החלטה
בפניי ערר על החלטת בית המשפט המחוזי בחיפה (כבוד השופטת ת' שרון-נתנאל ) בתיק ב"ש 3289/08 מיום 25.8.2008, לפיה דחה בית המשפט את בקשת העוררים לקבל לידם את כל הקלטת שצולמה על ידי כוחות צה"ל בעת האירועים נשוא כתב האישום.
כנגד העוררים הוגש לבית המשפט המחוזי בחיפה כתב אישום, המייחס להם עבירה של החזקת סם מסוכן שלא כדין ושלא לצריכה עצמית, לפי סעיף 7(א) ו-(ג) לפקודת הסמים המסוכנים [נוסח חדש], תשל"ג-1973.
לפי הנטען בכתב האישום, ביום 25.3.2008 סמוך לשעה 6:00 בבוקר, הגיעו העוררים מספר מטרים מגדר הגבול עם לבנון ולקחו מהמקום שני תיקי גב אשר בהם אריזות שהכילו סם מסוכן מסוג הרואין בכמות כוללת של 30 ק"ג ו- 55.03 גרם . בשעה 6:40 נעצרו העוררים סמוך לגדר הגבול כאשר על גבם התיקים.
ביום 17.6.08 הוציא שר הביטחון, מתוקף סמכותו לפי סעיף 44 לפקודת הראיות [נוסח חדש], התשל"א-1971 (להלן: פקודת הראיות), תעודה בדבר ראיות חסויות (להלן: תעודת החיסיון) מטעמי ביטחון המדינה לחלק מהראיות בתיק.
בתוך חומר החקירה שקיבלו לידיהם העוררים נמצאה קלטת וידאו אשר חלקים ממנה נמחקו. לאחר שפנו למשיבה בבקשה לקבל את שאר חלקי הקלטת ונענו בשלילה, הגישו העוררים לבית המשפט המחוזי בקשה לגילוי ראיות בהתאם לסעיף 74 לחוק סדר הדין הפלילי [נוסח משולב], התשמ"ב-1982 (להלן: חוק סדר הדין הפלילי). לדידם, הקלטת, או חלקים ממנה, אינה חוסה תחת תעודת החיסיון כיוון שאין היא מוזכרת בה. לפיכך המשיבה מחויבת למסור להם את הקלטת במלואה, לפי סעיף 74 לחוק סדר הדין הפלילי. לטענת המשיבה, חלקים אלו חוסים תחת תעודת החיסיון שהוציא שר הביטחון.
ביום 25.8.2008 קבע בית המשפט המחוזי שהקלטת חוסה תחת תעודת החיסיון שהוציא שר הביטחון. בית המשפט קבע שהפירוט המצוי בתעודת החיסיון מספק וכולל בחובו את הקלטת אשר חלקים ממנה נמחקו. לפיכך אין לומר שהמשיבה לא עמדה בחובתה לפי סעיף 74 לחוק סדר הדין הפלילי להמציא לעוררים את כל חומר החקירה.
מכאן הערר שבפניי.
בדיון לפני חזרו הצדדים על טענותיהם בבית המשפט המחוזי. לטענת העוררים, טעה בית המשפט קמא כאשר קבע כי תעודת החיסיון חלה על קטעי הוידאו אשר נמחקו מהקלטת שניתנה להם, זאת לאור העובדה שאין תעודת החיסיון מציינת במפורש את הקלטת. מכאן שיש לאפשר להם לעיין בקלטת הוידאו במלואה, בהתאם לסעיף 74 לחוק סדר הדין הפלילי.
מנגד, סומכת באת כוח המשיבה את ידיה על החלטת בית המשפט המחוזי.
לאחר ששמעתי את טיעוני הצדדים ולאחר שעיינתי בהודעת הערר ובהחלטתו של בית המשפט המחוזי, הגעתי לכלל מסקנה, כי דין הערר להדחות.
