צו סיכומי טענות
מכוח תקנה 448 של תקנות סדר הדין
האזרחי, התשמ"ד-1984, נקבע בזאת הסדר ביחס לדרכי שמיעת הערעור, כמפורט להלן:
סיכום טענות
1.
הצדדים יגישו את סיכומיהם על הפרשה כולה בכתב.
מתכונת הסיכומים
2.
היקף הסיכומים של המערער והמשיבים יוגבל ל-12 עמודים, וסיכומי
התשובה של המערער ל-2 עמודים. לעניין זה, "עמוד" הוא מסמך בגודל המכונה
A4
. הסיכומים יוגשו כך שיהיו
קריאים וברורים.
הרווח בין השורות בהדפסה לא יפחת מרווח כפול. האותיות יהיו
בגופן 12 והמרווח בין האותיות יהיה "רגיל
", תוך השארת שוליים
ברוחב של שני סנטימטרים לפחות מכל צד. מידות אלה מתייחסות לגופן

. אם בעלי הדין משתמשים
בגופן אחר עליהם להתאים את מידותיו לדרישות אלה.

תיק המוצגים יוגש במועד שנקבע להגשת סיכומים, בכריכה נפרדת
מכתב הסיכומים. כמו כן, יגישו הצדדים, במועד הגשת הסיכומים,
רשימת
אסמכתאות
שבדעתם להסתמך עליהם.
לא יוגש
כרך אסמכתאות שעניינו פסקי דין או החלטות
של בתי משפט בישראל ובלבד שאלו פורסמו במסגרת פרסום רשמי (פד"י) או שניתן לאתרם
במאגרי מידע מסחריים אחרים. אין באמור לעיל כדי למנוע הגשת אסמכתאות שאינן נכללות באמור
לעיל או הגשה במסגרת נספחים לכתבי בי דין של אסמכתא אחת או מספר מועט של אסמכתאות שבעל
הדין סבור שיש להן מרכזיות או חשיבות מיוחדת בהליך.

בהתאם להוראת תקנה 497ב לתקנות סדר הדין האזרחי,
התשמ"ד-1984, לא יוגשו סיכומי הטענות של הצדדים, לרבות סיכומי התשובה,
באמצעות הפקסימיליה.

המערער יגיש את סיכום טענותיו עד יום 25.11.2010.
6.
המשיבים יגישו את סיכום טענותיהם עד יום 27.1.2011.

טענותיהם בערעור שכנגד עד המועד הקבוע בסעיף 6. המשיבים רשאים להגיש את הסיכומים
בערעור ובערעור שכנגד כמסמך אחד, בהיקף של שני סיכומי טענות.

המערער, הוא המשיב שכנגד, יגיש את סיכום טענותיו בערעור שכנגד
עד יום 17.2.2011. המערער רשאי להגיש, בתוך אותה תקופה סיכומי תשובה בערעור, ורשאי
הוא להגיש את סיכומי התשובה בערעור יחד עם סיכום הטענות בערעור שכנגד במסמך אחד,
בהיקף של סיכום טענות וסיכום תשובה.

חיובי בעלי הדין לפעול על-פי החלטה
זו אינם מותלים זה בזה, ומחדל של בעל דין אינו פוטר את בעלי הדין האחרים מהגשת סיכומיהם במועד, אלא אם שינה בית המשפט את המועד שנקבע, על-פי בקשה שהוגשה.
המצאה

בעלי הדין ימציאו שלושה עותקים מסיכום טענותיהם לבית המשפט, וכן ימציאו עותק לכל יתר בעלי הדין, בד בבד עם ההמצאה לבית המשפט או קודם לכן. בעלי הדין יציינו את דבר ההמצאה, בסיכומיהם.

חפצו בעלי הדין או מי מהם לשנות הסדר זה, עליהם להגיש בקשה הכוללת את תגובות יתר בעלי הדין, או הסבר להעדר תגובות אלה. הבקשה תציין את המועדים המקוריים שנקבעו וכן תנקוב במועדים המוצעים על דרך של ציון המועד, ולא על דרך של קביעת תקופה.
עיקרי טיעון

נקבע בזאת, כי אין צורך בהגשת עיקרי טיעון לפי תקנה 446 לתקנות סדר הדין האזרחי, התשמ"ד-1984.
השלמת טיעון בעל פה

הצדדים ישלימו את סיכומיהם בכתב על ידי טיעון בעל פה ביום 4.4.2011 בשעה 09:00. משך הטיעון בעל פה ייקבע על ידי בית המשפט בעת הדיון, ועל הצדדים להיערך לטיעון על דרך ההשלמה בלבד.
הגשת הסיכומים בכתב תקדם לדיון בעל פה, וכל בקשה לשינוי במועדי הגשת הסיכומים בכתב, חייבת לציין את המועד שנקבע לשמיעת הטיעונים בעל פה.
