בקשה להפחתת סכום ערבון
החלטה
לפניי בקשה להפחתת סכום העירבון שנקבע בהליך זה (25,000 ₪), ולהמרתו בבטוחה המצויה בידי המשיב 1. ביקשתי את תגובת המשיבים אולם בשל שביתת הפרקליטים זו לא הוגשה. משכך ראיתי לנכון לבחון את הבקשה לגופה. בענייננו, נתקלת הבקשה בשלוש משוכות. האחת, היעדר הוכחת חוסר יכולת כלכלית להפקיד עירבון. הטענות המועלות בבקשה בעניין יכולתה הכספית של המערערת, והתיעוד לעניין זה, אינם מספקים ואינם מבססים מסקנה בדבר חוסר יכולת לגייס את סכום העירבון; זאת בין היתר בשים לב להצלחת המערערת לגייס סכום של מיליוני ₪ מגורם חיצוני (סעיף 9 לבקשה). שנית, כבוד השופטת נאור שדנה בבקשה לעיכוב ביצוע קבעה כי סיכויי הערעור אינם נראים גבוהים. שלישית, על מנת שניתן יהיה להסתפק בערובה שאינה שוות-ערך לעירבון במזומן או בערבות בנקאית מבחינת הזמינות, הוודאות והקלות במימוש הבטוחה בעת הצורך, יש לבסס את אותם התנאים הדרושים לצורך פטור מעירבון, קרי: חוסר יכולת כלכלית וסיכויים טובים להליך. בענייננו, על בסיס הנתונים שלפניי לא שוכנעתי כי הוצגה חלופה שוות-ערך, וכאמור לעיל, שני התנאים האמורים לא מתקיימים. עם זאת, בשים לב להיקף ההליך ולעובדה שהמשיבים לא הגישו תגובה, נראה לי כי יש מקום להפחתת סכום העירבון, והוא יועמד לפיכך על סך של 15,000 ₪. סכום זה יופקד תוך 14 ימים מעת המצאת החלטה זו, שאם לא כן יירשם ההליך לדחייה ללא הודעה נוספת.
