לפניי ערעור על החלטת בית משפט השלום בירושלים (כבוד השופט י' מינטקביץ ) מיום 30.10.2014 שלא לפסול עצמו מלדון בת"פ 51033-12-11.

נגד המערערת ונאשם נוסף מתנהל הליך פלילי בבית משפט השלום בירושלים. כתב האישום לא צורף לערעור, ועל כן פרטי ההליך אינם ברורים. יוער, כי המערערת אינה מיוצגת בערעור דנא על ידי עורך דין. אין זה כלל ברור מי חתם בשמה על הודעת הערעור. ביום 30.10.2014 התקיים דיון בהליך. בדיון התברר, כי בתיק המוצגים שהגישה המשיבה לבית המשפט נכללו הודעות שנגבו מהנאשם הנוסף בקשר לתיק אחר. ההודעות אינן קשורות לכתב האישום שהוגש בהליך נושא הערעור. תיק המוצגים הוחזר לבאת כוח המשיבה, למעט הודעה אחת מטעם הנאשם הנוסף. על רקע זה, ביקשה המערערת כי בית המשפט יפסול עצמו מלשבת בדין, כך שהדיון יועבר לשופט שלא נחשף לחומר שהגישה המשיבה בשוגג.

בית המשפט (כבוד השופט י' מינטקביץ ) דחה את בקשת הפסלות על אתר. הוא קבע כי עצם החשיפה לעבר פלילי של נאשם, קל וחומר לקיומה של חקירה פלילית נגדו בעניין אחר, אינה מקימה עילת פסלות. בהחלטתו ציין כי אכן עיין בהודעות אשר נגבו מהנאשם הנוסף בעניינים שאינם נוגעים להליך המתנהל בפניו. עם זאת, בית המשפט הבהיר כי לא היה בהודעות אלה כדי לבסס דעה קדומה כלפי מי מהנאשמים. עוד הדגיש בית המשפט, כי תוכנן של ההודעות אינו זכור לו משום שלא התעמק בקריאתן, לאחר שמצא כי אינן רלוונטיות לכתב האישום. בית המשפט העיר, כי אין זה ברור מדוע המערערת היא שיזמה את הליכי הפסלות כאשר החומר אליו נחשף בית המשפט נוגע לנאשם הנוסף בהליך. לאחר שדחה את בקשת הפסלות, דחה בית המשפט אף את בקשתה של המערערת להפסיק את הדיון בהליך כדי להעניק לה שהות להגשת ערעור פסלות לבית משפט זה.

בערעור שלפניי חוזרת המערערת על טענותיה בבקשת הפסלות. היא שבה וטוענת כי בית המשפט נחשף לנפח משמעותי של חומר ראיות שאינו קביל. בנוסף, טוענת המערערת כי התנהלותו של בית המשפט, ובכלל זאת הערות שונות מצדו והחלטות דיוניות שקיבל ביחס לעדים ולראיות מלמדות כי גמר אומר להרשיעה. עוד טענה המערערת כי מהתנהלות השופט מינטקביץ היא למדה כי הוא מושפע מעברו כפרקליט בשורות התביעה. המערערת ביקשה לקיים דיון בעל פה בערעור.

דין הערעור להידחות בלא שמיעת טיעונים בעל פה. כפי שנקבע בעבר, אין חובה לקיים דיון בעל פה בערעור פסלות, אף כאשר ההליך העיקרי הוא הליך פלילי, וניתן להכריע בערעור בהתבסס על טיעונים בכתב בלבד (ראו ע"פ 200/10 חן נ ' מדינת ישראל , פיסקאות 2, 3 (7.3.2010); ע"פ 3377/14 ארבל נ' מדינת ישראל
(19.5.2014)).

