החלטה

בקשה לעיכוב ביצוע פסק דינו של בית המשפט המחוזי בירושלים (השופט י' שפירא ; ת"א 5034-03; להלן: פסק הדין ), בגדרו ניתן סעד הצהרתי המורה כי יפוי הכוח הבלתי חוזר נשוא פסק הדין בטל; המבקשים ויעקב עמרם חוייבו לשלם למשיבים 1 ו-2 (להלן: המשיבים ) את סכום האגרה ששולמה בצירוף שכר טרחת עורך-דין בסך של 75,000 ₪; והמשיבים חוייבו לשלם לאוצר המדינה סך של 25,000 ₪.

מקורה של הפרשה שלפנינו בתביעה שהגישו המשיבים לבית המשפט המחוזי, בטענה כי המבקשים גזלו את אדמתם תוך שימוש באיש קש וזיוף יפוי כוח נוטריוני. לאחר בחינת הראיות שהובאו לפניו, ובהסתמך בין היתר על עדותו של עורך הדין אשר אישר את המסמך הנוטריוני, פסק בית המשפט כי אישור זה ניתן מבלי שהחותם חתם לפני הנוטריון וכי טענת הזיוף הוּכחה. על כן, כאמור, קיבל בית המשפט את התביעה למתן סעד הצהרתי לפיו יפוי הכוח הבלתי חוזר בטל.

המשיבים ערערו לבית משפט זה, המבקשים הגישו ערעור שכנגד ומאוחר יותר הגישו בקשה לעיכוב ביצוע, הוא נושא הליך זה. לטענת המבקשים, סיכויי הערעור להתקבל גבוהים, מכיוון שבית המשפט המחוזי העניק משקל רב, למעשה בלעדי, לעדותו של עורך הדין אשר אישר את המסמך הנוטריוני, ולא עימת עדות זו אל מול מכלול הראיות והנסיבות הרלוונטיות. עוד טוענים המבקשים כי מאזן הנוחות נוטה לטובתם, משום שמדובר בפסק הדין בסכום הוצאות גבוה אשר תשלומו עלול לגרום לפגיעה בעסקיהם, עד כדי התמוטטותם. עוד נטען כי מכיוון שהמשיבים הם תושבי איו"ש, יהיה זה קשה עד בלתי אפשרי לגבות מהם בחזרה את סכומי הכסף שישולמו במידה והמבקשים יזכו בערעור. מנגד טוענים המשיבים כי סיכויי הערעור להתקבל הם נמוכים, מפני שהערעור מופנה נגד קביעות עובדתיות של בית המשפט המחוזי, ואין זו דרכה של ערכאת הערעור להתערב בהן. אשר למאזן הנוחות נטען כי עיכוב ביצוע פסק הדין עלול לסכן את האפשרות לבצעו, וכי ישנם פתרונות פשוטים שיביאו למניעת החשש שהעלו המבקשים.

לאחר בחינת טענות הצדדים מזה ומזה באתי לכלל מסקנה כי דין הבקשה להידחות. כידוע, המבקש לעכב ביצוע פסק דין שניתן נגדו נדרש להוכיח כי סיכויי הערעור להתקבל הם גבוהים, וכי מאזן הנוחות נוטה לטובתו. בבקשה שלפנינו אין צורך לדון בסיכויי הערעור, שכן די בשיקולי מאזן הנוחות כדי להביא לדחייתה. ראשית יצויין כי המבקשים טענו אמנם כי רצונם בעיכוב פסק הדין כולו, לרבות הליכי ההוצאה לפועל שנפתחו נגדם בגין אי-תשלום ההוצאות שהוטלו עליהם, אולם הטענות שהעלו נוגעות לתשלום ההוצאות בלבד, ועל כן הדיון יתמקד בעיכוב ביצועה של הוראה זו, שנושאה הוא חיוב כספי. במצבים מעין אלה הנטייה היא שלא להורות על עיכוב ביצוע אלא בנסיבות חריגות כאשר קיים חשש שאם מבקש עיכוב הביצוע יזכה בערעור, הוא לא יוכל לגבות את כספו בחזרה (ע"א 7022/12 עיריית פתח תקוה נ' אוסטוינד (25.10.2012)). הדבר נכון ביתר שאת מקום שמבוקש בו עיכוב ביצוע של תשלום סכומי כסף שנפסקו כהוצאות וכשכר טרחת עורך-דין (ע"א 6593/12 מנאר ייעוץ כלכלי והשקעות בע"מ נ' חמאיסי (23.9.2012)). בענייננו המבקשים אמנם טענו כי תשלום מצדם עלול לגרום לפגיעה בעסקיהם עד כדי התמוטטותם, אולם לא הוצגו ראיות לביסוס טענה זו לבד מהצהרתו הכללית של המבקש 2 לפיה "הדבר עלול לגרום לנו לפגיעה כלכלית חמורה" , אשר אין בה די על מנת להוכיח כי מאזן הנוחות נוטה לטובת המבקשים. אשר לטענה על אודות קשיים בגביית הכספים בחזרה במידה והמבקשים יזכו בערעורם, הודיעו המשיבים על הסכמתם לכך שהכספים המגיעים להם יופקדו בנאמנות לזכותם. אשר על כן, אני מורה על הפקדת סכום חובם הפסוק של המבקשים למשיבים בקופת בית המשפט, עד למתן פסק הדין בערעור. בכפוף לכך נדחית הבקשה לעיכוב ביצוע פסק הדין. המבקשים ישאו בהוצאות המשיבים בסך של 2,500 ₪.
