החלטה
לפניי בקשה לפטור מתשלום אגרה ומהפקדת ערבון בהליך שבכותרת.

הערעור נסב על פסק דין של בית המשפט המחוזי בחיפה בתביעת נזיקין בגין רשלנות רפואית נטענת. בית המשפט המחוזי דחה את התביעה, בקובעו כי לא הוכחה הפרה של חובת הזהירות ולא הוכח קשר סיבתי בין מצבה של המערערת לבין הטיפולים שביצעו המשיבים. בבקשה לפניי טוענת המערערת כי מצבה הכלכלי קשה. לדבריה, היא מתפרנסת מקצבת נכות כללית מן המוסד ל ביטוח לאומי ומלבד קצבה דומה המשולמת לבעלה, אין לבני הזוג הכנסות נוספות. על פי הנטען, בשל המצב הרפואי של המערערת ובעלה הם נדרשים להוצאות גבוהות מאוד לטיפולים ולתרופות, דבר המקשה מאוד על המשפחה. המשיבים מתנגדים לבקשה.

על בעל דין המבקש פטור מאגרה ומהערבון מחמת עוניו לפרוש לפני בית המשפט תשתית עובדתית מלאה ועדכנית בדבר מצבו הכלכלי. המערערת לא עמדה בנטל זה. הבקשה חסרה התייחסות לרכושה של המערערת. לא ניתן בה פירוט של נכסיה, לרבות נכסי נדל"ן ונכסים פיננסיים, כגון פיקדונות וחסכונות. כמו כן, לא צורפו לבקשה דפי חשבון בנק מלאים לששת החודשים האחרונים. לעניין זה לא ניתן להסתפק בדף המפרט את יתרת הזכות הנוכחית בחשבון, מה גם שבמסמכי החשבון לא מופיע שמה של המערערת. בנוסף, הבקשה אינה מבהירה מדוע אין בידה של המערערת להסתייע בסביבתה הקרובה – ובילדיה הבגירים בפרט – לצורך גיוס כספי הערבון. במצב דברים זה לא ניתן להיעתר לבקשה, אף מבלי להידרש לשאלת סיכויי ההליך. בשים לב למהות ההליך, למצבה הבריאותי של המערערת ולמעמדם היחסי של הצדדים, יעמוד הערבון על סך של 5,000 ₪. האגרה תשולם והערבון יופקד תוך 21 ימים מעת המצאת החלטה זו, ולא – יימחק ההליך או יידחה, לפי העניין, ללא צורך בהודעה נוספת.