לגופו של עניין, אין לכחד כי התנהלות המשיבה במקרה דנא מעוררת קושי. מצב בו חומרי חקירה שאינם נוגעים לעניין והמתייחסים לנאשם בהליך פלילי מוצאים את דרכם לתיק בית המשפט איננו מצב תקין, בלשון המעטה. אולם, התנהלות המשיבה לחוד, ודיני פסלות השופט לחוד. הלכה ידועה היא כי חשיפה של בית המשפט לראיות שאינן קבילות אינה מקימה בהכרח עילת פסלות. ההנחה היא ששופט מקצועי מסוגל להפריד בין ראיות קבילות לכאלה שאינן קבילות. רק במקרים בהם נחשף בית המשפט למסה קריטית של ראיות שאינן קבילות יהיה בכך כדי להקים חשש ממשי למשוא פנים ולהביא לפסילתו (ראו, למשל, ע"פ 4492/02 שטייק נ ' מדינת ישראל , פ ' ' ד נו(5) 825, 830-829 (2002); ע"פ 4849/03 שלוש נ' מדינת ישראל (3.7.2003); ע"פ 8080/12 מדינת ישראל נ' אולמרט , פיסקה 14 (הנשיא א' גרוניס ) (6.7.2014); יגאל מרזל דיני פסלות שופט 302-298 (2006) (להלן – מרזל )). כך אף נקבע, כי עצם החשיפה לעבר פלילי של נאשם אינה מהווה עילה לפסילת בית המשפט (ראו, למשל, ע"פ 4492/02 הנ"ל, בעמוד 829; ע"פ 3144/14

במקרה דנא, מסקנתי היא כי אין בחשיפה של בית המשפט לחומר שהוגש בשוגג בעניינו של הנאשם הנוסף, כשלעצמה, כדי להקים חשש ממשי למשוא פנים. המערערת לא הניחה תשתית עובדתית ראויה באשר ל תוכן הראיות שהוגשו בשוגג ועוצמתן, כך שהטענות בהקשר זה נטענו למעשה בעלמא. עילת הפסלות הנטענת היא, איפוא, עצם החשיפה לחומר, שכאמור אינו נוגע להליך המסוים ואינו מתייחס כלל למערערת. אין בכך, בנסיבות העניין, כדי להקים עילת פסלות. בית המשפט הבהיר בהחלטתו בבקשת הפסלות כי נחשף להליכי חקירה בלבד, כאשר כלל לא ידוע לו כיצד נסתיימו. הוא אף ציין כי איננו זוכר את הפרטים שעלו מן החומר, באשר לא התעמק בהם לאחר שמצא כי החומר אינו קשור לכתב האישום בהליך המתברר בפניו. ונוסיף על כל אלה ונזכיר את העובדה כי החומר שהוגש והוחזר למשיבה אינו נוגע כלל למערערת אלא לנאשם הנוסף. לא זו אף זו, מן החומר שהונח בפניי, לא ניתן להסיק כי בהתנהלות בית המשפט הייתה העדפה כלשהי לעמדת המשיבה. בית המשפט אף מתח ביקורת על התנהלות המשיבה בהליך בהחלטתו בבקשה אחרת במסגרת הדיון ביום 30.10.2014, בזו הלשון: "לא ניתן לקבל הגשת בקשה להוספת ארבעה עדי תביעה המוגשת בבוקר ישיבת הוכחות, וזה המעט שניתן לומר על התנהלות המשיבה".

לסיום יצוין, כי לא מצאתי להידרש לטענות הנוספות שהעלתה המערערת בעניין התנהלותו של בית המשפט במסגרת ההליך. דומה שמקומן של אלה איננו בגדרי ערעור פסלות לבית המשפט העליון. מדובר בהשגות על החלטות דיוניות של בית המשפט, עליהן, כידוע, יש לערער על פי סדרי הדין הרגילים (ראו, למשל, ע"פ 2749/14 גאון נ' מדינת ישראל , פיסקה 9 (18.4.2014)). אף אין לקבל את טענת המערערת כי עברו של השופט מינטקביץ כעורך דין בפרקליטות המחוז השפיע על עמדתו בהליך ועל כן יש לפוסלו (ראו, למשל, ע"פ 6185/14 גליק נ' מדינת ישראל , פיסקאות 8-7 (30.9.2014); וכן מרזל , בעמודים 289-286).

סיכומו של דבר, לא מצאתי כי מתקיים בנסיבות העניין חשש ממשי למשוא פנים, כנדרש לפי סעיף 77א לחוק בתי המשפט [נוסח משולב], התשמ"ד-1984.
הערעור נדחה איפוא, מבלי שהמשיבה נדרשה להשיב.
