בקשה להגשת הודעת ערעור מתוקנת
החלטה
לפניי בקשה מטעם המשיב 9 להורות על תיקון כתב הערעור. שתי טענות בבקשה: ראשית , כי הערעור אינו ערוך בתמציתיות ובבהירות מספקת, ויש בו משום הווכחנות; שנית , כי לערעור צורפו נספחים שאינם מותרים בהגשה בשלב זה.
לגבי הטענה הראשונה , לא מצאתי מקום להורות על תיקון כתב הערעור על דרך של קיצורו או ניסוחו מחדש, וזאת על רקע הגישה הכללית שלפיה בית המשפט אינו משמש "עורך-על" של כתבי-הטענות.
עם זאת, יש ממש בטענה השנייה , שכן על-פי הדין ועל-פי המקובל בבית משפט זה, להודעת-הערעור ניתן לצרף את המסמכים המפורטים בתקנה 419 לתקנות סדר הדין האזרחי, התשמ"ד-1984, לאמור: החלטות של הערכאות הקודמות הנוגעות לעניין. מסמכים אחרים יש לצרף לתיק-המוצגים הנלווה לסיכומי הצדדים – הכול בכפוף להוראות הנוגעות לתוכנו של תיק מוצגים (ראו תקנות 438-437 לתקנות – יצוין כי כל התקנות הנזכרות בהחלטה זו חלות בענייננו מכוח תקנה 34 לתקנות בתי משפט לענינים מינהליים (סדרי דין), התשס"א-2000; כן ראו עע"מ 4573/08 איזוטופ בע"מ נ' עיריית אשדוד (16.7.2008); ע"א 9785/07 פלד נ' כהן-פיתוח-דרעד שותפות מוגבלת רשומה
(26.2.2008)).
לאור האמור, ומכיוון שבהודעת הערעור גופה ישנן הפניות לנספחים שצורפו בטרם עת, יגיש המערער, תוך 7 ימים, הודעת ערעור מתוקנת, שאליה יצורפו רק הנספחים שניתן לצרף בהתאם לתקנה 419 הנ"ל. לכשתוגש הודעת הערעור המתוקנת, תחזיר המזכירות למערער את הודעת הערעור שבתיק.
