החלטה
המשיב הורשע עפ"י הודאתו בעבירה של החזקת נשק (שני אקדחים + מחסנית). בית משפט
קמא הטיל עליו עונש של 6 חודשי מאסר בעבודות שירות. המבקשת הגישה ערעור על גזר הדין ובד בבד עתרה לעיכוב ביצוע פסק הדין.
אין בדעתי להאריך בהלכות עיכוב ביצוע גזר דין. אומר בקצרה, ומבלי להידרש לסיכויי הערעור, על מנת שלא לכבול בדרך כלשהי את המותב שידון בערעור לגופו, כי אם תידחה הבקשה, יהא בכך כדי לאיין את הערעור. בנסיבות אלה, ובהתחשב בכך שמדובר בעונש שתקופתו קצרה יחסית, אני סבור כי ראוי להיעתר לבקשה ואשר על כן אני מורה על עיכוב ביצוע גזר הדין.
הסכום שהופקד להבטחת התייצבות המשיב, יישאר מופקד עד למתן פסק דין בערעור.
המזכירות תקבע את הערעור לשמיעה במהלך שלושת החודשים הקרובים.
