לפניי עתירה לקיום דיון נוסף בפסק דינו של בית המשפט העליון ( השופטים א' גרוניס , מ' נאור ו ע' ארבל ) בע"פ 11971/05 בסעוד נ' מדינת ישראל (טרם פורסם, 15.7.2009) (להלן: פסק הדין ), בו נדחה ערעורו של העותר על פסק-דינו של בית המשפט המחוזי בנצרת מיום 16.11.05 בת.פ. 1012/04 (השופטים א' אמינוף , נ' מוניץ ו ג' (דה ליאו) לוי ), בו הורשע העותר בעבירות של רצח, תקיפה ואיומים על שוטר.

בפסק-דינו של בית המשפט המחוזי מיום 16.11.05 הורשע העותר, לאחר ניהול הליך הוכחות, ברצח בכוונה תחילה בגין דקירתו למוות של אבי סלמי (להלן: המנוח ), במהלך קטטה בבר. לאחר שמיעת עדויותיהם של עדי הראיה ובחינת גרסתו של העותר קבע בית המשפט המחוזי, פה-אחד, כי העותר איים על המנוח זמן מה לפני אירוע הדקירה; כי הוא הצטייד לשם כך בסכין בעל להב של כ- 20 ס"מ אותו לקח קודם לכן ממטבח הבר; כי בעת ניסיונו של בעל המקום למנוע מהעותר להשלים את זממו, דקר העותר את בעל המקום ופצע אותו ולאחר מכן דקר את המנוח דקירה אחת שהביאה למותו; וכי למעשה זה לא קדמה התגרות מצדו של המנוח. על בסיס קביעות עובדתיות אלה הרשיע בית המשפט המחוזי את העותר כאמור לעיל.

על הכרעת דינו של בית המשפט המחוזי הגיש העותר ערעור לבית המשפט העליון. ערעורו הושתת על הטענה כי שגה בית המשפט המחוזי בקובעו כי התקיים היסוד הנפשי הדרוש לשם הרשעה בעבירת רצח בכוונה תחילה. בין היתר, טען המערער כי היה שיכור בעת האירוע; כי דקר את המנוח דקירה אחת בלבד, בבטנו; כי נטל את הסכין מהבר רק לאחר תחילת הקטטה עם המנוח; וכי לא היה לו מניע לרצוח את המנוח, אשר היה מכרו הוותיק. ביום 15.7.09 דחה בית המשפט העליון ( השופטים א' גרוניס , מ' נאור ו ע' ארבל ) את הערעור פה-אחד. בפסק-הדין נקבע כי טענותיו של העותר נשענות על ניסיון לערער ממצאים עובדתיים שנקבעו על-ידי בית המשפט המחוזי, ואשר ככלל ערכאת הערעור אינה נוהגת להתערב בהם. הודגש, כי מסקנותיו וממצאיו של בית המשפט המחוזי מבוססים ונכונים, ואינם מעוררים עילה כלשהי להתערבות ערכאת הערעור. נקבע, כי נסיבות האירוע מצביעות על רצונו של העותר לגרום לתוצאה הקטלנית ועל צפייתו את התוצאה. בית המשפט דחה את טענת העותר לפיה היה תחת השפעת חומר משכר, אשר שללה ממנו את יכולתו להבין את אשר עשה או להימנע מהמעשה, וקבע כי ממכלול העדויות והראיות עולה כי העותר הבין היטב את מעשיו, תכנן את ביצוע הדקירה והתכוון לגרום לתוצאתה הקטלנית – וכל זאת, מבלי שקדמה למעשה התגרות מצדו של המנוח, אשר עשויה הייתה לשלול את יסוד ה"כוונה תחילה" ממעשיו של העותר.

על פסק-דינו של בית המשפט העליון מיום 15.7.09 הוגשה העתירה שלפניי. בעתירה חזר העותר על הטענות אותן העלה בערעורו, אשר עיקרן כי לא נתקיימה בו "ההחלטה להמית" את המנוח, הדרושה לשם הרשעה בעבירה של רצח בכוונה תחילה. כך, למשל, נטען כי העותר דקר את המנוח דקירה אחת בלבד, בבטנו; כי היה שיכור בעת האירוע ולא שלט במעשיו; וכי בכיו לאחר האירוע, עת גילה את דבר מותו של המנוח, מעיד על אי רצונו במותו.

דין העתירה לדיון נוסף להידחות. כידוע, בהתאם לסעיף 30(ב) לחוק בתי המשפט [נוסח משולב], התשמ"ד-1984 (להלן: חוק בתי המשפט ), שמור הליך הדיון הנוסף למקרים חריגים ביותר ויוצאי-דופן בהם נפסקה הלכה משפטית חדשה, העומדת בסתירה להלכה קודמת, או שמפאת חשיבותה, קשיותה או חידושה ראוי כי בית המשפט ידון בה דיון נוסף. בית משפט זה פסק לא אחת כי דיון נוסף אינו ערעור נוסף בו שבים ובוחנים האם הרשעה או זיכוי היו מעוגנים כראוי בחומר הראיות או האם עקרונות הדין יושמו בצורה נכונה (ראו, למשל, דנ"פ 7238/06 ענקרי נ' מדינת ישראל (לא פורסם, 11.9.2006), דנ"פ 10402/07 מטיס נ' מדינת ישראל (לא פורסם, 29.1.2008)). בענייננו, כל טענותיו של העותר הן טענות ערעוריות במהותן, אשר הועלו על-ידו כבר בעת הדיון בערעורו ונבחנו על-ידי ערכאת הערעור. בפסק-הדין נשוא העתירה נדונו טענות אלו בפירוט ונדחו לאחר שלא נמצא כי יש בהן ממש. בפסק-הדין לא נקבעה כל הלכה חדשה, ובית המשפט אך יישם את ההלכה הקיימת על נסיבותיו של המקרה הנתון שבא לפניו. טענותיו של העותר לא הצדיקו את קבלת ערעורו על פסק-דינו של בית המשפט המחוזי, וודאי שאין בהן כדי להצדיק את קיומו של דיון נוסף.
אשר על כן, העתירה לדיון נוסף נדחית.
