פסק-דין

בית המשפט המחוזי מרכז-לוד קיבל את תביעתה הכספית של המשיבה נגד המערער. מ דובר
בתביעה שהתבססה על כתב התחייבות לעניין הלוואה שניתנה על ידי המשיבה למערער בשנת 1991. סכום ההלוואה עמד על כ-2.9 מיליון ש"ח. המערער החזיר את קרן ההלוואה בתוספת כלשהי אך לא את הריבית על פי המוסכם, כך לטענת המשיבה. בית המשפט דחה את שתי טענותיו של המערער: האחת, כי מסמך ההתחייבות זוייף, והאחרת כי אין עליו לשלם ריבית נוכח דיני הריבית במשפט העברי והיתר עסקה.

עיינו בטענות בכתב ושמענו טיעונים בעל פה. דעתנו היא כי אין בסיס להתערב בקביעותיו של בית המשפט המחוזי, שכאמור דחה את שתי טענותיו של המערער. לעניין שתי הסוגיות שעמדו לדיון סמך בית המשפט על חוות דעת של מומחים. מכאן, שדין הערעור להידחות וכך אנו מורים. המערער יישא בשכר טרחה בסכום של 75,000 ש"ח.
