לפניי בקשה להארכת מועד להגשת ערעור פסלות.

המבקש הועמד לדין בבית המשפט לתעבורה בתל-אביב בגין עבירה של נהיגה בשכרות. המבקש הורשע בדין ביום 10.6.2008 לאחר שלא התייצב לדיון. בית המשפט המחוזי קיבל את ערעורו של המבקש וקבע כי בנסיבות העניין יש לאפשר למבקש את יומו בבית המשפט. עם ביטול ההרשעה הוחזר עניינו של המבקש אל כב' השופטת נ' פראג-לבוא בבית המשפט לתעבורה. המבקש ביקש את פסילתה של השופטת מלישב בדין, בטענה כי בזמנו סרבה השופטת לבטל את פסק הדין שניתן במעמד צד אחד, קביעה שנהפכה בערכאת הערעור. בקשת הפסלות נדחתה ביום 24.3.2009 במעמד הצדדים. לאחר הקראת ההחלטה הודיע המבקש כי בכוונתו להגיש ערעור לבית המשפט העליון. ביום 7.4.2009 הגיש המבקש בקשה להארכת מועד, היא הבקשה שלפניי. נטען בה כי בשל שגגה שנפלה במשרדו של בא-כוח המבקש הוגש הערעור באיחור של יום אחד.

לאחר שעיון בבקשה ובחומר המצוי בתיק באתי לכלל מסקנה כי דין הבקשה להידחות. סעיף 147(ב) לחוק סדר הדין הפלילי [נוסח משולב], התשמ"ב-1982, קובע כי ערעור על החלטה בעניין פסלות יוגש תוך חמישה ימים מהיום שהודעה לבעל הדין החלטת השופט. מכאן שהיה על המבקש להגיש את הודעת הערעור עד ליום 29.3.2009. המבקש איחר איפוא בתשעה ימים בהגשת ההליך. בשים לב לכך שמדובר בערעור פסלות, זהו פרק זמן משמעותי. שכן, על ערעור פסלות להתברר, ככלל, במהירות האפשרית, הן כדי להסיר כל צל ועננה הקשורים בטענת הפסלות, והן כדי למנוע שיבוש אפשרי של הדיון בערכאה הדיונית (ראו, יגאל מרזל , דיני פסלות שופט 332 (התשס"ו-2006)). מטעם זה, יש לנקוט משנה זהירות ואף צמצום מסוים בהיעתרות לבקשות להארכת מועד המוגשות במסגרת ערעור פסלות (השוו, בש"א רוה נ' בנק הפועלים בע"מ (לא פורסם, 11.6.2008)). אמנם, מ דובר בערעור פסלות במסגרת הליך פלילי, כך שלא נדרש "טעם מיוחד" להארכת מועד, אך גם בהליך הפלילי הכלל הוא שיש לקיים את המועדים הקבועים בחוק, בעוד שהארכת מועד הינה היוצא מן הכלל. הארכת מועד תינתן רק בהתקיים טעם ממשי המניח את הדעת (ראו, בש"פ 5988/06 נגר נ' מדינת ישראל (לא פורסם, 25.7.2006)).

הטעם לאיחור עליו מבוססת הבקשה דנן הוא טעות מצד המבקש באשר למניין הימים. לא שוכנעתי כי בנסיבות העניין, טעות זו מקימה טעם ממשי המניח את הדעת לאיחור של תשעה ימים. הבקשה, המנוסחת בצורה תמציתית וכללית מאוד, אינה מסבירה מהו היסוד לסברה המוטעית של המבקש לגבי מניין הימים. יתרה מכך, וזה העיקר בעיני, מעיון בכתב הערעור ובהחלטת בית המשפט דלמטה נראה כי, על פני הדברים, סיכוייו של ערעור הפסלות להתקבל הינם קלושים. המבקש אינו מצביע בבקשתו על קיומה של עילת פסלות. טענות המערער בעניין פסלות המותב נסובות בעיקרו של דבר על החלטות שיפוטיות קודמות שהתקבלו בעניינו. ספק רב אם יש בהן ביסוס לטענה בדבר חשש ממשי אובייקטיבי למשוא פנים (ראו, סעיף 77א לחוק בתי המשפט [נוסח משולב], התשמ"ד - 1984). כידוע, הביקורת מצד בעל דין שאינו שבע רצון מהחלטות בית המשפט צריכה להתייחס לגופן של ההחלטות ולא לגופו של היושב בדין. במצב דברים זה, לא שוכנעתי כי קיימת הצדקה להארכת המועד להגשת ערעור פסלות.
הבקשה נדחית.
