בקשה למחיקת הערעור
ובקשה להוצאת מוצגים מתיק המוצגים
החלטה
מונחות לפניי שתי בקשות מטעם המשיבים. האחת , למחיקת הערעור עקב אי צירוף משיבים, והאחרת , להוצאת מוצגים מתיק המוצגים של המערערים.
לגבי הבקשה הראשונה : צודקים המשיבים בטענתם כי נפל פגם באי-צירוף כל בעלי-הדין בבית המשפט המחוזי כמשיבים בערעור. תקנה 424 לתקנות סדר הדין האזרחי, התשמ"ד-1984 (להלן: התקנות ), קובעת מפורשות כי "כל מי שהיה בעל דין בתובענה לפני הערכאה הקודמת ואיננו מערער, יהיה משיב בערעור". טענות המערערים בתגובתם – לרבות הטענה בדבר פיצול ההליך בבית המשפט המחוזי, או הטענה כי התביעה נגד הנתבעים האחרים הוגשה מלכתחילה "מטעמי זהירות" – אין בהן כדי לייתר את הצורך בצירוף כל בעלי הדין בערכאה הקודמת גם להליך הערעור. אציין, כי לעיתים קרובות מצורפים להליך הערעור, בהתאם לתקנה 424 לתקנות, משיבים שאין להם בהכרח עניין בהליך, ואלה האחרונים רשאים לבקש שלא ליטול חלק בהליך. אולם אין עומדת ליוזמי ההליך הערעורי, על-פי שיקול דעתם, הבחירה שלא לצרף צדדים מסוימים בניגוד לתקנה 424 לתקנות.
יובהר כי לא נעלמה מעיני טענתם של המערערים באשר לשלב המאוחר שבו הוגשה הבקשה, אולם אין בטענה זו כדי להצדיק את המשך קיום ההליך ללא צדדים שהיה צורך לצרפם מלכתחילה. עם זאת, בנסיבות העניין לא ראיתי לנכון למחוק את ההליך, אלא להורות על תיקון כתב הערעור תוך חיוב המערערים בהוצאות.
לגבי הבקשה השנייה : בתיק המוצגים המוגש בערעור מותר לכלול אך ורק "מסמכים שהוצגו לפני בית המשפט בערכאות הקודמות" (ראו תקנה 437(א) לתקנות). בהקשר זה נפסק לא פעם כי לגבי מסמכים הבאים להוכיח עניין שבעובדה, רשאי בעל דין לצרפם לתיק המוצגים רק אם התקבלו כדין כראיה בערכאה הדיונית, או לחילופין התקבלו כראיה על-פי החלטה המתירה הגשת ראיות נוספות בערעור (ראו למשל ב"ש 153/06 צביח נ' מדינת ישראל , פ"ד מ(2) 345 (1986)). ודוק: על-פי תקנה 457 לתקנות, בעל-דין בערעור אינו רשאי להציג ראיות נוספות שלא הוגשו והתקבלו על-ידי הערכאה הדיונית, אלא אם הדבר הותר במפורש על-ידי ערכאת הערעור. לפי הנחיה 7(ב) להנחיות נשיאת בית-המשפט העליון, "לא תהיה בסיכומים בכתב התייחסות לראיה שהגשתה התבקשה ולא ניתן יהיה לצרפה לתיק המוצגים" (ראו גם ע"א 8320/09 אלחדד נ' שמיר (לא פורסם, 13.12.2010)).
המערערים אינם חולקים על כך שהמוצגים מע/4, מע/5 ו-מע/21 התקבלו לידיהם לאחר מתן פסק הדין נשוא ערעור זה מיום 19.6.2011. בכך נשמטה מניה וביה האפשרות לכלול את המסמכים בתיק המוצגים ללא קבלת רשות, ואין בטענות המערערים בתגובתם כדי להכשיר את המהלך. כך למשל, אין דין שונה ומיוחד לעניין צירוף מוצגים במקום שבו ההליך בערכאה המבררת נדחה מטעמי התיישנות, והמקום הראוי להעלות בו טענות לגבי נחיצותם של המסמכים או לגבי הגשתם בהליך אחֵר הוא בקשה להוספת ראיות המוגשת בהתאם לדין ולהנחיות הנשיאה. לגבי המוצג מע/20 (תוספת לתשובה לבקשה לסילוק על-הסף), לאחר שבחנתי את טענות הצדדים לא מצאתי מקום להורות על סילוקו מתיק המוצגים.
סיכומם של דברים, אני מורה כדלקמן:

המערערים יגישו תוך 5 ימים דף פתיחה חדש להודעת הערעור, בהתאם לתקנה 424 לתקנות. המזכירות תתייק את דף הפתיחה החדש בתיקי השופטים ותעדכן בתכנת ניהול תיקים. המערערים ימציאו לבעלי הדין הנוספים את כתבי בי-הדין ואת החלטות בית המשפט, ללא דיחוי.

המזכירות תחזיר למערערים את סיכומיהם ואת תיק המוצגים מטעמם, והם יגישו סיכומים מתוקנים ותיק מוצגים מתוקן תוך 7 ימים, בהתאם לאמור לעיל.
3.
המועד להגשת סיכומי המשיבים מוארך עד ליום 14.10.2012. המועד להגשת סיכומי התשובה מטעם המערערים מוארך עד ליום 11.11.2012.
4.
המערערים יישאו בשכר טרחת עורך-הדין של המשיבים בגין הבקשות שלפניי בסך של 4,000 ₪.
