זהו ערר על החלטתו של בית המשפט המחוזי במחוז מרכז (כבוד השופטת ז' בוסתן), אשר בה נדחה עררו של העורר על החלטת בית משפט השלום בפתח תקווה. העורר הורשע בעבירות של תקיפה הגורמת חבלה של ממש (לפי סעיף 380 לחוק העונשין, התשל"ז-1977 (להלן: החוק )), איומים (לפי סעיף 192 לחוק) ומעשה מגונה (לפי סעיף 348 לחוק). הוא נידון לריצוי מאסר בפועל למשך 20 חודשים, מאסר על תנאי וחוייב בתשלום פיצוי למתלוננת; כמו כן הופעל נגדו מאסר מותנה שהוטל עליו בגין עבירה קודמת. העורר ריצה את עונשו ולאחר שחרורו הטיל עליו בית משפט השלום, לבקשת המשיבה, מגבלות שונות לפי חוק ההגנה על הציבור מפני עברייני מין, התשס"ו-2006 (להלן: חוק ההגנה ), ובהן איסור לצרוך משקאות משכרים למשך תקופה של 4 שנים.

על החלטה זו ערר העורר לבית משפט המחוזי וזה, כאמור, דחה את עררו. בית המשפט המחוזי קבע שהאיסור על צריכת משקאות משכרים הוא מידתי, אף שהוא איסור מוחלט ואינו מוגבל לצריכה שהיא "מעבר לכמות המותרת על פי פקודת התעבורה". זאת משום שהעורר ביצע את העבירות שבגינן הורשע בעת שהיה בגילופין, תוך שהיה בהליך גמילה שכשל, ובעוד מאסר מותנה תלוי ועומד נגדו. בית המשפט המחוזי הוסיף כי מעובדות כתב האישום, כמו גם מדו"ח הערכת מסוכנות שנערכה לעורר, עולה כי העורר מתקשה לשלוט על התנהגותו ועל דחפיו המיניים והתוקפניים, כי צריכת אלכוהול משמשת אותו להסרת עכבות, כי הוא אינו שוקל כל היזקקות לטיפול וכי הוא נעדר מסגרת חברתית או תעסוקתית.

העורר טוען כי צריכת אלכוהול אינה מהווה עוד גורם מסיר עכבות עבורו, ותומך טענתו בכך שבמהלך תקופת המשפט, שארכה כ-6 שנים ובמהלכה היה משוחרר, לא ביצע עבירות נוספות על אף שלא נאסר עליו לצרוך אלכוהול. העורר טוען גם כי האיסור הגורף על צריכת משקאות משכרים נוגד את הדרישה, לפי סעיף 13(ג) לחוק ההגנה, לנקוט באמצעי שפגיעתו בעבריין היא פחותה, מקום בו הדבר אפשרי מבלי לפגוע במטרת הפיקוח והמעקב. זאת הן לעניין משך האיסור והן לעניין היותו גורף, ולא מוגבל "לצריכה שהיא מעבר לכמות המותרת על פי פקודת התעבורה". העורר טוען עוד כי הערכת מסוכנות אינה כלי מדויק, ועל כן יש לנהוג בה ביתר זהירות.

אין ממש בערר. העורר והמתלוננת שהו יחד בבית קפה, ולאחר זמן מה עזבו את המקום והמתלוננת הסיעה את העורר ברכבה. העורר המציע למתלוננת לעלות לדירתו, ומשסירבה אחז בבגדיה ומשך אותה בחוזקה. המתלוננת החלה לנסוע לכיוון תחנת המשטרה, וכאשר התקרבו לתחנה ביקש העורר מהמתלוננת כי תעצור את רכבה ותאפשר לו לרדת. לאחר שהמתלוננת עצרה דרש ממנה העורר כי תנשקו וכאשר סירבה חתך אותה בזרועותיה באמצעות מכשיר חד. המתלוננת החלה שוב בנסיעתה לכיוון תחנת המשטרה אך מצאה את שער הכניסה סגור. המתלוננת ניסתה לעורר תשומת לב על-ידי הבהוב באורות הרכב. אז איים העורר על המתלוננת כי יהרוג אותה, חשף בפניה את איבר מינו, ולקח את מפתחות הרכב. המתלוננת נמלטה מן הרכב והעורר החל לרדוף אחריה. לבסוף הצליחה המתלוננת לעצור רכב אחר שהסיעה מן המקום. העורר ביצע מעשים אלה בהיותו בגילופין, ובהיותו במהלך הליך גמילה מאלכוהול.
המעשים החמורים בהם הורשע העורר, בצירוף דו"ח הערכת מסוכנות שהוכן בעניינו, מעידים כי מידת מסוכנותו גבוהה. צריכת אלכוהול מוסיפה עוד למסוכנות זו, בהיותה גורם מסיר עכבות עבור העורר. אמנם העורר מציין כי מאז שחרורו נמנע מצריכת אלכוהול, אולם הוא שולל כל היזקקות לטיפול גמילה כלשהו. לדברים אלה אין לייחס משקל של ממש. העורר נעצר בעת שהיה מצוי בעיצומו של טיפול גמילה ושעה שהיה תלוי ועומד נגדו עונש של מאסר מותנה והדבר לא מנע ממנו להיות תחת השפעה של אלכוהול. במצב דברים זה, קיים חשש ממשי כי גם צריכת כמות מועטה של אלכוהול תוביל את העורר חזרה אל הרגליו הישנים, של צריכת אלכוהול בכמויות גדולות באופן יומיומי. הבחירה במתן היתר לשתיה של אלכוהול בכמות מוגבלת היא בחירה שאינה מציאותית מקום בו מ דובר במי שנותן עינו בכוס. המעבר משתייה מוגבלת לאבדן העשתונות הוא מעבר צפוי במקרהו של העורר.
הצעת העורר להתיר לו לצרוך אלכוהול בכמות המותרת על פי פקודת התעבורה אינה מעשית בנסיבות שבהן יש אינדיקציות משמעותיות לקיומה של התמכרות לאלכוהול, וזאת בשל היעדר אפשרות מעשית לפקח, באמצעות מדידה, על כמות האלכוהול שהעורר יצרוך. מקום בו נקבע, כי על-מנת להפחית את מסוכנותו של עבריין מין מסוים, ישנו צורך עקרוני בהגבלה על צריכת אלכוהול, הרי שיש לשקול בזהירות רבה את האפשרות להתיר לו לצרוך אלכוהול אף בכמות קטנה, "שאינה עולה על הכמות המותרת לפי פקודת התעבורה". משאין איסור מוחלט על צריכת אלכוהול, נדרש אמון רב בעבריין המין ובטחון ממשי כי יעמוד במגבלת הכמות שהוטלה עליו, על-מנת להתיר את חרצובות האסור שהרי היכולת לפקח באופן חיצוני על עמידתו במגבלה היא מצומצמת ביותר. לאור הנסיבות שפורטו, צדק בית-המשפט המחוזי כאשר נמנע מלהתיר לעורר לשתות "כמויות מוגבלות" של אלכוהול.
על-כן, נדחה הערר.
