פסק-דין
בעלי הדין הסכימו, בעקבות המלצתנו, כי ההכרעה בערעור תהא על דרך הפשרה, בהתאם לסעיף 79א(א) לחוק בתי המשפט [נוסח משולב], התשמ"ד – 1984.
עיינו בחומר ושמענו טיעונים בעל-פה. בין היתר בחנו את חוות דעתו של השמאי ואת דבריו בחקירתו בבית המשפט.
הגענו לכלל מסקנה כי יש להעמיד את סכום הפיצוי לגבי כל דונם על סך של 11,000 דולר, נכון ליום 30.6.98. הסכום יומר לשקלים על פי השער היציג במועד הנזכר ויישא הפרשי הצמדה וריבית בהתאם לסעיף 8(א) לחוק לתיקון דיני הרכישה לצרכי ציבור, התשכ"ד-1984 עד לתשלום בפועל. מן הסכום שיחושב כאמור יש, כמובן, לנכות את הסכום ששילמה המשיבה על חשבון הפיצויים. פסק דין זה יבוא תחת פסקי הדין שניתנו על ידי בית המשפט המחוזי.
המשיבה תישא בשכר טרחת עורך דין בסך 20,000 ₪ בשתי הערכאות.
