ובקבוקי תבערה לעבר בתי יהודים וכלי רכב של כוחות הבטחון בכפר סילואן. במהלך האירועים יידה המשיב בקבוק תבערה לכיוון עובר אורח וגרם לפציעתו ולכוויות בפניו. יודגש, כי המשיב ביצע מעשים אלו תוך הפרת תנאי שחרור שנקבעו לו ביום 31.10.2010 ב בית משפט השלום בירושלים בתיק אחר, ואשר כללו מעצר בית מלא.

אומר בקצרה כי לאור מסוכנותו של המשיב, כפי שנלמדת מנסיבות ביצוע העבירות ומהעובדה שהמעשים בוצעו עת היה נתון במעצר בית, ובהתחשב בכך שהמשפט מתנהל בקצב משביע רצון והגיע כעת ליישורת האחרונה (נקבעו מספר
מועדים קרובים לסיכומים בעל פה:29.12.2011 - 23.1.2012 – 30.1.2012), איני סבור כי יש בחלוף הזמן כדי להצדיק שחרורו של המשיב לחלופת מעצר.

אשר על כן, אני מורה על הארכת מעצרו של המשיב בארבעים וחמישה ימים נוספים, החל מיום החל מיום 14.1.12 או עד למתן פסק דין ב ת.פ . 28097-04-11 ב בית המשפט המחוזי בירושלים (כב' השופט י' נועם ) לפי המוקדם.