על תעודת חיסיון להיות מפורטת דיה, בכדי לאפשר לנאשם לעמוד על טיב הראיה החסויה ובכדי שיוכל להתגונן מפניה בהתאם. עם זאת, כפי שציין בצדק בית המשפט המחוזי, בבוא בית המשפט לבחון את הפירוט שבתעודת החיסיון עליו לשקול את האינטרס הציבורי שעומד מנגד, במקרה זה ביטחון המדינה ושלום הציבור. אין לצפות שתעודת החיסיון תציין במדויק כל פרט ופרט מחומר הראיות כאשר ייתכן שבעצם כך תחשוף את פרטי הראיות אשר החיסיון בא למנוע את חשיפתן מלכתחילה. במקרה זה, רשימת הנושאים בתעודת החסיון אשר הוציא שר הביטחון מפורטת דיה בכדי לאפשר לעוררים לעמוד על טיבן של הראיות החסויות בהליך המתנהל נגדם. תעודת החיסיון שהוציא שר הביטחון מתייחסת בין היתר לראיות בנושאי "שיטות סריקה ודרכי פעולה של תצפיות צה"ל". לכן, אף שקלטת הוידאו אינה מצוינת בשמה בתעודת החיסיון, ברי שקלטת אשר צולמה על ידי תצפית של צה"ל בגבול לבנון נופלת תחת העניינים המנויים בתעודת החיסיון וחוסים בצלה. מכאן שתעודת החסיון חלה על חלקי הקלטת אשר לא הוצגו לעוררים.
סעיף 78 לחוק סדר הדין הפלילי קובע כי " הוראות סעיף 74 אינן חלות על חומר שאי-גילויו מותר או שגילויו אסור לפי כל דין ". משמע, שחומר החוסה תחת תעודת חיסיון שהוציא שר המוסמך לכך אינו בא בגדר חומר החקירה שהנאשם רשאי לעיין בו. לפיכך, אין לעוררים זכות לעיין בחלקי הקלטת אשר חוסים תחת תעודת החיסיון שהוציא שר הביטחון בבקשה לעיון בחומר החקירה לפי סעיף 74(ב) לחוק סדר הדין הפלילי. לעומת זאת, לרשות העוררים עומדת הזכות לעתור לבית משפט זה בבקשה לגילוי ראייה חסויה לפי סעיף 46 לפקודת הראיות, שהוא ההליך הרלוונטי לגופו של עניין. דאז יוכלו העוררים להביא את תעודת החיסיון, ואת הקטעים שנמחקו מהקלטת לעינו הבוחנת של בית המשפט, אשר יבחן אם יש לגלותה ולהסיר ממנה את החיסיון.
יתרה מזו, טוענים באי כוח העוררים שאם תחול תעודת החיסיון בנוסחה הכוללני לכאורה על הקלטת, אף שלא צוינה בה במפורש, יש בכך בכדי לאפשר למשיבה להעלים ראיות מהם.
במקרה שלפניי דבר קיומה של הקלטת לא הוסתר מידי העוררים וזאת צוינה בברור ברשימת חומר החקירה הזמינה לעוררים. לכן, בניגוד לטענת העוררים, היותה של הקלטת חוסה תחת תעודת החיסיון איננה נותנת בידי המשיבה כוח להסתיר את עצם קיומן של ראיות מפניהם. ככל שהעוררים מודעים לקיומן של חלקים אשר נמחקו מהקלטת, פתוחה בפניהם הדרך לדרוש מבית משפט זה את גילוי הקלטת בהליך שקבע המחוקק בסעיף 46 לפקודת הראיות בכדי לשמור על זכויותיהם. על כן, בנסיבות המקרה שבפניי, לא סברתי כי שגה בית המשפט קמא בכך שלא אפשר לעוררים לעיין בחלקי הקלטת אשר לא נמסרו להם.
סוף דבר, החלטתו של בית המשפט המחוזי מנומקת ומבוססת היטב ולא מצאתי מקום להתערב בה.
אשר על כן, הערר נדחה.
