בקשה לפטור מאגרה ועירבון
החלטה
מונחת לפניי בקשה לפטור מתשלום אגרה ומהפקדת עירבון. הבקשה הוגשה במסגרת ערעור על פסק-דין של בית המשפט המחוזי בירושלים, שדחה את תביעת הרשלנות הרפואית שהגישו המערערות נגד המשיבים. אומר מיד: אין ספק בדבר נכותה הקשה של המערערת 1, ובדבר ההשלכות שיש לכך על חיי המשפחה. גם בית המשפט המחוזי עמד על כך בסוף פסק-דינו, והתחשב בכך בפסיקת ההוצאות. עם זאת, בית המשפט המחוזי זיכה את המשיבים בתשלום שכר טרחה, גם אם בסכום מתון, ואין לשלול כי אם יידחה הערעור בבית משפט זה, תחויבנה המערערות בתשלום הוצאות. לכן, יש לבחון את הבקשה שלפניי ברגישות המתבקשת אך תוך יישום אמות המידה הרגילות בכגון דא, לאמור: יכולת כלכלית וסיכויי הערעור.
בבקשה שלפניי אין פירוט ותיעוד מלאים לעניין היכולת להעמיד עירבון בהליך. כך, לא הובאו פרטים מלאים ומדויקים – בצירוף אסמכתאות – לעניין הכנסות המשפחה, הוצאותיה ונכסיה, כמו-גם לעניין האפשרות להסתייע בסביבה הקרובה. אדגיש כי התיעוד המלווה את הבקשה דל, ובחלקו אינו עדכני כלל. עוד אציין, בהתייחס לטענה שהועלתה בבקשה, כי עובדת קבלת קצבאות נכות מהמוסד לביטוח לאומי אינה מהווה כשלעצמה ראיה לחוסר יכולת כלכלית (בשונה מקבלת גמלת הבטחת הכנסה). לבסוף אדגיש כי לדברי המשיבים, המערערות טרם שילמו את ההוצאות שנפסקו לחובתן בבית המשפט המחוזי (שכאמור היו על הצד הנמוך). לעניין סיכויי ההליך אציין, מבלי לקבוע מסמרות, כי פסק-הדין של בית המשפט המחוזי הוא מנומק ומפורט ביותר, ועל פני הדברים מציב לפני המערערות משֹוכה גבוהה.
אשר על כן, אין בידי להיעתר לבקשה. עם זאת, בנסיבות העניין מצאתי לנכון לילך לקראתן של המערערות, במובן זה שהאגרה תעמוד על סכום מופחת של 1,500 ₪, והעירבון על סך של 15,000 ₪. התשלום וההפקדה יתבצעו תוך 30 ימים מעת המצאת החלטה זו, שאם לא כן יימחק ההליך או יידחה, לפי העניין, ללא הודעה נוספת.
