בקשה לפטור מעירבון
החלטה
לפניי בקשה לפטור מהפקדת עירבון, להמרתו בערובה אחרת או להפחתתו. הבקשה הוגשה במסגרת ערעור על החלטה של בית המשפט המחוזי בחיפה (כבוד השופט מ' רניאל ), שבה נתקבלה בקשתה של המשיבה 1 – המנהלת המיוחדת לנכסיו של המשיב 2 – ובית המשפט הורה על ביטול הענקה (נכס מקרקעין) שהעניק החייב לבנו – הוא המערער.
המזכירה הראשית העמידה את העירבון בהליך זה על 20,000 ₪. מדובר בסכום סביר בנסיבות העניין. המערער מבקש להמיר את העירבון בערבות אישית וכן בערבות צד ג'. אומר מיד כי התחייבות עצמית כלל אינה נחשבת חלופת עירבון (ראו למשל בש"א 5385/09 עיריית חיפה נ' עמותת העדה היהודית הספרדית בחיפה (טרם פורסם, 16.7.2009)). אשר לערבות צד ג, זו אינה נחשבת בטוחה שוות-ערך לעירבון במזומן או בערבות בנקאית, מבחינת זמינות הבטוחה, הוודאות שבה והקלות במי מוש ה. לפיכך, יש לבחון את הבקשה להמרת העירבון בערבות צד ג' לפי אמות-המידה הנהוגות בבקשה לפטור מהפקדת עירבון, לאמור: האם הוכח שהמערער חסר יכולת כלכלית, והאם סיכויי ההליך גבוהים.
בענייננו, המערער טוען כי הוא "נגרר להליך דנא בעל כורחו", ספג הפסדים כלכליים, ועל כן חיובו בהפקדת עירבון בסכום גבוה אינו הוגן ומהווה "מעמסה קשה מנשוא על כתפיו". אולם פרט לטענה כללית זו, אין בבקשה שלפניי כל פירוט ותיעוד בעניין מצבו הכלכלי של המערער, ובעניין יכולתו להסתייע – אם יש צורך בכך – בסביבתו הקרובה. בהקשר זה, הכלל הוא כי "צד להליך אשר רוצה לחשוף את בעל הדין שכנגד לסיכונים בהליך ערעורי, עליו נטל ההוכחה לקיומם של תנאי הפטור מהפקדת העירבון. המבקש פטור מהפקדת עירבון צריך לפרוש בפני בית המשפט תשתית עובדתית מלאה ביותר ועדכנית בדבר מצבו הכלכלי ויכולתו לגייס את סכום העירבון" (דברי כבוד השופט ס' ג'ובראן בבש"א 4807/11 מזרחי נ' פקיד שומה פתח-תקוה (טרם פורסם, 29.6.2011)). המערער לא עמד בנטל זה ולוּ בקירוב; עוד ראוי להזכיר, כי אין די בכך שבעל-דין יטען שהפקדת עירבון בסכום הולם תכביד עליו, אלא עליו להציג תשתית ראייתית מלאה לכך שאין באפשרותו לגייס את סכום העירבון (ראו בש"א 4070/11 פלוני נ' מדינת ישראל (טרם פורסם, 30.5.2011)).
משלא הוכח כי אין באפשרותו של המערער להפקיד עירבון בסכום הולם – והסכום שנקבע (20,000 ₪) הוא כאמור סכום הולם – אין מקום למתן פטור מהפקדת עירבון, להמרתו בערובה פחותת-ערך, או להפחתתו. זאת מבלי צורך להביע עמדה בעניין סיכויי ההליך, שהרי מדובר, כאמור, בתנאי מצטבר להוכחת חוסר יכולת כלכלית. למותר לציין כי אם יזכה המערער בהליך, או שבית המשפט יימנע מחיובו בתשלום הוצאות, אזי יוחזר לו העירבון (בכפוף להיעדר מניעה בדין לכך).
התוצאה היא שהבקשה נדחית. העירבון יופקד תוך 14 ימים מעת המצאת החלטה זו (ימי הפגרה במניין), שאם לא כן יירשם ההליך לדחייה ללא הודעה נוספת.
